In the United States, emulator software and the game files or online service it runs are separate legal questions. An independently written emulator may be lawful, but obtaining unauthorized ROMs, BIOS files, encryption keys, modified clients, or replacement online services can create copyright, contract, and DMCA section 1201 risks. Owning an original cartridge or disc does not automatically authorize downloading or sharing a copy, and preservation exceptions are narrow.
The legal answer depends on what you are doing
“Using an emulator” describes several different acts. Writing software that imitates a console, dumping a cartridge you lawfully possess, downloading a ROM from an unknown site, bypassing authentication, and operating a public replacement server are not legally interchangeable. The relevant questions are who made each copy, how access controls were handled, what the game license says, whether other people receive the files or service, and which country’s law applies.

Emulator code is different from the game copy
Why an emulator can be lawful
An emulator is a program that reproduces the behavior of another system. If developers create it independently rather than copying protected source code, the emulator itself is not automatically illegal. In Sony Computer Entertainment v. Connectix, the Ninth Circuit found that intermediate copying during reverse engineering could support a fair-use defense in the circumstances before it. That decision is useful precedent for independently developed software, not a blanket immunity for every emulator project.
Details matter. Copying code instead of observing functional behavior, distributing decompiled portions, incorporating proprietary firmware, or adding tools whose purpose is to defeat access controls can change the analysis. A court would examine what was copied, why it was copied, how the resulting program was distributed, and the effect on the copyright owner’s market. A favorable precedent does not decide those facts in advance.

Why the ROM or BIOS creates a separate problem
The game image, console BIOS, encryption key, and a modified client are expressive software or other protected material. Downloading one from an unauthorized site makes another copy; uploading it or sharing it with a friend implicates distribution rights. A BIOS or key can also be a technological component that controls access, so extracting or using it may raise section 1201 issues even when the emulator program itself was independently written.
Nintendo’s official FAQ states that playing a pirated version of a game is against the law. That publisher statement is not a court ruling about every possible archival or personal-use fact, but it illustrates why a lawful emulator does not make an unauthorized game image lawful.
“I own the cartridge” is not a universal ROM license
Buying a physical game gives you ownership of that particular object, subject to the applicable license and copyright rules. It does not automatically authorize obtaining a digital copy from an unauthorized website, distributing a dump to other people, or bypassing an access control. The authorities considered here do not establish a broad rule that ownership of a cartridge or disc makes ROM sharing legal.

A copy made or supplied without permission can still be unauthorized even if the recipient has purchased an original. Whether a particular self-made archival copy is permitted can depend on the device, the applicable exemption, and whether circumvention was required; the facts should be reviewed rather than assumed.

DMCA section 1201 can matter even when the use is personal
Section 1201 of the Digital Millennium Copyright Act addresses circumvention of technological measures that control access to copyrighted works, as well as certain trafficking in circumvention tools. This is a different question from whether the final use would otherwise qualify as fair use. A person can therefore face an anti-circumvention issue even when the intended play is private, noncommercial, or involves a game they purchased.
What can count as circumvention in this context
- Removing or bypassing encryption or authentication that prevents the game from running.
- Extracting a protected BIOS, key, or client by defeating a technical restriction.
- Redirecting an official client around a subscription or server check.
- Distributing a tool or modified client that is designed to evade those controls.
The law includes exemptions adopted through a rulemaking process. They are limited by work, user, institution, and purpose, and they can change over time. An exemption is not a general permission to copy every game or to publish a replacement service. Check the wording and current period of any exemption instead of relying on a summary from an emulator forum.
Why unauthorized fan servers carry extra risk
Publisher terms can prohibit the service itself
Online games typically involve an end-user license, terms of service, or both. Those contracts may restrict reverse engineering, unauthorized servers, protocol emulation, account access, and redistribution of client files. A server can therefore create a contract dispute even if it does not distribute a complete ROM.
Blizzard’s legal FAQ states: “you may not host or provide matchmaking services for any of our games or emulate or redirect the communication protocols used by Blizzard Entertainment® in the network feature of its games … without the prior written consent of Blizzard Entertainment®.” That is the publisher’s stated position and a warning about its terms; it is not, by itself, a holding that every fan server is infringing.

Courts have recognized circumvention claims
In Davidson & Associates v. Jung, the Eighth Circuit upheld claims involving the bnetd server emulator. The court found that the system was designed to circumvent technological measures controlling access to Battle.net and Blizzard games. The decision shows why a server that reproduces a proprietary authentication or matchmaking service can present more than a simple copyright-copying question.
Factors that increase or reduce exposure

“Private server” is therefore not a legal category that resolves the issue. A closed server can still use protected assets, violate a contract, or bypass authentication. Conversely, a project with permission and a properly licensed client may have a materially different risk profile.
What preservation exemptions actually allow
Eligible institutions
Current U.S. regulations permit eligible libraries, archives, and museums to circumvent access controls for lawfully acquired complete games that are no longer reasonably available, subject to stated conditions. The exemption is institution-focused. It does not turn an individual’s emulator setup into a generally exempt activity, and it does not authorize an institution to distribute the game publicly without satisfying other copyright rules.
Eligibility, lawful acquisition, the game’s availability, the preservation purpose, and the technical method all matter. An institution should document those facts and follow the exact regulatory limits rather than treating “preservation” as a magic word.

