Sometimes they can complete a purchase without asking you to approve that specific transaction—but that does not mean an AI agent has unlimited authority to spend your money. Some checkout flows require confirmation for every order; others are designed for transactions within a budget, payment-token limit, or other boundaries you previously set. Whether a particular purchase was actually authorized depends on what you agreed to, the product’s terms, and the circumstances.
What does “without your permission” mean?
An agent may be able to initiate a payment technically, but capability is not the same as permission. The useful question is what you authorized it to do: which task, with which sellers or kinds of items, up to what amount, for how long, and whether it must ask before completing the purchase.
For example, asking an agent to find “the best running shoes under $100” could mean you want recommendations, a prepared checkout, or an actual order. Unless the interface makes clear which action your instruction permits, don’t assume that asking it to shop also authorizes it to buy.
Stripe’s service terms define “Authority” in its own agentic-commerce setting as the express scope a customer gives an agent, potentially including spending limits, merchant restrictions, and time limits. That is a contractual definition for Stripe’s service, not a general legal definition. Stripe’s terms also describe transactions as unauthorized in that setting when they were not authorized, exceeded the customer’s authority, or resulted from bugs, hallucinations, or misinterpretations, among other circumstances.

Which purchase flows require a fresh confirmation?
The amount of approval varies by flow. A “buy” button, a delegated payment token, a wallet budget, and an automated machine payment do not all grant the same permission.

These are descriptions of particular product approaches, not a guarantee that every merchant participates or that every implementation offers the same controls. Visa says its AI-Ready Cards approach uses tokenized credentials tied to specific agents and use cases, with real-time authorization and fraud monitoring; its stated user controls include spending limits, merchant-category restrictions, and approval requirements. How those controls work depends on the implementation.

How can you tell whether a purchase is within the permission you gave?
Before enabling an agent to transact, look for controls that make the boundary explicit. A broad instruction such as “handle this for me” is harder to assess than a task with a seller, amount, duration, and approval rule.
- Task: Does permission cover finding options, placing an order, or both?
- Amount: Is there a maximum per purchase, per task, or for the whole wallet?
- Seller and category: Can the agent buy only from a named merchant or within specified categories?
- Time: Does the authorization expire, or can it be reused?
- Approval: Must you confirm each order, or only purchases above a threshold?
- Token scope: If a payment token is used, what seller, amount, and period is it restricted to?
- Records and stop controls: Can you see completed or pending transactions and prevent the agent from making more?
A token or spending cap can limit what a credential can be used for, but it does not by itself determine whether a transaction was legally authorized or how a dispute will be resolved.

Who handles the order if something goes wrong?
In OpenAI’s described Instant Checkout flow, the merchant accepts or declines the order, processes payment through its provider, and handles fulfillment and customer support. OpenAI says it passes necessary information between the user and merchant, and its developer documentation says OpenAI is not the merchant of record. For an item that was never shipped, a return, or a refund request, the merchant is therefore a key point of contact in that described flow.
Stripe’s terms likewise place fulfillment and post-fulfillment obligations—including shipping, returns, refunds, and exchanges—on the seller. Those terms also allocate certain unauthorized-transaction risks between Stripe and its user. That allocation applies to the parties and service covered by the terms; it should not be treated as a universal rule about who is liable in every purchase.

For a real disputed order, check the relevant seller, payment-provider, and platform terms, then contact the appropriate provider. Whether a charge can be reversed or who bears responsibility depends on the applicable agreements, payment arrangements, facts, and jurisdiction.
Does the law let an AI agent buy without asking each time?
The product descriptions and terms discussed here do not establish a universal legal answer. A legal conclusion about a specific purchase requires the relevant jurisdiction and facts, including what the customer authorized and what the applicable agreements say.
