A website screenshot can reproduce copyright-protected writing, artwork, photographs, or other expressive content on the page. Making the image is not automatically infringement, but public availability is not permission to republish it either. In the United States, the answer depends on what the screenshot contains, why and how you use it, any license or site terms, and the four-factor fair-use analysis. This article explains the U.S. framework; other countries use different rules.
What a website screenshot can copy
Copyright can protect original expression displayed on a web page, including articles, illustrations, photographs, videos, distinctive graphics, and original page text. The U.S. Copyright Office explains that copyright does not protect facts, ideas, systems, or methods of operation, although it may protect the way those things are expressed. A screenshot is an image, but it can still embody a reproduction of the protected expression visible inside it. A page may also combine material owned by different people: the site’s layout and writing, a stock photograph licensed from another company, a user comment, a logo, and an embedded video. Permission for one element does not necessarily clear the others.
There is no automatic screenshot exemption
Neither “it was online” nor “it is only a screenshot” creates a blanket exception. A publicly viewable page is not a public-domain work. Copyright normally belongs to the author or other rights holder unless the term has expired, the work was released under a license, or another legal rule applies.

Attribution is useful and may be required by a license, but a credit line by itself does not grant copyright permission. Likewise, calling a use educational, noncommercial, newsworthy, or “only a small crop” does not decide the result. Those facts can matter to an exception such as fair use, but none is conclusive.
How U.S. fair use applies to a screenshot
Section 107 of the U.S. Copyright Act uses four factors. Courts weigh them together; there is no percentage, pixel size, word count, or fixed number of screenshots that is automatically safe. The Copyright Office’s Fair Use FAQ and Fair Use Index describe the framework. Only a federal court can finally determine whether a particular use is fair.
1. Purpose and character
Ask what the screenshot does in your new work. Commentary, criticism, news reporting, teaching, scholarship, and research are examples of purposes identified in the statute. A screenshot that lets readers analyze a deceptive interface, compare a design, document a public event, or explain a software bug has a different function from an image used merely as decoration.
Courts also consider whether the use is commercial and whether it adds a new purpose or meaning. Commercial publication is not automatically infringing, and nonprofit or educational status is not automatic permission. Explain the point the image serves and use no more of the page than that point requires.

2. Nature of the source material
Consider whether the captured material is mainly factual or creative, and whether it was published or unpublished. A screenshot of a table of public facts may present a different question from a screenshot centered on an original photograph, illustration, or highly creative article. This factor is only one part of the analysis; factual material can still be expressed protectably.
3. Amount and substantiality
Measure both quantity and qualitative importance. A narrow crop can reduce the amount copied, but a small image showing the “heart” of a photograph, illustration, or article may still be substantial. A full-page capture may be harder to justify when a headline or small excerpt would communicate the same point. Conversely, showing the complete interface may be necessary when the interface itself is what you are reviewing.
4. Effect on the potential market
Ask whether your image substitutes for the original or harms an existing or reasonably expected market for the work. A low-resolution screenshot embedded in a critique may not replace the source, while a high-quality capture that lets people consume the page without visiting it could have a different effect. Consider licensing markets for photographs, screenshots, archives, or commercial reprints when those markets exist.
Prominence and recognizability can matter
Do not assume that a screenshot is too small or incidental to count. In Richardson v. Townsquare Media, Inc., No. 25-291 (2d Cir. Apr. 23, 2026), the Second Circuit held at the pleadings stage that recognizable, prominently displayed screenshots taken from videos could not be dismissed as de minimis. It vacated the judgment as to those screenshots and remanded the case. The dispute concerned video screenshots in online headlines, not website-page screenshots generally. It illustrates why context, prominence, and recognizability deserve attention.
Permission, licenses, and site terms
Before publishing, look for a copyright notice, reuse or press policy, Creative Commons or other license, and terms of service. Follow the exact conditions: attribution wording, noncommercial limits, cropping restrictions, link requirements, or a request for written permission. A policy may cover only the site’s own text and images, not third-party material displayed there.
The European Court of Human Rights copyright and disclaimer page demonstrates how specific these policies can be. It allows certain reproduction with acknowledgment for private use or information and education connected with the Court’s activities, while requiring prior written permission for other uses, including commercial use, and separately discusses photographs. That is the Court’s policy, not a general rule for every website or a statement of European copyright law.

A practical decision process before you post
- Identify every visible work. List text, photos, illustrations, logos, video frames, comments, charts, and distinctive graphics. Note which appear to be third-party material.
- Define the image’s job. Write one sentence explaining whether it documents, comments on, criticizes, teaches, reports, or merely decorates.
- Reduce the capture. Crop or redact unrelated expressive material, personal data, account details, and third-party images when they are not needed.
- Check permission. Save the relevant license or policy and comply with its conditions. If rights are unclear, ask the site owner and the creator of separately credited material.
- Evaluate the four factors. Record the purpose, source’s creative or factual character, amount and qualitative importance, and possible market effect. Treat this as risk analysis, not a formula.
- Document your basis. Keep the source URL, capture date, permission correspondence, license version, and the explanation of why the image is necessary.
- Escalate high-risk uses. Obtain individualized advice for advertising, product packaging, paid campaigns, large prominent reproductions, or a threatened claim.

These patterns do not predict a court’s result. The surrounding facts and the rights in each component control.
Other rights besides copyright
Clearing copyright does not resolve every issue. A screenshot can display trademarks, personal information, confidential data, publicity rights, contractual restrictions, or platform rules. A person’s name or image, an exposed email address, or an account dashboard may create privacy or security concerns even when the underlying text is not copyrighted. Review those issues separately and remove sensitive information unless it is necessary and lawful to publish.
Capture a defensible record
For documentation, preserve the original URL, date and time, your browser or capture settings, and an unedited archival copy. Keep a working copy with redactions and a note identifying what was removed. If a page changes frequently, record the page’s visible state and the reason that state matters. Do not defeat access controls or capture private areas without authorization.

Reduce its dimensions, crop to the relevant interface, and place explanation next to it. If the screenshot is the subject of the article, explain why the full or prominent view is necessary and seek permission when practical.

When to obtain legal advice
Consider a copyright lawyer or qualified legal service when the use is central to a paid campaign, merchandise, a high-traffic commercial publication, a full-resolution reproduction, or a dispute or takedown demand. The Copyright Office cannot decide whether your particular use is fair or provide individual legal advice.

Does putting a copyright notice on a website prevent screenshots?
No. A notice signals claimed rights but does not itself decide whether a particular screenshot is licensed, fair use, or otherwise lawful.
Can I screenshot a page that anyone can view?
You can usually make a personal copy for ordinary browsing, but public visibility alone does not authorize republication. The planned publication and the material captured determine the legal analysis.
