Yes, they can—unless a binding sovereignty requirement, contract and technical design prevent it. A cloud region or primary data-centre address is only one part of the answer. Replicas, snapshots, disaster-recovery copies, support sessions, administrator access, logs, metadata and telemetry can follow different routes. For personal or mixed data leaving the European Economic Area (EEA), you also need a lawful GDPR transfer mechanism and a documented assessment of the destination country’s laws and government-access risks.
Residency is not the same as sovereignty
Data residency answers a narrow question: where a particular copy is stored. Sovereignty asks a broader set of questions about storage, processing, control and legal exposure. A service can keep production workloads in one country while sending backups to another region, routing support through an overseas operations team, or exporting telemetry to a separate analytics platform.
For a sovereignty review, map every path taken by the service:
- Live customer data and the systems that process it.
- Replicas, snapshots, cache copies and disaster-recovery images.
- Support and troubleshooting sessions, including remote console or break-glass access.
- Privileged administration, identity services and management-plane traffic.
- Logs, metadata and telemetry, including service-generated data about your use of the platform.
- Subcontractors, software suppliers and external analytics or monitoring services.
These paths may have different locations, operators and retention periods. An “in-country” label therefore does not prove that every flow stays in the country, or even in the same legal jurisdiction.

Start with the type of data and the location that matters
Personal and mixed datasets
Personal data remains governed by the General Data Protection Regulation (GDPR). If it leaves the EEA, the transfer needs a recognised legal mechanism. A dataset that combines personal and non-personal elements is generally treated as personal data when the elements are inextricably linked. You cannot avoid the GDPR transfer rules simply by calling the workload mixed or by placing the database in an EU facility.
Non-personal data inside the EU
EU policy supports the free movement of non-personal data within the Union. Public authorities retain access for regulatory control even when the data is stored or processed in another EU country or in the cloud. That freedom does not remove security, contractual or authority-access concerns, but it means an EU-to-EU move is not treated like a transfer of personal data outside the EEA.
Data that crosses the EEA boundary
For personal data sent outside the EEA, the European Commission identifies several tools: an adequacy decision, standard contractual clauses (SCCs), binding corporate rules, approved certification, codes of conduct and limited derogations. The choice depends on the parties, destination and circumstances; a generic statement that a provider uses “EU contracts” is not enough.

What Schrems II adds to a transfer decision
The Schrems II judgment requires more than signing SCCs. You must assess the destination country’s laws and practices, the specific circumstances of the transfer and whether public-authority access powers are necessary and proportionate. Where the assessment identifies a material risk, supplementary measures may be required.

For a cloud service, document the data categories, purpose, frequency, destination, onward transfers and access roles. Then examine whether a government could compel access to the data, keys, management plane or support records. Technical measures such as strong encryption, customer-controlled keys, strict identity boundaries and minimised telemetry can reduce exposure, but they must be described precisely: encryption does not solve a case where the provider controls the decryption keys or can access plaintext during support.
How EU sovereignty criteria go beyond a data-centre address
The European Commission’s Cloud and AI Development Act material describes four sovereignty levels. Level 1 begins with infrastructure located in the Union. Higher levels add independence from third countries, supply-chain transparency, Union ownership and control, and protection from third-country interference. The progression shows why a region selector alone cannot establish sovereignty.
Working material published on EUR-Lex in 2026 goes further by expressly including customer data, metadata and telemetry. Under those criteria, they remain in the Union unless the customer explicitly requests otherwise. The criteria also examine outsourced technical and operational support, provider ownership and control, subcontractors, third-country governmental access and data generated through use of the service.
Use these criteria as a checklist rather than as a marketing label. Ask which level your regulation or contract requires, then verify each boundary with evidence. A service may satisfy an infrastructure-location requirement while failing an ownership, support-access or telemetry requirement.

Where cloud data can leave your jurisdiction
Backups and disaster recovery
Backup systems often have their own region settings, retention policies and replication defaults. A snapshot may be copied to a second region for durability; a disaster-recovery image may be retained for months; a support export may be stored temporarily in a case-management system. Ask separately about live data, replicas, snapshots, backup archives and recovery-test copies. Require the provider to state where each is stored and processed, how long it is retained and what happens when a region becomes unavailable.
Support and privileged access
Support personnel may work from another country even when the workload is local. Follow-the-sun operations, subcontracted technicians and emergency access can create an overseas path to production systems. Determine whether staff can view plaintext, run commands, download diagnostics or change configuration. Confirm the countries from which access is permitted, the approval process, session recording, time limits and post-access review. A policy that says access is “restricted” should be backed by operator-location records and privileged-access logs.
Telemetry, logs and metadata
Telemetry can contain identifiers, resource names, IP addresses, error payloads, query fragments or configuration values. Metadata can reveal tenant names, administrators, locations and usage patterns even when application content stays local. Obtain the telemetry schema, destinations, retention periods, redaction rules and the analytics services involved. Ask whether customers can disable optional fields, choose an in-jurisdiction endpoint or keep raw logs under their own control.

