Some synthetic cells are alive in the biological sense; others are engineered cell-like systems that do not meet all accepted criteria for life. The decisive questions are what the construct can do—metabolize, maintain itself, process information, grow, reproduce and evolve—and, separately, which oversight rules apply to its materials, use and environment. A chemically synthesized genome inside a functioning bacterium can produce a living organism, but a non-replicating vesicle that runs an enzyme reaction is not automatically alive. Law does not supply one universal “alive” label: regulators usually classify a system by its characteristics, intended use, containment and possible effects.
“Synthetic cell” describes a continuum, not a single invention
The phrase synthetic cell covers systems at very different levels of construction. At one end are simple compartments made from nonliving components, such as vesicles that contain enzymes or genetic molecules but cannot reproduce. At the other are genome-containing cells that grow and divide. Between those endpoints are protocells, cell-free genetic systems, minimal organisms and hybrid designs that combine engineered parts with a natural cellular chassis.
The 2026 National Academies framework organizes this continuum by complexity: “from left to right, simple, non-replicating systems with no genetic material to genome-containing, replicating systems.” Its first classification layer asks two practical questions: is genetic material present, and does the system replicate? A second layer examines intended function, operating environment, novel substances, persistence, interactions with living organisms, evolvability, gene transfer and misuse potential.
This approach also draws boundaries. Purely chemical systems with no cellular characteristics, conventional genetically engineered organisms, and cells carrying synthetic genomes that are otherwise identical to natural organisms fall outside the report’s core definition, although gray areas remain. A system can therefore be synthetic in one sense—because its genome, membrane or operating program was designed by people—without being a “synthetic cell” under every scientific or regulatory framework.

What “alive” means in biology
There is no universally accepted laboratory test that produces a yes-or-no answer for every borderline system. Biologists instead look for a coordinated set of properties. The more of these functions a construct performs autonomously, the stronger the case that it is alive.
Organized metabolism
Living cells obtain and transform energy through networks of chemical reactions. The reactions must be organized and linked to the cell’s maintenance, growth or reproduction. A vesicle that performs one supplied enzymatic reaction is active, but that activity alone does not establish metabolism in the biological sense. Stronger evidence would be a system that acquires resources, powers its own maintenance and directs energy toward making additional cellular components.
Homeostasis
Homeostasis is the active regulation of internal conditions. Natural cells control concentrations of ions, acidity, water and other variables despite changes outside the membrane. A compartment that merely traps a solution has a boundary, not necessarily homeostasis; it would need feedback and corrective processes that keep its internal state within workable limits.

Cells store, read and use information. DNA or another heritable polymer can encode instructions, while molecular machinery interprets those instructions to build and regulate the system. Information storage by itself is not enough: a DNA-coated bead is not a living cell unless the information participates in an integrated, self-maintaining process.
Growth and reproduction
Growth means making more of the system’s organized material; reproduction means producing an offspring that inherits the relevant organization. A construct that divides only when supplied with extensive external parts may be partially autonomous. A system that uses its own machinery to copy its genetic information, assemble components and produce viable descendants is much closer to ordinary life.

Evolutionary capacity
Populations of living organisms can vary, pass traits to descendants and be shaped by selection. Evolvability is not required by every philosophical definition of life, but it is an important practical indicator. A self-replicating construct with heritable variation can adapt in ways that a one-shot chemical device cannot.
These criteria are best treated as a profile rather than a checklist with one mandatory item. A researcher should state which criteria are being applied and which functions depend on supplied materials or an external cell.

The following comparison shows why “synthetic cell” and “alive” cannot be used as synonyms.
| System type | Genetic material | Replication | Metabolic autonomy and homeostasis | Growth, evolution and chassis | Typical context |
|---|---|---|---|---|---|
| Non-replicating vesicle | May have none, or contain supplied DNA/RNA | No autonomous replication | Usually limited to programmed or externally driven reactions | Does not grow or evolve as a population; no cellular chassis required | Drug delivery, compartment experiments and basic protocell studies |
| Cell-free genetic system | DNA or RNA is present | Copies may be made in a reaction, but the complete system does not reproduce as a cell | Depends on supplied energy, enzymes and substrates | No inherited cellular organism; no natural chassis | Gene-expression and biosensor research |
| Protocell | May contain genetic material | Often non-replicating or only partly self-copying | Some designs show compartmentalization or reaction networks, but not full autonomy | Life-like functions are partial; chassis is built from nonliving components | Bottom-up origin-of-life and synthetic-biology research |
| Minimal bacterium | Yes | Autonomous growth and division under suitable conditions | Integrated metabolism and regulation, though reduced to essential functions | Can evolve; may use a natural or heavily modified cellular chassis | Studying the minimum gene set needed for cellular life |
| Cell with a synthetic genome | Yes, with chemically synthesized or extensively redesigned DNA | Can be autonomous if the host cell and genome support growth | Provided by the cellular machinery and metabolism | Living and evolvable; typically begins with a pre-existing cell chassis | Synthetic genomics and genome-function studies |
| Fully bottom-up autonomous cell | Would be designed and assembled from nonliving parts | Would reproduce without a natural cellular chassis | Would need integrated metabolism, regulation and repair | Would represent the strongest claim of life from nonlife; not established by the JCVI example | Long-term construction goal |
The table separates three issues that are often conflated: whether a system is made by people, whether it is built from nonliving ingredients, and whether it functions as an autonomous organism.
JCVI-syn3.0: the clearest living example
The J. Craig Venter Institute (JCVI) reports that researchers designed and constructed JCVI-syn3.0, a minimal synthetic bacterial cell. Its genome contains about 531,000 base pairs and 473 genes, and JCVI described it as the smallest genome of any self-replicating organism at the time of publication in 2016.

