A federal change could sharply restrict intoxicating hemp-derived products, but it was not yet in effect as of October 3, 2026. The Associated Press reported that a funding measure had pushed the effective date from November 12 to December 11, 2026. The $28.3 billion at stake is a Whitney Economics projection of threatened retail revenue—not a tally of losses already incurred.
When is the reported hemp THC restriction due to take effect?
As of October 3, 2026, the reported effective date was December 11, after a short-term federal funding measure delayed the date from November 12. That timing comes from the Associated Press’s October 3 report. The change was prospective at that point, and Congress could still consider alternatives, so the date and policy remained subject to change.
The Associated Press describes the measure as a 2025 federal change to the definition of hemp. It reports that the change would limit THC to 0.4 milligrams per container. The exact statutory text has not been independently reviewed for this article, so that description should be understood as the rule reported by AP, not product-specific legal advice.
What would the 0.4-milligram limit mean for gummies and drinks?
AP reports that the restriction could eliminate many intoxicating hemp-derived products, including products such as THC gummies and beverages. Under the 2018 Farm Bill definition as described by AP, hemp was defined using a threshold of less than 0.3% delta-9 THC by dry weight. AP says that test enabled some products to contain intoxicating amounts while still meeting the percentage threshold. A September 2026 analysis by Cannabis.Inc says the revised definition also counts total THC, including THCA.

The options also differ in more than the permitted dose: they could treat serving size and container size differently, impose different retail or age rules, and affect interstate commerce and state-regulated sales in different ways. The reporting does not provide a bill-by-bill comparison.
How much revenue and how many jobs could be affected?
Whitney Economics projected that the restriction could put $28.3 billion in retail revenue at risk, displace 225,000 jobs, and reduce potential state sales-tax receipts by $2.1 billion. AP reported those estimates from a report released the previous month. They are forecasts of possible impacts, not observed losses or a directly measured census of intoxicating hemp THC sales.

Whitney Economics listed its September 2026 U.S. Hemp Cannabinoid Report in its pressroom, but the page reviewed does not expose the report’s methodology or full calculations. The estimates therefore describe the projected scale of exposure; they do not establish what businesses, workers, or states would actually lose if the restriction takes effect.
Why do the sides disagree?
Hemp businesses and their allies
Some businesses argue that dose limits and age restrictions could address concerns while preserving a market and the jobs tied to it. Kentucky-based Cornbread Hemp’s owners, Eric Zipperle and Jim Higdon, told AP that they would consider a five-milligram cap, while arguing that the reported 0.4-milligram limit would destroy their business. “If it goes through in December, this place is toast — it’s gone,” Zipperle told AP.

AP reported that Cornbread Hemp had 105 employees, sold hemp beverages in 18 states, and expected $65 million in 2026 revenue. Those are company figures or AP-reported expectations, not audited results. AP also identified alcohol retailer Total Wine & More among the retail allies, reporting that cannabis seltzer sales had helped offset falling alcohol sales.
Public-health opponents
Kevin Sabet, CEO of Smart Approaches to Marijuana and an opponent of the products, told AP: “I have sympathy for people losing their jobs, but I also have sympathy for the many, many more people whose lives are affected by this.” His statement conveys an opponent’s concern; it is not, on its own, evidence that every hemp THC product causes a particular harm.

State-legal cannabis operators
AP reports that regulated cannabis operators support the restriction and view hemp THC products as unfair competition. Lobbyist Cory Harris argued that some products might instead be sold in legal in-state markets under state rules, which could make the projected business impact less severe. That is a stakeholder’s view, not a verified forecast that products or jobs would transition successfully.

Businesses are already making decisions under uncertainty, but the examples reported by AP are snapshots from its October 3 story, not updates on their current status. Nicholas Hohns, who runs Deutermann Farms in Clayton, North Carolina, makes THC and CBD gummies. He told AP he had expected a limited business window and kept investment low because he feared a shutdown; he had considered making creatine gummies instead.
Drinkin’ Buds, a beverage company in Sheboygan, Wisconsin, had mothballed production, and co-founder Matt Swanson had removed himself from payroll, according to AP. These examples show how the pending change can affect planning before its reported effective date, but they do not establish what will happen to any one company if the policy changes or takes effect.