The provider’s place of incorporation, parent-company control, subcontractors and supply chain affect legal exposure. Identify who owns and controls the service, which entities can administer it and which third-country laws could apply. A local subsidiary or local data centre does not by itself eliminate the possibility of a foreign-government request to a parent company or subcontractor.

Exit and resilience
Sovereignty also includes the ability to leave. Check whether data can be exported in a documented format, whether restoration can occur without an overseas control plane, and whether continuity testing depends on a foreign region or support team. Record egress terms, recovery objectives, key availability and the steps for deleting all replicas after termination.
Contract terms that make sovereignty enforceable
Put the required boundaries in the order form, data-processing agreement, security schedule and service description—not only in a policy webpage. At minimum, define:
- Geography: countries or jurisdictions for live data, replicas, snapshots, backups, recovery copies and processing.
- Support: permitted operator locations, subcontractor use, remote-console capability, approval requirements, session logging and emergency-access procedures.
- Telemetry: fields collected, destinations, retention, redaction, customer controls and any analytics provider.
- Legal requests: notice and challenge procedures for foreign-government demands, disclosure limits and the customer’s right to receive relevant information where legally permitted.
- Security controls: key ownership, identity and administration boundaries, encryption responsibilities and supply-chain controls.
- Change control: advance notice and approval rights for a new region, subcontractor, support location or telemetry destination.
- Deletion and exit: export format, recovery testing, deletion deadlines for every copy and evidence of completion.
For personal data leaving the EEA, attach the appropriate transfer mechanism and the transfer-impact assessment. State which supplementary measures are relied upon and who maintains them when the provider changes its architecture.

A practical vendor-assessment workflow
- Classify the workload. Mark personal, mixed and non-personal data, and identify whether any dataset leaves the EEA.
- Draw the complete flow. Include production, replicas, backups, support tools, administration, telemetry, metadata, subcontractors and recovery operations.
- Set the required boundary. Decide whether the requirement is country-only, Union-only, or a higher sovereignty level involving ownership, supply chain and third-country interference.
- Test legal exposure. For an EEA exit, select the transfer mechanism and complete a Schrems II assessment covering destination law, access powers and supplementary measures.
- Validate controls with evidence. Reconcile contracts, diagrams, logs, policies and monitoring records. Resolve differences before go-live.
- Test failure and exit. Run a restore, confirm that keys and administration remain available within the boundary, and verify deletion and export procedures.
- Monitor continuously. Review new regions, support locations, subcontractors, telemetry fields, government requests and audit records at each material change.
Direct answers to common sovereignty questions
Can a cloud backup be stored in another country?
Yes, unless a contract, regulation or technical policy prohibits it. Backup geography must be checked separately from the primary region, including snapshots and disaster-recovery copies.
Can overseas support see production data?
Potentially. Remote operators or subcontractors may have access even when the servers are local. Confirm operator locations, permissions, approvals, recording and whether diagnostics contain plaintext.
Does telemetry leave the region?
It may. Telemetry and metadata are explicitly within the scope of EU sovereign-cloud criteria. Obtain the schema and destination list, then restrict or redact fields that cannot leave the required boundary.
Is an EU data centre enough?
No. It addresses infrastructure location but not replicas, support, telemetry, ownership, subcontractors, supply-chain control or third-country legal exposure.
Can a foreign government compel access to data hosted locally?
Local hosting does not automatically remove that risk. Assess the provider’s ownership and control, subcontractors, applicable third-country laws and the process for responding to requests. For non-personal data, the Data Act does not prohibit cross-border flows; it adds safeguards for third-country public-body requests, including measures such as encryption, audits and certification. Providers should publish protective measures and, where possible, inform customers before access.
What a defensible sovereignty decision looks like
A defensible decision ties each requirement to a documented control and an auditable record. The result should show where every copy and flow goes, who can access it, which legal mechanism covers an EEA transfer, how foreign-government requests are handled and how the service can be restored or exited without an unapproved overseas dependency. If any of those answers is missing, treat the service as unproven rather than assuming that the advertised region provides sovereignty.
