Autonomous weapons should be governed by a combination of firm prohibitions and strict limits: ban systems whose effects cannot be adequately understood or predicted, and systems designed to target people directly; constrain other systems by target, location, duration and scale; and require informed human judgment, effective intervention, legal review, realistic testing and accountability. International humanitarian law (IHL) already applies, but the International Committee of the Red Cross (ICRC) says new legally binding rules are needed to make the boundaries clear.

What counts as an autonomous weapon?

The defining feature is autonomy in the critical targeting functions: selecting a target and applying force to it. The ICRC defines an autonomous weapon system as a weapon that, once activated, can select and engage targets without further human intervention. Autonomous navigation or flight by itself does not meet that definition.

This distinction matters because “military AI,” “armed drone” and “autonomous weapon” are not interchangeable labels. A system may use AI to navigate, identify information or assist an operator while a human still selects and authorizes each target. Conversely, a comparatively simple rule-based system can be autonomous in the relevant sense if it selects and engages targets on its own. The question is what the weapon does after activation, not whether it uses a particular kind of software.

Nor does autonomy automatically make every weapon unlawful. The concern is whether people can use a particular system in a particular situation in compliance with IHL, and whether the weapon’s effects can be sufficiently understood, anticipated and controlled. That assessment becomes harder when a system can act over a broad area, for a long time, against changing targets or conditions.

Why should some autonomous weapons be prohibited outright?

Two categories warrant prohibition rather than reliance on case-by-case operational caution: systems whose functioning or effects cannot be sufficiently understood, predicted or explained, and systems designed or used to apply force directly against human beings.

Unpredictable systems

A weapon that can behave in materially different ways in comparable circumstances is difficult to use safely and lawfully. If its effects cannot be anticipated with sufficient confidence, people may be unable to distinguish military objectives from civilians and civilian objects, assess expected incidental harm, or take feasible precautions. The ICRC’s concern is that unpredictability can make a weapon indiscriminate by nature, rather than merely risky in a particular deployment.

Opacity is relevant when it prevents commanders and operators from understanding how the system will function, what its limits are, or why it produces a particular engagement. The prohibition proposed by the ICRC is not a blanket rejection of autonomous functions; it draws a line at systems that cannot be adequately understood and predicted.

Systems that target people directly

The second red line is a weapon designed or used to apply force directly against human beings. This is not simply a question of whether a machine can recognize a person. It is about delegating the selection and engagement of human targets to the weapon, without a human making the relevant judgment. The ICRC argues that decisions about life and death require human judgment and moral restraint that a system cannot supply.

In an August 25, 2026 joint appeal, UN Secretary-General António Guterres and ICRC President Mirjana Spoljaric warned that the world was “dangerously close to crossing a moral red line: the autonomous targeting of humans by machines.” That appeal reinforces the proposed prohibition; it does not establish that every system with autonomous functions is covered by it.

How should other autonomous weapons be constrained?

Systems outside the prohibited categories should be limited by both their design and their conditions of use. The goal is to make the system’s possible effects narrow enough for decision-makers to understand and assess under IHL, including the rules of distinction, proportionality and precautions in attack.

Constrain the target and situation

Where possible, use should be limited to objects that are military objectives by nature, rather than targets defined by ambiguous behavior or context. A system’s target profile should be specific enough that users can assess what it may engage and whether those targets are lawful in the proposed circumstances.

Use should also be barred in situations where civilians or civilian objects are present if the system cannot reliably account for changing circumstances. A weapon that may be usable in a tightly bounded environment does not thereby become suitable for a populated, fluid or otherwise different setting. The assessment must match the system to the actual mission conditions.

Bound the operating area, time and scale

Each authorization should specify a defined geographic area, a short and reviewable activation period, and a limit on the number of systems, targets or engagements permitted before fresh human authorization is required. Open-ended permissions make it harder to anticipate the effects of deployment and to keep the operation within the conditions assessed in advance.

These limits should be operational controls, not merely paperwork. If a system leaves its authorized area, reaches the end of its activation window, or exceeds its approved engagement limit, it should not continue to apply force under the same authorization.

