Yes. People and organisations in the United States, United Kingdom, European Union, Canada, Australia and elsewhere can use Chinese AI models through hosted chat services, provider APIs, or self-hosted open-weight releases. The important question is not simply whether a model is reachable from your country. You must establish which endpoint you are using, where prompts and logs are processed, which provider entity controls the service, and what privacy, export-control, procurement and AI-law obligations apply.

A hosted service can route personal data to China even when you connect from another country. A model deployed in your own cloud can keep prompts inside infrastructure you control, but it does not remove your responsibilities as a data controller, employer or AI-system operator.

Three ways to use a Chinese AI model abroad

Hosted chat applications

A browser or mobile chatbot is the simplest route. You create an account, send prompts to the provider’s service and receive generated text, code or other output. The provider normally controls the servers, storage, logging, abuse monitoring and support access. Country availability can change independently of the model itself, and an app being downloadable does not prove that its processing complies with your organisation’s policy.

Official APIs and cloud regions

Businesses can call a model from software through an API. The account, endpoint and selected region determine the data path. Alibaba Cloud’s current documentation, for example, says its DeepSeek Responses API supports selected models only in the China (Beijing) and Singapore regions. That means “available internationally” is not a single technical status: availability differs by model, API capability, account type and region.

Self-hosted or customer-cloud weights

Some Chinese developers release open-weight models. You can place the weights on premises, in a private data centre or in your own cloud tenancy and expose an internal inference service. Alibaba states that Qwen supports on-premises deployment, official APIs and deployment in an organisation’s own cloud. This can give you control over network routing, retention and access logs, but you still operate a production AI system and remain responsible for its security and lawful use.

Does using one send prompts to China?

It can, especially with a provider-hosted chatbot or endpoint whose processing region is China. DeepSeek’s privacy policy, last updated February 14, 2025, states: “When you access our Services, your Personal Data may be processed and stored in our servers in the People’s Republic of China.” The policy lists account information, user input, device and network information, log information, location information and cookies.

This is a statement of the provider’s policy, not a promise that every product, future endpoint or enterprise contract has identical routing. A different regional endpoint may have different storage and support arrangements. Before sending data, obtain the service’s current terms and technical documentation and verify:

  • the country or region used for inference;
  • where prompts, uploaded files, account records, logs and backups are stored;
  • which provider entity and subprocessors can access the data;
  • how long content and telemetry are retained;
  • whether inputs or outputs are used for model training, abuse detection or product improvement;
  • what support personnel can see and under what access controls; and
  • whether the service provides deletion, export and audit records.

Do not infer data residency from the domain name, billing currency, language setting or the physical location of your office. Ask for the precise endpoint and contract that will handle your traffic.

How to keep prompts out of China

Choose a documented non-China endpoint

If a provider offers a processing region in your jurisdiction or another approved country, use that endpoint only after confirming that storage, backups, support and subprocessors follow the same boundary. A “Singapore” inference region, for example, does not by itself prove that all logs or support access stay there.

Run the model in your infrastructure

Self-hosting or customer-cloud deployment can keep prompts and generated results within infrastructure controlled by your organisation. Network egress rules can block unapproved telemetry, and an internal gateway can enforce authentication, retention and redaction. This approach requires capacity planning, patching, vulnerability management, monitoring, incident response and model-version governance. It also shifts the burden of proving compliance to you rather than eliminating it.

Reduce what the model receives

Where a hosted route is unavoidable, remove direct identifiers, confidential passages and unnecessary metadata before transmission. Use synthetic or de-identified examples for experimentation, and prohibit regulated or export-controlled material until legal and security teams approve the endpoint. Redaction lowers exposure; it is not a substitute for a lawful transfer and an approved contract.

Is DeepSeek legal under GDPR?

There is no blanket rule making every use of a Chinese model illegal in the European Union. The decisive issues are the data involved, the parties and purposes, the transfer mechanism, the technical safeguards and the applicable use case. The European Commission said on June 2, 2025 that “any transfer of personal data to China by DeepSeek needs to take place in compliance with the EU’s General Data Protection Regulation (GDPR).”

Transfers to China

If personal data leaves the European Economic Area for a Chinese provider, identify the GDPR transfer tool and document why it is effective. The Commission’s guidance identifies the modernised Standard Contractual Clauses (SCCs) as contractual safeguards for transfers from EU/EEA controllers or processors to third countries. SCCs do not automatically legalise a transfer. Your assessment should address the provider’s ability to honour the clauses, local-authority access, encryption, key control, retention, onward transfers and the rights available to individuals.

Third-country government requests

The European Data Protection Board’s June 5, 2025 guidance on GDPR Article 48 explains how organisations should assess requests from non-European authorities for personal-data transfers. A demand from a foreign authority is not, by itself, a GDPR transfer mechanism. Establish a process for challenging or narrowing requests, notifying the customer where permitted, recording decisions and applying supplementary technical measures.

Your role still matters

Determine whether your organisation is a controller, processor or joint controller for the prompts and outputs. Set a lawful purpose, provide required notices, limit collection, configure retention and honor access or deletion requests. A provider’s privacy policy cannot transfer those duties to the employee who pasted the data into a chat box.

How the EU AI Act changes the analysis

The AI Act can apply based on where an AI system’s output is used, not only where its developer is established. Providers and deployers outside the EU can fall within its territorial reach when output is used in the EU. Classify the actual arrangement: a general-purpose AI model, a high-risk system integrated into a regulated process, or a use that triggers transparency duties.

