Yes, an AI film may use a recognizable actor’s likeness or voice only when the production has the permissions and rights required for that specific replica and use; a disclosure label is not a substitute. First establish who is identifiable, what the model will generate, how the output will be used, which agreement governs the production, and where the film will be distributed. Then assess disclosure rules separately: the U.S. union-contract and state-law questions, EU transparency obligations, and YouTube’s upload policy are not one worldwide rule.
What should a filmmaker check before generating an actor’s likeness or voice?
Start with the person and the proposed use, not with the tool. A digital replica can involve a recognizable face, voice, or both, and the relevant permission depends on the production, the agreement, the person’s status, and the use being proposed. Footage or audio captured for one purpose does not automatically authorize generating a new performance for another.
- Identify the person and material. List every recognizable performer whose face or voice may be reproduced, and identify the footage, photographs, recordings, or other source material involved. Record whether the performer is living or deceased.
- Describe the output. Specify what the generated performance will say or do, which project it belongs to, whether it will be used for dialogue, narration, dubbing, or another purpose, and whether it may be reused.
- Identify the governing terms. Check the applicable union agreement, production contract, and rights holders for the particular medium and project. A TV/theatrical agreement and a commercial contract are not interchangeable.
- Obtain permission for the specific use. Make sure authorization covers creation of the replica as well as the intended performance and reuse. Keep the approved description and permission with the production records.
- Review distribution separately. Check the rules of the territories and platforms where the work will appear, then inspect the final cut for material that exceeds the authorized use or requires a disclosure.
This is a practical sequence, not a substitute for legal review. The key distinction is that permission answers whether the production may create or use a person’s replica; a disclosure rule answers what viewers must be told about covered content.
Does having the actor’s footage or recording give permission?
No. Owning, controlling, or having access to production materials does not by itself settle whether a new AI-generated performance may be made from a performer’s identity.

SAG-AFTRA’s 2026 TV/Theatrical Agreement summary clarifies that a digital replica generated from photography already captured for a picture can still receive employment-based replica protections, even where the actor did not participate in a new scan. The union’s performer bulletin also explains that ownership of materials created during employment does not erase applicable consent and, in many cases, payment conditions for use in other projects. A camera original, still photograph, or recorded line should therefore not be treated as a blanket likeness license.
Copyright and identity rights are distinct questions. The U.S. Copyright Office’s 2024 report says, “A replica of their image or voice alone would not constitute copyright infringement.” That statement concerns copyright in a work; it does not mean a replica is automatically lawful. A production may need to assess rights in the recording or other copyrighted material and rights relating to the person’s identity or voice separately. The Copyright Office’s policy recommendations should not be described as enacted federal law.
What does SAG-AFTRA’s 2026 TV/Theatrical Agreement require?

The union’s TV/theatrical bulletin describes advance notice for scanning and clear, conspicuous consent accompanied by a reasonably specific description of the proposed digital-replica use. The description matters: approval for one project or performance should not be read as permission for a materially different project or use. The applicable agreement governs the details, so a producer should check its terms rather than rely on a generic release or a one-time verbal approval.
When does the new dubbing-consent requirement start?
One provision is future-dated. Under SAG-AFTRA’s 2026 agreement summary, the new requirement for consent to dub with a digital replica applies to pictures commencing principal photography on or after July 1, 2027. That trigger means the specific new dubbing requirement should not be described as universally effective in October 2026. Other contract, consent, and rights questions may still apply before then.

For a covered dubbing use, identify the performer, the language and dialogue, the picture, and the intended generation and reuse. A voice replica is a performer-replica issue, not merely a technical audio choice. A commercial voice use is governed by a different, commercial-specific union bulletin.
How do real-person replicas differ from synthetic performers?
A replica resembling a specific identifiable performer is not the same category as a synthetic performer that is not recognizable as an identifiable person. SAG-AFTRA’s 2026 summary distinguishes these concepts and describes separate union notice and bargaining considerations for synthetics.