Make the constraints work together

Target restrictions cannot make up for an unlimited operating area, and a short time limit cannot make an unpredictable system safe. A sound authorization combines target type, geography, duration, scale and environmental conditions. The narrower and more clearly specified the envelope, the more feasible it is for commanders to anticipate the weapon’s possible effects and decide whether using it is lawful.

What does meaningful human judgment require?

Meaningful human control is not satisfied simply because a person presses an activation button. The people authorizing and operating the weapon need enough information, authority and time to make a real decision about its use, and a practical way to stop or suspend an engagement.

The ICRC’s March 3, 2026 legal briefing emphasizes that “it is not the weapon system that must comply with IHL, but the humans using it.” That places responsibility on the people and organizations making and carrying out decisions. A system’s autonomy does not remove the duty to assess the expected effects of an attack or to take applicable precautions.

In practical terms, commanders and operators should understand the system’s capabilities and limitations, its target logic, the environment for which it was approved, and how it may fail. They should decide whether and how it may be used, and retain the practical ability to suspend or terminate the engagement. “Human in the loop” and “human on the loop” are not sufficient descriptions by themselves: what matters is the person’s actual authority, information, timing and capacity to intervene.

The U.S. Department of Defense implementation model offers concrete examples. Directive 3000.09, most recently updated in January 2023, calls for systems to allow commanders and operators to exercise “appropriate levels of human judgment over the use of force.” It also emphasizes adequate training, tactics, techniques, procedures and doctrine, as well as an interface that trained operators can readily understand. These are examples of a national policy framework, not a substitute for international rules.

What should review and testing cover before deployment?

States should require legal review before a weapon is developed and deployed, document the limits on its operation, and require realistic evaluation of its performance and safety. Where a system has significant autonomy, approval should receive senior-level scrutiny rather than being left solely to routine field-level authorization.

Review the actual intended use

A review should address the weapon’s design and the specific operational constraints proposed for it. That includes which targets it may engage, the environment and geographic area in which it may operate, the authorized duration and scale, the conditions that require human intervention, and the conditions under which it must stop. A legal assessment of the weapon cannot be separated from how it is intended to be used.

Test realistic conditions and failure modes

Evaluation should cover the full intended operating envelope, not just ideal conditions. Relevant scenarios include degraded communications, changing environmental conditions, civilian presence, sensor failure, adversarial inputs and loss of operator connectivity. Testing should establish whether the system remains reliable and suitable in those circumstances and whether its safeguards function as intended.

The U.S. baseline summarized by the Congressional Research Service requires covered systems to demonstrate appropriate performance, capability, reliability, effectiveness and suitability under realistic conditions. It also calls for retesting when a change—including a machine-learning-related change—alters the system’s operating state or could affect safety features. A previous approval should not silently carry over to a materially changed system.

How can intervention and deactivation be reliable?

An override is meaningful only if it can work in time to prevent or halt an unsafe engagement. The intervention channel must remain available throughout the authorized operating period, be reliable under expected conditions, and give the operator enough information to recognize when action is needed.

Systems should have tested fail-safe behavior when communications, sensors, navigation, identification confidence or other approved environmental assumptions fall outside their limits. The appropriate response depends on the system and mission, but it must be defined and tested in advance; a nominal promise that an operator can intervene is not enough if the system may act faster than the operator can assess the situation or if the connection may fail without a safe response.

Effective supervision also requires a clear operating picture and understandable alerts. Operators need to know when the system is approaching a boundary, when confidence or system status has changed, and when an engagement is underway. The ICRC calls for effective human supervision and timely intervention; U.S. policy similarly emphasizes robustness and reducing the probability and consequences of failures.

How should accountability be preserved?

Rules should assign responsibility to identifiable people and organizations, rather than allowing a weapon’s autonomous operation to become an excuse for unaccountability. Opaque decision processes can make it harder to determine what happened after unlawful harm, so the ability to investigate should be designed into authorization and recordkeeping.