JCVI-syn3.0 is alive under ordinary biological criteria: it uses cellular metabolism, maintains itself, grows and divides, and can pass its genome to daughter cells. Its DNA was chemically synthesized and assembled through a design-build-test process, with genes derived from earlier JCVI-syn1.0 work. The organism is therefore a living bacterium with a synthetic genome.
That achievement does not prove that scientists assembled a complete living cell from nonliving molecules. Researchers used a pre-existing cellular chassis into which the synthetic genome was installed. The chassis supplied membranes, cytoplasmic machinery and other structures needed to boot and run the genome. JCVI’s milestone summary distinguishes the first bacterium with a synthetic genome in 2010 from the minimal bacterial cell reported in 2016; both milestones concern synthetic genomics and cellular engineering, not a final demonstration of fully bottom-up life.
JCVI describes synthetic genomics as two linked operations: synthesizing complete genomes or chromosomes, then booting those nucleic acids to make viruses or living cells. The broader goal is to design DNA that predictably produces cells with biological functions not already found in nature. That goal concerns control and function, not a claim that every engineered cell is a new category of life.
Is “Synthia” a living organism?
“Synthia” is sometimes used informally for JCVI’s synthetic-genome organisms. If the name refers to a JCVI organism that contains a synthetic genome and grows and reproduces in a cellular chassis, the organism is biologically alive. The fact that people designed its DNA does not remove it from the category of living bacteria.
If “Synthia” refers instead to a non-replicating prototype, vesicle or cell-free system, the answer depends on the functions that particular construct performs. The name alone cannot establish life; genetic material, autonomous metabolism, homeostasis and reproduction must be assessed for the actual system.

What makes a synthetic cell different from a GMO?
“GMO” is a broad practical term for an organism whose genetic material has been altered using biotechnology. A synthetic cell may be a GMO, but the categories overlap rather than match.
| Question | Synthetic-cell description | GMO description |
|---|---|---|
| What is being classified? | A system defined by how its cellular components, genome and functions are designed or assembled | An organism defined by genetic modification, regardless of whether its cell architecture is synthetic |
| Must the genome be chemically synthesized? | No. Some systems use engineered parts or natural components; JCVI-syn3.0 uses a chemically synthesized genome | No. A targeted edit, inserted gene or other modification can qualify |
| Must it be alive? | No. Protocells and non-replicating compartments can be called synthetic cells | Usually the term is applied to living organisms, although regulators may also govern genetically modified materials |
| Must it have a natural cellular chassis? | No; bottom-up designs seek to avoid one, while hybrid systems use one | Most GMOs begin with an existing organism or cell line |
| What matters for oversight? | Replication, persistence, intended use, interactions, gene transfer and misuse potential | The modified organism, trait, exposure route, containment and applicable jurisdictional rules |
A conventional crop carrying one inserted gene can be a GMO without being a synthetic cell. Conversely, a non-replicating engineered vesicle might be described as a synthetic-cell system without being an organism or GMO.
Does designing the genome make the cell nonliving?
No. In biology, origin and operation are different questions. A cell does not become nonliving because its DNA was written, synthesized or edited by humans. If the resulting system carries out integrated metabolism, maintains its internal state, grows and reproduces, it meets the ordinary functional description of life.
The design origin does matter scientifically. It can show that a genome’s instructions are sufficient to operate a particular chassis, reveal which genes are essential and enable new functions. It also matters for governance because engineered sequences, altered host range or new environmental behavior can change risk. But “human-designed” is not a biological opposite of “alive.”

