Yes. A molecule suggested by ChatGPT, a generative chemistry system or another AI model can be patented if the claimed invention meets the ordinary legal tests: patent eligibility, novelty, inventive step or non-obviousness, utility or industrial applicability, and adequate disclosure. The model’s involvement does not make a compound automatically patentable or unpatentable.
The difficult questions are usually evidentiary and legal: what a human actually contributed to the claimed invention, whether an AI-generated disclosure was public and enabling before the filing date, whether the specification supports the full chemical scope, and which person or organization owns the rights. U.S. and European practice now treat AI as a tool, not an inventor.
What can be patented when AI suggests a molecule?
A patent application may target different forms of the same discovery. The claim strategy should be chosen before drafting because each form requires different proof.
- Compound claims: the precise molecular structure, including defined stereochemistry where relevant.
- Species and subgenus claims: a particular molecule or a narrower structural class within a broader chemical genus.
- Composition claims: a salt, polymorph, formulation or mixture containing the compound.
- Use claims: treatment of a specified disease, a biological use, or another technical application supported by evidence.
- Manufacturing claims: a synthesis route, catalyst, reaction condition or purification process.
- Screening or assay claims: a method that identifies activity or selects compounds, if the method has the required technical character and support.
An AI output is only a starting point. The patentable subject matter is the human-defined, legally eligible invention described in the claims and specification, not the text generated by the model.

The patentability tests still apply
Novelty
Novelty asks whether a single prior-art reference made every element of the claimed invention available before the relevant filing or priority date. An identical chemical structure, a disclosed stereoisomer, or a reference that directly and unambiguously teaches the claimed composition can defeat novelty. A different name does not make a known structure new, so chemical searching must go beyond keywords.
Inventive step or non-obviousness
A claim can fail even when no reference shows the exact molecule. A close analogue combined with a predictable substitution, a routine optimization path or an expected property may make the claimed variation obvious to a skilled person. A surprising technical effect can support inventiveness, but the effect must be credible, tied to the claim scope and supported by evidence rather than asserted as an AI prediction.
Utility, industrial applicability and technical character
U.S. practice requires a useful invention; European practice also examines industrial applicability and, where relevant, technical character. A therapeutic claim should identify a credible use and the application should explain how the compound performs that use. A model’s probability score or predicted binding result is not automatically proof of practical utility.

The specification must describe the invention and teach a skilled person how to make and use it without undue experimentation. The analysis considers the breadth of the claims, the nature of the chemistry, the state of the prior art, the skill level, the amount of guidance, predictability and working examples.
For an AI-designed molecule, a bare prompt-and-answer transcript is weak support. Preserve an identified structure, stereochemistry, proposed or demonstrated synthesis, analytical characterization and utility evidence. Broad genus or Markush claims require support across the claimed range; a few predicted molecules may not justify every untested species.

Can an AI-generated document become prior art?
Prior art is knowledge available before the relevant filing or priority date. The origin of the disclosure does not control. A document generated by an AI system can be prior art if it was publicly accessible in time and provides an enabling technical teaching.
When an AI disclosure is potentially prior art
- Public accessibility: the document was posted, published, indexed, distributed or otherwise available to the public.
- Timing: it was accessible before the application’s relevant filing or priority date.
- Technical content: it discloses the claimed subject matter, not merely a vague idea or an unidentifiable model output.
- Enablement: it teaches a skilled person how to make or use what is claimed without undue experimentation.
A private response generated inside a company or laboratory is generally not public prior art merely because the file exists. Confidentiality, access permissions and the actual publication event matter. A later-publicized AI output does not normally become earlier prior art just because the model produced it years earlier.
How to search for a molecule
Search the structure, not only the proposed name. Record the publication date, priority claims, jurisdictions and the portions that teach preparation or use.
- Run exact-structure, substructure and similarity searches in chemical and patent databases.
- Review patent families and applications, including different naming conventions and salt or stereochemical forms.
- Check non-patent literature, theses, conference materials and publicly accessible regulatory disclosures.
- Look for sequence, assay, formulation or target disclosures that may anticipate a use or method claim.
- Search publicly available AI-generated papers, reports or patent-like documents and verify when they became accessible.
- For each reference, ask whether a skilled person could actually make and use the disclosed compound.
Earlier-filed patent applications may also have prior-art effect under applicable statutes, subject to jurisdiction-specific exceptions. The filing team should preserve the date and version of every search result.
Who is the inventor when AI found the compound?
Only natural persons can be named inventors under current U.S. and European practice. The U.S. Patent and Trademark Office’s November 2025 revised guidance rescinded its 2024 AI-specific guidance and states that the same inventorship standard applies to all inventions: AI systems are tools, and a human must have contributed to conception of the claimed subject matter. The USPTO presumes a named human is the actual inventor unless the record raises a question.

The USPTO’s 2024 announcement that “AI-assisted inventions are not categorically unpatentable” remains useful context, but the November 2025 revision is the current U.S. operating guidance.