Records should preserve enough information to reconstruct the decision and the system’s behavior. Depending on the operation, that includes who authorized the mission, the operating parameters and target profile, the system version, relevant alerts, operator interventions or overrides, and engagement outcomes. Records must be sufficient to support review and investigation; recording data without preserving the context needed to interpret it will not answer who made which decision or whether the approved limits were followed.

Accountability should cover the full chain of decisions, from approval and mission planning to operation and post-incident review. Commanders and operators remain responsible for applying IHL, while organizations must ensure the system is reviewed, constrained, maintained and used under the rules that govern it.

Are existing laws enough, and what international rules are needed?

Existing IHL is relevant and applies to autonomous weapons. The policy gap identified by the ICRC is that current rules do not, in its view, sufficiently clarify which systems cannot comply and how other systems must be constrained. National directives and voluntary principles can help states implement safeguards, but they do not provide a common, legally binding international floor.

In their August 25, 2026 appeal, Guterres and Spoljaric called for negotiations on a legally binding instrument with clear prohibitions and restrictions. They identified the Seventh Review Conference of the Convention on Certain Conventional Weapons (CCW), scheduled for November 16–20, 2026, as the clearest available path to begin negotiations. As of November 5, 2026, that conference is still upcoming; it has not yet produced a treaty.

A useful international instrument would be specific enough to establish enforceable red lines against unpredictable systems and direct autonomous targeting of humans, while setting strict limits for all other systems. It should also be technology-neutral enough to cover future designs, rather than depending on a particular AI method or platform name. The ICRC’s proposed prohibitions and restrictions and the U.S. review framework address different layers: international rules set common boundaries, while national policy can supply review, testing, training and operational procedures.

How can you compare safeguard proposals?

Look past broad promises of “responsible AI” and check what a proposal actually requires. These questions make it easier to distinguish a binding prohibition from a voluntary process or a policy that leaves too much to individual operators.

  • Does it ban the unacceptable? Check whether it prohibits systems that cannot be sufficiently understood or predicted and systems that target people directly, rather than relying only on careful use.
  • Which targets may be engaged? Ask whether the rules prioritize objects that are military objectives by nature or allow less clearly defined target profiles.
  • Is the system predictable? Decision-makers should be able to understand and anticipate its functioning and effects in the approved setting.
  • Is the operating envelope bounded? Look for limits on geography, duration, scale, environmental conditions and civilian presence.
  • Can a person make and stop the decision? Human judgment must be informed and timely, with actual authority and a workable means of intervention.
  • Can compliance be checked afterward? Look for legal review, realistic testing, retesting after relevant changes, records, investigation and appropriate senior approval.

What does current use establish—and what does it not establish?

Autonomous weapons are already used in bounded contexts against military objectives by nature, including missiles, radars and warships, often where civilians are absent or excluded and under human supervision. Those examples show that some autonomous functions can be used in constrained settings; they do not establish that autonomy generally improves civilian protection.

The narrower conclusion is that operational usefulness in a controlled environment does not automatically transfer to a broader target set, larger geographic area, longer duration or more variable conditions. Expanding those dimensions can increase unpredictability, escalation risk and the difficulty of complying with distinction, proportionality and precautions in attack. A safeguard regime therefore has to govern not just what a system is called, but what it can do and the circumstances in which people authorize its use.

Frequently Asked Questions

Can the same autonomous weapon be acceptable for one mission but not another?

Yes. The legality and safety assessment depends not only on the weapon’s design but also on its intended targets, operating environment and constraints. Approval for a bounded mission does not establish suitability for a different mission with different conditions.

Does international humanitarian law stop applying when a weapon makes its own targeting decision?

No. IHL continues to govern the humans who authorize and use the weapon, including their duties concerning attacks. Autonomy changes how decisions are carried out; it does not create an exception to those duties.

Has the November 2026 CCW conference already adopted a treaty on autonomous weapons?

No. As of November 5, 2026, the Seventh CCW Review Conference is scheduled for November 16–20, and the UN Secretary-General and ICRC President have identified it as a path to begin negotiations. A call to negotiate is not an adopted treaty.