The distinction is useful for classifying the production, but it does not itself resolve every legal or platform question. Nor does calling a character “synthetic” settle the matter if viewers could reasonably identify it as a real person.
Can a film use a deceased actor’s face or voice?
Do not assume that a performer’s death makes a replica free to use. California’s official account of AB 1836 says commercial use of a deceased performer’s digital replica in specified media requires estate consent. SAG-AFTRA has also stated that its applicable agreement and state law require estate consent for a deceased performer’s replica in a motion picture.
Confirm who is authorized to act for the estate and what the production and use require. An informal “yes” from a relative may not establish that the person has authority, and the California announcement is an overview rather than an exhaustive analysis of the statute. The applicable contract and the law in each relevant territory still matter.

Do I have to disclose an AI-generated actor or scene?
Possibly, but disclosure depends on the jurisdiction, content, and platform. It does not grant permission to clone a performer, and having permission does not automatically remove a disclosure obligation.

Article 50 of the EU AI Act requires deployers to disclose covered image, audio, or video deepfakes when the Act applies. For content that forms part of an evidently artistic, creative, satirical, or fictional work, the obligation is limited to an appropriate disclosure that the content was generated or manipulated; the disclosure must not hamper enjoyment of the work. This is not a blanket exemption for fiction.
Providers have separate machine-readable marking requirements, subject to Article 50’s conditions. The European Commission says the Act generally became applicable on August 2, 2026. Article 2 also covers specified non-EU providers or deployers where system output is used in the Union. These provisions do not mean every use of AI in editing is a covered deepfake.
For YouTube uploads
YouTube requires creators to identify realistic AI-generated or meaningfully altered content using the upload “AI use” control. Its examples include an apparent real person making a statement or taking an action that never happened. YouTube distinguishes those cases from minor edits, production assistance, and cloning one’s own voice for voiceovers or dubs. The platform label addresses YouTube’s policy; it does not supply an actor’s consent.
For U.S. productions and other platforms
The material here does not establish one general U.S. rule requiring every fictional AI scene to carry a label. Check the rules that apply to the specific release territory and platform rather than treating a YouTube label as a universal standard. If the work includes endorsements, that is a separate issue: FTC guidance addresses disclosures of material connections, not a general requirement to label every fictional AI scene.

What changes if the project is a commercial rather than a film?
Use the agreement for the production’s medium. SAG-AFTRA’s 2025 Commercials Contract bulletin describes a specified payment of 150% of a session fee per covered commercial using a generated digital-replica performance. That figure is a commercial-contract term, not a general theatrical-film rate.
The same bulletin describes generally sought 48-hour advance notice, with stated minimums and conditions. Because the payment and notice relate to covered commercials and are subject to the bulletin’s terms, they should not be carried over as a default for a feature, TV episode, or independent film. Confirm the governing contract and its coverage before quoting a fee or deadline.
Is one signed release enough for future projects?
Do not assume so. SAG-AFTRA’s TV/theatrical bulletin describes a reasonably specific use description and renewed consent for a different project or a different use, subject to the applicable agreement’s provisions. California’s AB 2602 concerns the enforceability of specified digital-replica contract provisions and representation in negotiations; it is not a universal release template.
In practice, a release should be reviewed against the actual production and planned output, not just the fact that it mentions AI. If the project, dialogue, context, distribution, or reuse changes, check whether the original authorization covers the change and whether fresh consent is required.

Before picture lock or upload, compare what appears in the final cut with the approved description and the relevant disclosure rules. A final review can catch an initially authorized replica that has been placed in a different scene, reused in an unapproved project, or uploaded without a platform label required for that version.

- Verify that the person or estate representative granting permission has authority, and that the permission covers both generation and the intended uses.
- Check the production medium and governing union terms before relying on a notice period, payment provision, or consent deadline.