General-purpose models with systemic risk

The European Commission states that systemic-risk GPAI models placed on the EU market must meet obligations covering technical documentation, model evaluations, systemic-risk assessment and mitigation, and cybersecurity. Those GPAI rules applied from August 2, 2025. If your organisation integrates such a model, clarify which duties belong to the provider and which belong to the deployer, then retain evidence of evaluations, controls and instructions.

Transparency

Commission guidance on Article 50 says providers outside the EU can be subject to applicable transparency obligations when their output is used in the EU. Consider whether users must be told that content was generated or manipulated by AI, and keep the notices and records required for the particular deployment. An ordinary internal experiment may have a different classification from a customer-facing decision system.

Government-device bans and access restrictions

Consumer availability does not override a government or regulated-sector prohibition. On January 30, 2025, Italy’s data-protection authority ordered an urgent limitation on processing Italian users’ data by Hangzhou DeepSeek and Beijing DeepSeek and opened an investigation after finding the companies’ responses unsatisfactory. The European Commission later recorded restrictions on Australian government devices and Danish Parliament devices, while Taiwan advised government officials against using the service.

These measures can change and may apply only to specified public bodies, devices or purposes. Check your national regulator, procurement rules, employer policy and device-management controls immediately before deployment. A public-sector employee should not install a consumer application merely because it works on a personal phone or is available in an app store.

Contracts, sanctions and export controls

DeepSeek’s Open Platform Terms state: “You recognize that you are solely responsible for complying with all applicable Export Control and Sanctions Laws related to the access and use of the Services of you and your end user.” The terms also state that disputes are governed by the laws of the People’s Republic of China and may be brought where DeepSeek’s registered office is located.

Have procurement and counsel review the provider entity, governing law, venue, service-level commitments, suspension rights, indemnities, intellectual-property allocation, confidentiality, breach notification and deletion terms. Screen the intended users, countries, customers and subject matter against sanctions and export-control rules. A model that is technically reachable may still be unsuitable for a government contract, defence project or controlled technology.

Hosted service versus self-hosting

Decision axis Provider-hosted chatbot or API Self-hosted or customer-cloud model
Data path Provider determines inference, storage, logs, backups and support access; verify each region. Organisation can set network routes and storage boundaries, subject to its cloud and operational design.
Operational effort Fastest to start; provider runs infrastructure and updates. Organisation manages hardware or cloud capacity, upgrades, monitoring, security and incident response.
Compliance control Relies on contract, provider documentation, transfer safeguards and available settings. More direct control, but the organisation must implement and evidence controls itself.
Model and feature access Depends on account, endpoint, model version and supported region; capabilities can differ. Depends on released weights, licenses, hardware and the team’s ability to operate them.
Best fit Low-risk experimentation or workloads approved for the provider’s documented data path. Sensitive workloads requiring residency, private networking, custom retention or detailed auditability.

A practical approval checklist

  1. Name the exact service. Record the model name and version, provider legal entity, chatbot or API endpoint, account type and processing region.
  2. Classify the inputs. Separate public, internal, personal, confidential, regulated and export-controlled data. Block higher-risk categories until an owner approves them.
  3. Read current documents. Review the privacy policy, terms, retention and training settings, subprocessor list, security documentation and deletion process. Save the version and review date.
  4. Map the data flow. Document inference, storage, backups, telemetry, support access and onward transfers. Test the actual endpoint rather than relying on marketing language.
  5. Complete legal assessments. For EU personal data, select a GDPR transfer mechanism, perform a transfer-impact assessment and specify supplementary safeguards. Assess the AI Act role, sector rules, sanctions and export controls.
  6. Apply technical controls. Use single sign-on, least-privilege access, redaction, secrets management, network egress restrictions, retention limits and audit logs. Disable optional training or telemetry where the contract and product allow it.
  7. Test outputs safely. Check hallucinations, prompt-injection resistance, content controls, copyright handling and human review before production use. Do not allow generated text to make an unreviewed high-impact decision.
  8. Plan an exit. Keep a fallback model or process, export prompts and configuration where permitted, and define how to revoke keys and delete provider-held data.
  9. Recheck before launch and periodically. Provider regions, model versions, regulator orders, government restrictions and terms can change. Reconfirm them immediately before launch and on a scheduled review cycle.

Common failure modes and fixes

“The app works here, so it must be approved”

Technical access says nothing about procurement or privacy. Fix this by requiring an approved endpoint, data classification and documented owner before installation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“SCCs solve everything”

SCCs are a transfer framework, not an automatic finding of adequacy. Add a transfer-impact assessment, supplementary measures, access-rights analysis and a procedure for government requests.

“Self-hosting removes all legal risk”

It can remove a provider-side transfer, but your organisation still determines lawful collection, retention, security, access, copyright treatment and model governance. Apply the same control framework to an internal deployment.

“A regional label proves residency”

Inference, logs, backups and support may use different locations. Obtain written technical and contractual confirmation for each data category and subprocessors.

Bottom line for users in the US, UK, EU, Canada and Australia

Chinese AI models can be used outside China, but “can I access it?” and “may my organisation use it for this data?” are separate questions. Use a hosted service only when its endpoint, contract and data path meet your requirements. Prefer a documented non-China region or a self-hosted/customer-cloud deployment for sensitive information, and remember that local operation changes the route of the data rather than removing GDPR, AI Act, security, sector or export-control duties.
