Usually not when the download is an unauthorized ROM or a prepatched package containing Nintendo’s game data. Nintendo says that uploading or downloading pirate copies of its games is illegal. A Super Mario 64 demake that bundles the original ROM, Nintendo code, graphics, music, models or other protected material therefore carries substantial infringement risk.
A project built with independently written code and independently created assets can present a different legal analysis, but “homebrew” is not a blanket license. Characters, names, logos, music, distribution methods, monetization and the law of your country can still matter. This is general information, not jurisdiction-specific legal advice.
Start with the files, not the label
“Demake” describes a fan project that reimagines a newer or more ambitious game in the style or technical limits of an older platform. It does not tell you whether the download is lawful. Two files advertised with the same name can have very different legal profiles depending on what they contain.

Before downloading, identify the exact archive, installer or executable. Read what the project says it includes, whether it requires an original game, and whether it asks you to bypass a technical protection. A title such as “SM64 demake” is not a legal classification.

Nintendo’s stated position on ROM downloads
Nintendo’s Intellectual Property & Piracy FAQ states: “The uploading and downloading of pirate copies of Nintendo games is illegal.” The same position covers third-party links and peer-to-peer offers that provide unauthorized copies. A website offering an SM64 ROM, or a prepatched demake that contains Nintendo’s game data, fits the conduct Nintendo describes.
That statement is Nintendo’s enforcement and rights-holder position, not a universal summary of every country’s law. Copyright statutes, exceptions and court decisions differ by jurisdiction. It does mean that a download link is not made legitimate merely because it is free, widely mirrored, labeled “abandonware,” or accompanied by a claim that the uploader owns a cartridge.
Does owning an N64 cartridge let you download the ROM?
Owning an original cartridge does not, by itself, make a ROM-site download lawful. The copy on a website is still an unauthorized copy if the distributor had no permission to reproduce or offer it. The legal question is how the copy was made and obtained, not only whether you possess another copy.

The U.S. archival-copy rule
In the United States, Copyright Act section 117 can allow a lawful owner of a copy of a computer program to make an archival copy under specific conditions. The U.S. Copyright Office explains that the owner, or someone authorized by the owner, may make a copy when it is for archival (backup) purposes only, the person is the legal owner of the copy, and the archival copy is destroyed or transferred with the original when the original is sold, given away or otherwise transferred.
Those conditions describe a narrow owner-made backup exception. They do not authorize downloading a ROM from a third party, buying a separately sold “backup,” or keeping an archival copy after surrendering the original. Section 117 is a U.S. rule; it should not be assumed to apply in another country or to every type of game-related file.
How demake code, art and patches change the analysis
Original implementation
If developers wrote new code and created new graphics, music, models and level data, the project is materially different from a redistributed SM64 ROM. That reduces the risk associated with copying Nintendo’s program and extracted assets. It does not settle every issue: using Mario, Super Mario 64, Nintendo logos, recognizable character designs, original music or other protected expression can still implicate copyrights and trademarks.

Extracted or converted assets
A project that imports Nintendo textures, sounds, models, maps, animations or code is not independent merely because the surrounding engine is new. Downloading those files, or a build that bundles them, involves the protected material itself. The more of the original game a package reproduces, the harder it is to characterize the download as a wholly new homebrew game.
Patch-only distribution
A patch can be less risky to distribute than a prepatched ROM because it does not ship Nintendo’s original file. That packaging choice is not a license. A patch may still contain copyrighted portions, may be designed to recreate or modify Nintendo code, and may be accompanied by instructions that facilitate an unauthorized copy. The user’s source ROM and the jurisdiction’s rules remain relevant.
Are emulators, flash carts and circumvention illegal?
An emulator is a software tool. Its legality depends on how it was developed and used, what game files run on it, and whether access controls are bypassed. Saying “emulators are illegal” is too broad, just as saying an emulator makes every ROM lawful is wrong.

The U.S. Copyright Office explains that Digital Millennium Copyright Act section 1201 generally prohibits bypassing technological measures that control access to video games and software. The 2024 rulemaking includes narrow exemptions for specified preservation and restoration work by eligible libraries, archives, museums and certain circumstances involving lawfully acquired games. Those provisions are not a general public authorization to download SM64 ROMs or distribute circumvention tools.
A flash cartridge or similar device is hardware; the device itself does not determine whether the image loaded onto it was lawfully obtained. A user who dumps a cartridge they lawfully own, where local law permits that copy, faces a different question from someone downloading a ready-made image. Circumvention, distribution and commercial sale can introduce additional legal exposure.

What Nintendo’s fan-content guidelines do—and do not—permit
Nintendo’s published Game Content Guidelines describe circumstances in which it will not object to certain gameplay footage and screenshots on appropriate sharing platforms. They are aimed at specified video and image sharing, not at distributing ROMs, copied game assets or every fan-made game.

The guidelines do not grant a general fan-game license. They also say Nintendo cannot provide legal advice and encourage users to seek their own counsel about a proposed use. A video that falls within the stated conditions should not be treated as permission to upload the underlying game files or a demake build.

A practical legality checklist
Use this sequence before you click a download link or publish your own build:
- Identify the jurisdiction. Record the country whose law governs your download, development, hosting and audience. Do not apply a U.S. exception automatically elsewhere.
- Inspect the package. Determine whether it contains a .z64, .n64, .v64 or other cartridge image, Nintendo executables, extracted textures, sounds, models or music. A complete prepatched archive is not equivalent to a patch file.
- Check the project’s provenance. Look for a clear statement that code and assets were independently created, and whether the project requires users to provide a lawfully obtained original. A “homebrew” label alone proves nothing.
- Consider access controls. Ask whether running, dumping or installing the software requires bypassing a technological measure. DMCA section 1201 and comparable laws can impose separate restrictions.
- Separate play from distribution. Downloading, hosting, selling, sharing a link, bundling a ROM with hardware and showing gameplay are different acts with different risks.
- Review branding and content. Names, logos, characters, music and distinctive artwork can create trademark or copyright concerns even when no original ROM is included.
- Stop when the facts are unclear. If the creator will not say what files are included or where assets came from, treat that uncertainty as a warning rather than assuming the safest interpretation.
Examples that illustrate the boundary
“I own the cartridge and found a prepatched download.”
Ownership of the cartridge does not convert the website’s copy into an authorized one. A prepatched archive that includes Nintendo’s ROM remains the riskiest form of the common fan-project download.

This avoids shipping the original ROM file, but legality still depends on the patch’s contents, the way you obtain your source copy, any circumvention involved and the law where you are. Patch-only is a distribution choice, not a Nintendo authorization.
“The game is a new engine with new art but stars Mario.”
New implementation and assets reduce the copied-code issue. They do not eliminate possible claims based on Nintendo’s characters, names, logos, music or other expressive elements, nor do they prevent a takedown.
“I only want to record gameplay.”
Nintendo’s guidelines address certain gameplay footage and screenshots under stated conditions. They do not authorize obtaining or distributing the ROM or a complete demake package, and the guidelines themselves advise seeking legal counsel for other uses.

What a cautious player or developer can do
- Prefer projects that clearly document original code and assets and distribute no Nintendo ROM.
- Obtain any required original software through a lawful source and follow the rules that apply where you live; do not substitute a ROM-site download because you own a cartridge.
- Do not mirror, seed, sell or bundle Nintendo game images, extracted assets or preloaded devices containing them.
- For a public release, remove Nintendo logos and original music and obtain advice about character and title use, monetization, platform terms and takedown procedures.
- If the project is commercial, attracts a large audience or uses substantial Mario content, consult a lawyer in the relevant jurisdiction before distribution.
