The Commodity Futures Trading Commission (CFTC) can investigate and prosecute fraud, manipulation, and other violations involving futures, options, swaps, and other commodity interests. It also has anti-fraud and anti-manipulation authority over virtual-currency cash markets when those currencies are commodities traded in interstate commerce. A CFTC settlement may require disgorgement, a civil monetary penalty, restitution, trading or registration bans, and compliance measures—but a penalty is not an automatic refund to customers. Whether customers recover money depends on the order, the claims process, and sometimes a receiver, bankruptcy trustee, monitor, or administrator.
What the CFTC can do in crypto markets
The CFTC enforces the Commodity Exchange Act (CEA) and CFTC regulations. Its clearest jurisdiction covers derivatives: futures contracts, options, swaps, and other commodity interests. The agency also says it may pursue fraud and manipulation in virtual-currency cash markets when the virtual currency is a commodity in interstate commerce.
That authority does not make the CFTC a general regulator of every spot-crypto transaction. The facts of the product, the conduct, the parties, and the market determine whether the CEA and CFTC rules apply. A case involving access to digital-asset derivatives can fit squarely within CFTC jurisdiction even when the underlying asset is a cryptocurrency.
What a CFTC settlement means
A settlement is a negotiated resolution of an enforcement matter. It becomes binding through a Commission order or a federal-court consent order. The document controls: headlines and announcements may summarize the result, but the order specifies who must pay, who may trade, what conduct is prohibited, and how any customer distribution will work.

Read the operative order for the exact payment priority, due dates, interest, releases, and distribution mechanics. A press release describing a proposed settlement is not the same as a final court judgment.

The following matters illustrate how the CFTC separates allegations, forums, monetary remedies, and customer processes. Amounts are the figures stated in the relevant orders or agency announcements.

How customer recovery actually works
Recovery depends on the specific enforcement order and the claims procedure. The CFTC may direct a monitor, receiver, bankruptcy trustee, or claims administrator to identify victims, review documentation, calculate losses, and distribute available funds. In another matter, customers may need to pursue a separate legal remedy.

- Restitution: A victim-directed award for proven losses. The order may define eligible transactions, required evidence, deadlines, and payment priority.
- Disgorgement: Money taken from alleged ill-gotten gains. The order may combine it with restitution or allocate it through a distribution fund, but that result is not automatic.
- Civil penalties: Punitive and deterrent payments. They should never be represented as a guaranteed refund.
- Insolvency proceedings: If the firm is in bankruptcy or receivership, customers may be directed to the trustee or receiver instead of a CFTC claims administrator.
Keep account statements, transaction records, wallet addresses, emails, complaint correspondence, and tax records. Submit only the information requested by the official administrator or court. Do not pay an unofficial “release fee” to someone promising access to a CFTC distribution.
The CFTC Reparations Program for registered professionals
The Reparations Program is an inexpensive, expeditious, and fair forum for disputes with a registered futures or derivatives professional. It is different from a general fraud complaint and different from a distribution fund created by an enforcement order.
The CFTC says actual damages usually mean out-of-pocket trading losses. When an account was churned, actual damages can include a refund of commissions earned through the churning. The Commission may suspend a respondent’s registration or trading privileges for nonpayment, but it does not collect the award for the claimant.

Basic eligibility questions
- Was the respondent registered when the alleged misconduct occurred or when the complaint was filed?
- Did the conduct violate the CEA or a CFTC rule?
- Did that violation cause the loss being claimed?
- Was the complaint filed within the applicable limitations period?
- Is the firm in bankruptcy or receivership, requiring referral to a trustee or receiver instead?
Registration status matters. A claim against an unregistered actor may belong in another forum, even if the conduct also prompted a CFTC enforcement action.
Choosing a reparations proceeding

Before filing, identify the registered entity or individual, calculate the loss transaction by transaction, preserve supporting records, and check the current CFTC forms and deadlines. A reparations award does not guarantee immediate payment if the respondent lacks assets.
How to report crypto fraud or suspicious activity
Customers can submit a complaint or suspicious-activity tip to the CFTC Division of Enforcement. Include a chronological account, names and contact details, dates, products traded, amounts, account identifiers, wallet addresses where relevant, and copies of records. Explain what you believe violated the CEA or CFTC rules without overstating facts you cannot document.

A complaint alerts the agency; it does not automatically open a reparations case, freeze assets, or create a right to compensation. If a separate claims administrator has been appointed, follow that administrator’s instructions as well.

How large can CFTC penalties be?
Individual crypto cases vary widely. The Binance final order listed $1.35 billion in disgorgement and a separate $1.35 billion CMP, while Zhao’s individual CMP was $150 million. Falcon Labs’ order listed $1,179,008 in disgorgement and a $589,504 CMP. My Big Coin’s federal judgment listed $19,326,324 in CMPs and $6,442,108 in restitution.
For broader context, the CFTC reported more than $17.1 billion in total monetary relief for fiscal year 2024: $2.6 billion in CMPs and $14.5 billion in disgorgement and restitution. The agency identified digital-asset cases among that year’s precedent-setting actions. The fiscal-year total combines many matters and should not be used to estimate an individual customer’s recovery.
How to read a CFTC order before expecting payment
- Confirm the document’s status. Determine whether it is a complaint, proposed settlement announcement, Commission order, or final federal-court judgment.
- Separate the remedy types. Locate the exact paragraphs for restitution, disgorgement, CMPs, interest, and costs.
- Find the distribution mechanism. Look for a monitor, receiver, trustee, claims administrator, fund, or later notice explaining how to file.
- Check eligibility and proof rules. Note covered dates, products, customer categories, documentation, deadlines, and priority rules.
- Review restrictions. Trading bans, registration bans, injunctions, and compliance undertakings may protect the market without increasing the money available to customers.
- Verify payment instructions. Use only the contact details in the official order, court docket, or administrator notice.
Common mistakes and safer alternatives
- Mistake: treating every CFTC dollar as customer money. Safer approach: identify whether the amount is restitution, disgorgement, or a CMP.
- Mistake: assuming a settlement guarantees full recovery. Safer approach: wait for the claims procedure and asset-distribution notice.
- Mistake: filing reparations against an unregistered respondent. Safer approach: verify registration and consider whether a trustee, receiver, or another forum controls the dispute.
- Mistake: relying on a press release instead of the order. Safer approach: use the final Commission or court document for deadlines, releases, and payment terms.
- Mistake: reporting without records. Safer approach: preserve original statements, communications, transaction hashes, and a dated loss calculation.
- Mistake: confusing a complaint with a whistleblower submission. Safer approach: file Form TCR when seeking consideration for a whistleblower award.
What a CFTC action can—and cannot—tell a customer
A CFTC action can establish enforceable restrictions, impose monetary obligations, and create a path to restitution or another distribution when the order provides one. It can also document alleged conduct and protect markets through bans and compliance requirements.

It cannot promise that every customer will recover funds, convert a civil penalty into a refund, or substitute for reading the current order and claims instructions. The customer’s practical next step is determined by the named respondent’s status, the remedy authorized, and the deadline set by the applicable court, Commission order, trustee, receiver, or claims administrator.