The European Patent Office likewise requires a human inventor under the European Patent Convention. The applicant must identify that person and explain how the right to the invention was obtained from the inventor.
Human activities that may matter
Inventorship is claim-specific and fact-dependent. A scientist may contribute by defining the technical problem, selecting a model output, recognizing which structure solves the problem, proposing a modification, or conceiving the claimed synthesis or use. Merely owning the computer, paying for a subscription or asking a generic prompt does not by itself establish conception. Conversely, a person need not perform every experiment if that person contributed to the conception of the claimed invention.
Create a claim-by-claim record showing which natural person contributed to each inventive concept. Do not list the model, software company or an institution as an inventor. Incorrect inventorship can create correction, ownership and enforceability problems even when the chemistry itself is patentable.
Who owns the patent?
Inventorship and ownership answer different questions. Inventorship identifies the human contributors to conception. Ownership is a property question governed by employment agreements, sponsored-research terms, university policies, laboratory rules and written assignments.
A company may own the rights by assignment even though an individual researcher remains the named inventor. The USPTO states that a patent or application is assignable by a written instrument and that the assignment transfers an ownership interest to the assignee. Review the agreements in force before filing rather than assuming that the person who operated the AI tool owns the result.

Ownership checks before filing
- Identify who supplied the AI system and under whose account or laboratory it was used.
- Review employment, contractor, collaboration and sponsored-research provisions.
- Determine who set the research objectives and who selected, modified or rejected model outputs.
- Confirm who performed experiments and generated data supporting the claims.
- Check confidentiality, publication-review and invention-disclosure obligations.
- Execute and record written assignments from every inventor required by the governing jurisdiction.
AI service terms may affect confidentiality or permitted use, but they do not replace the patent-law analysis of inventorship or the written agreements that transfer ownership.
Evidence an AI-assisted patent file should preserve
Keep an auditable record from model suggestion to filing. The record should distinguish prediction from demonstrated fact.
- Model name, version, provider, access date and account used.
- Prompts, settings, retrieved context and complete outputs, including rejected candidates.
- Human selection criteria, edits, structural changes and reasons for choosing the claimed molecule.
- Source code, computational workflows and input data used to generate or rank candidates.
- Laboratory notebooks, dated protocols, yields, analytical data and assay results.
- Evidence of utility, including controls and the limits of any prediction.
- Disclosure dates, confidentiality measures and the date each contributor learned or documented the invention.
Do not state that a compound was synthesized or tested unless contemporaneous records support that statement. If evidence is predictive only, draft claims and examples that accurately reflect that limitation.

- Freeze the evidence. Export model conversations and preserve version, date, prompts, outputs, code, notebooks and experiment files in a controlled record.
- Define the claim target. Decide whether protection is sought for an exact compound, stereoisomer, salt, composition, therapeutic use, assay or manufacturing process.
- Search broadly. Use structure and substructure searches plus patents, applications, journals, theses, conferences, regulatory materials and public AI-generated documents.
- Map human conception. For every proposed claim, identify the natural person who contributed to conception and document the contribution.
- Check rights. Review employment, university, collaboration and sponsored-research terms; obtain written assignments where required.
- Build the specification. Include reproducible synthesis, characterization, utility evidence and support for the full proposed claim scope.
- Control disclosure. File before public disclosure where possible. Obtain jurisdiction-specific advice on confidentiality, grace periods and any statutory exceptions.
- Reconcile the final claims with the evidence. Remove species, uses or breadth that the description and data cannot credibly support.

Common failure modes and how to correct them
Listing the AI as an inventor
Problem: The application names a model or describes it as a co-inventor. Correction: identify only natural persons who contributed to conception and retain the records supporting that determination.

Assuming a private output is automatically prior art
Problem: An internal model response is treated as a public disclosure. Correction: establish whether the material was accessible to the public, when it became accessible and whether it was enabling.
Claiming a broad chemical genus from a few predictions
Problem: A Markush claim covers thousands of untested structures although the specification shows only a handful. Correction: narrow the scope or add credible examples, synthetic guidance and data that support the claimed breadth.

Problem: A docking score or generated rationale is presented as demonstrated biological activity. Correction: label predictions as predictions and include reproducible experimental evidence where a claim depends on activity.
Ignoring contracts until after filing
Problem: A university, employer, sponsor or collaborator later asserts rights. Correction: review obligations and obtain assignments before filing and before any public presentation.
Searching only the AI-proposed name
Problem: Prior art is missed because the reference uses another synonym, salt, stereochemical notation or structure. Correction: search exact, substructure and related structures and inspect the underlying disclosure.
Bottom line
An AI-suggested molecule may be patentable, but the patent succeeds or fails on ordinary legal requirements and the quality of the human and chemical evidence. Treat the model as a research tool, document the human conception of each claim, search public and enabling disclosures before the filing date, support the full scope with reproducible chemistry and utility data, and separate inventorship from ownership assignments.