When an external authentication server shuts down
A separate narrow exemption can permit qualifying institutions to restore access for personal, local gameplay after a copyright owner stops providing an external authentication server. The permission is aimed at maintaining access inside the institution or for the permitted users. It does not create a general right to run a public replacement server, sell access, or make the game available to everyone on the internet.
A practical decision process before you install or host anything
- Identify the jurisdiction. The analysis here is U.S.-focused. If you are elsewhere, check local rules on reverse engineering, copyright exhaustion, contracts, preservation, and circumvention.
- Separate every component. List the emulator executable, BIOS or firmware, game image, client patch, server software, and authentication method. Do not treat them as one legal object.
- Trace each file’s source. Record whether it was independently written, dumped from your own media, supplied by a rights holder, or downloaded from an unauthorized site. Do not redistribute files merely because you own the physical game.
- Read the current game license and service terms. Look specifically for reverse-engineering, protocol-emulation, server, account, and redistribution restrictions.
- Check for circumvention. Determine whether encryption, authentication, subscription checks, or another technical measure must be bypassed. If so, identify a current exemption that actually covers your user status, work, and purpose; otherwise obtain permission or stop.
- Limit distribution. A local setup is different from publishing ROMs, BIOS files, keys, modified clients, or a public matchmaking endpoint. Keep files and access within the rights you can document.
- Get written permission for a fan service. A signed license or explicit authorization should identify the game, territory, duration, client and server rights, trademarks, monetization, and shutdown obligations.
- Use qualified legal advice for a public project. A preservation lab, community server, or commercial operation should have counsel review the exact software, terms, and technical design before launch.
Common situations and the likely pressure points
“I downloaded an emulator and own the disc.”
The emulator and the disc ownership are separate from the source of the game image. The immediate questions are whether the emulator was independently developed, where the image came from, and whether any protection was bypassed. Ownership of the disc alone does not answer those questions.
“I downloaded a ROM for a game I bought years ago.”
The purchase does not automatically authorize a website’s copy or your redistribution of it. Copyright and section 1201 analysis turns on the copying and access-control facts, not simply on whether you once paid for a physical copy.

Shutdown does not itself waive contract, copyright, or circumvention rights. A replacement server may emulate a protected protocol, redirect the official client, use publisher assets, or bypass authentication. A written license or a narrowly applicable institutional exemption is materially safer than assuming abandonment equals permission.

“Our museum wants to keep a dead game playable.”
A qualifying library, archive, or museum may be able to rely on the preservation and shutdown-authentication exemptions, but only within their conditions. The institution should verify eligibility, lawful acquisition, reasonable unavailability, user limits, and whether the proposed access is local rather than public.
“Nobody charges money, so it is legal.”
Noncommercial operation can affect some defenses and remedies, but it does not erase copyright, contract, or anti-circumvention rules. Free distribution of a ROM or free access to an unauthorized server can still create liability.
Permission is the clearest way to change the analysis
Written permission from the copyright owner can address server hosting, protocol use, client modification, trademarks, distribution, and payment. It should be specific enough to cover the actual technical arrangement rather than merely saying that a community may “preserve” the game. Keep records of the grant, its territory and term, the files it covers, and any takedown or security requirements.

Without permission, the safest design choices are to use independently authored software, avoid distributing protected game files, avoid bypassing access controls, respect the game’s license, and keep any activity within a clearly applicable legal exemption. Those choices reduce risk; they do not guarantee a court would reach a particular result.
Jurisdiction changes the result
This explanation addresses United States law. Other countries may apply different rules to reverse engineering, private copying, exhaustion of rights, contractual restrictions, preservation institutions, and circumvention technology. A setup that appears permissible under one country’s law can still violate the law where the operator, users, server, or copyrighted work is located. The Library of Congress describes copyright guidance as general and simplified information rather than legal advice, so a cross-border or high-visibility project should obtain advice for each relevant jurisdiction.
Bottom line for players and preservation projects
An emulator can be lawful without making every ROM lawful. A purchased cartridge or disc is not a blanket license to download or share an image. DMCA anti-circumvention rules can apply to private, noncommercial play, while preservation exemptions are narrow and directed mainly at eligible institutions. Fan servers add contract and service-emulation risks, especially when they redirect an official client or defeat authentication. Before proceeding, separate the code, files, controls, server, distribution method, permission, and jurisdiction; the answer turns on that complete fact pattern.