Scientific definitions and legal definitions answer different questions
The scientific question is descriptive: which properties does the construct perform, and with what degree of autonomy? The legal question is administrative: which existing rules, permits, review committees or reporting duties apply to this material and activity?

The 2026 National Academies framework says oversight is distributed across biosafety, biosecurity, chemical-safety, environmental and biotechnology systems. Applicability can change with genetic material, replication capacity, intended function, containment, persistence and interaction with living organisms. It specifically notes that existing frameworks were not designed for the full diversity of synthetic-cell systems, especially nonliving or hybrid constructs and uses beyond contained laboratory research.
The European Commission’s 2014 expert opinion defines synthetic biology operationally as “the application of science, technology and engineering to facilitate and accelerate the design, manufacture and/or modification of genetic materials in living organisms.” The Commission also says the boundary between synthetic biology and genetic modification cannot be made fully quantifiable or unambiguous. This is a risk-assessment and policy definition; it is not a universal definition of life and does not grant a construct legal personhood.
How to determine the likely oversight path
Researchers, institutions and regulators can apply a staged assessment rather than searching for one legal label.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problems- Describe the physical system. List membranes, polymers, genetic material, host cells, enzymes, energy sources and any components that can persist outside the laboratory.
- Check replication. Determine whether the complete system can make a viable copy under its own control, what external inputs are required and whether replication is limited to a controlled device.
- Identify the intended function. A contained diagnostic reaction, therapeutic delivery system, environmental sensor and self-propagating organism present different questions even when their parts are similar.
- Map the operating environment. Record whether work is confined to a sealed instrument, a laboratory, a clinical setting, an agricultural site or an open environment. Consider escape, persistence and disposal.
- Assess interaction and transfer. Ask whether the system can infect, colonize, exchange genetic material with or alter other organisms. Consider host range and the possibility of horizontal gene transfer.
- Evaluate evolution and misuse. Examine whether variation could improve survival or spread, and whether the methods or outputs could lower barriers to constructing harmful biological systems.
- Match the facts to applicable reviews. Depending on the jurisdiction and activity, this may involve institutional biosafety review, biosecurity assessment, environmental or chemical-safety requirements, clinical oversight, transport rules or other permits. A non-replicating device may be governed mainly as a chemical, medical or engineered product; a self-replicating organism may trigger biological-containment and environmental controls.
- Document uncertainty. Record which assumptions are demonstrated, which depend on supplied components and which outcomes are unknown. Adaptive, case-specific review is more informative than assigning the word “alive” and stopping there.
Do synthetic cells have legal rights or a legal status?
There is no general rule that a synthetic cell receives legal rights merely because it is alive or has a synthetic genome. In current practice, legal systems regulate the people, facilities, materials, organisms and activities involved. A self-replicating engineered bacterium may be subject to containment, environmental, occupational or biotechnology rules, while a nonliving vesicle may fall under chemical, medical-device or product requirements. The exact result depends on the jurisdiction, the organism’s traits and the proposed use.
Legal personhood is a separate concept from biological life. It is a status created by law for specified entities; biological capability alone does not confer it. Questions about ownership, patents, liability, release and environmental harm are handled through applicable statutes, contracts and regulatory decisions, not through a universal scientific declaration that a construct is “alive.”
Common mistakes when interpreting synthetic-cell claims
- “It contains DNA, so it is alive.” DNA can be present in a cell-free reaction or inert container without autonomous cellular organization.
- “It is synthetic, so it is not alive.” JCVI-syn3.0 demonstrates that a chemically synthesized genome can operate in a living, self-replicating bacterium.
- “A minimal genome means a nonliving cell.” Minimal means reduced genetic content, not absence of metabolism or reproduction.
- “A synthetic genome means life was made from scratch.” JCVI’s organism relies on a pre-existing cellular chassis; that is different from assembling every cellular system from nonliving ingredients.
- “One regulator’s definition settles the science.” Regulatory categories are designed for oversight and can vary by use and jurisdiction.
- “A contained construct has no risk.” Containment reduces exposure, but persistence, escape, gene transfer, evolution and misuse still need evaluation.
The practical answer
Ask first what the construct actually does. A non-replicating vesicle or cell-free system may be life-like without being a living organism. A protocell may achieve compartmentalization and selected reactions while lacking autonomous growth or reproduction. A minimal bacterium or synthetic-genome cell that maintains itself and divides is alive in the ordinary biological sense, even if humans designed its genome. A fully bottom-up cell assembled from nonliving parts would be a stronger and still unresolved claim.
Then ask where and how it will be used. Scientific “alive” describes functions; legal status determines oversight. Replication, genetic material, intended purpose, containment, persistence, interaction with organisms, evolvability, gene transfer and misuse potential together determine which reviews and controls are appropriate.
