Don’t act on an AI-generated investment recommendation until you understand why it conflicts with your goals. Check the information the service used, ask how it arrived at the advice, and verify who provides the service and what obligations apply. In the U.S., an AI feature is not automatically a registered investment adviser: the provider and service determine the relevant rules.

First, identify the mismatch

Before trading, transferring money, or changing your plan, state the goal in practical terms: what the money is for, when you may need it, and what degree of loss or limited access you could tolerate. Then compare the proposed action with that goal. For example, a recommendation to invest money you expect to use soon deserves clarification if a market decline or difficulty selling could interfere with that need.

This pause is a prudent way to assess advice, not a universal rule prescribed by regulators. The SEC’s investor guidance emphasizes that robo-adviser recommendations depend on the service’s understanding of your objectives and circumstances.

Check what information the service used

Review the questionnaire and account details associated with the recommendation. Look for errors or omissions such as an outdated goal, the wrong time horizon or risk tolerance, missing debt or cash needs, assets held at another institution, or an account purpose the service did not capture.

The SEC notes that a robo-adviser’s recommendation is limited by the information it requests and receives; some services may collect only limited information, and clients may need to update their information themselves. Ask the provider how a correction will affect the recommendation rather than assuming the system already has your full financial picture. See the SEC’s robo-adviser investor bulletin.

Ask for a clear explanation

Ask the provider to connect its recommendation to your stated objectives and circumstances. These questions are practical prompts based on SEC investor guidance, not a regulator-mandated script:

  • Which goals and personal or financial facts did you use?
  • Why does this recommendation fit my time horizon, cash needs, and risk tolerance?
  • What alternatives did you compare, and why were they not recommended?
  • What are the investment risks, total costs, and any tax or account limitations?
  • How does the strategy rebalance, and how might it respond to a market decline?
  • Can a qualified investment professional review the recommendation?

Human access varies: some services offer access to investment professionals, while others may provide technical support only or little professional involvement. Find out who would review the advice and what that review includes.

Verify the provider, its services, and its incentives

Do not assume that a product called an “AI financial advisor” has the same status as a registered investment adviser or robo-adviser. The SEC describes robo-advisers as registered investment advisers that use algorithms to provide online advisory services, often with limited human interaction. Other AI tools may not be advisory services at all. The provider’s actual role and service matter.

  1. Use Investor.gov’s adviser resources and the SEC’s Investment Adviser Public Disclosure (IAPD) database to check the firm and relevant individual’s registration or license status and disciplinary history.
  2. Read the firm’s relationship summary and Form ADV brochure. Compare the services, limitations, and human support described there with what the tool actually did.
  3. Check how the firm and adviser are paid, what products the service offers, and whether its choices are restricted to proprietary or other products that could create conflicts.

SEC staff guidance explains that an investment adviser’s duty of care includes giving advice in the client’s best interest based on a reasonable understanding of the client’s objectives. The staff bulletin also cautions that disclosing a conflict alone does not satisfy that obligation. This is SEC staff guidance, not itself a rule or regulation; a disclosed conflict is a reason to understand the incentives, not proof by itself that a recommendation is unsuitable or improper. Choose how to proceed

If you are deciding whether to stay with the automated service, request its human review, or consult another adviser, compare the options on factors that affect whether the advice fits your situation:

What to compare Questions to ask
Coverage of your circumstances Does the service consider the goal, broader financial picture, debts, outside assets, and liquidity needs relevant to the decision?
Human access Is a qualified investment professional available, and what can that person review or change?
Investments and strategy Is the product menu limited? What risks, rebalancing approach, and alternatives shape the recommendation?
Costs and conflicts What are the total fees and indirect costs? How is the firm compensated, and what conflicts are disclosed?
Provider record What do registration records, disclosures, and disciplinary history show?

If the service cannot explain the mismatch, correct the information, or offer a review you consider adequate, you can seek a second opinion from a qualified adviser. Before engaging one, check registration, experience relevant to your circumstances, services, fees and compensation, conflicts, and disciplinary history. What AI use does—and does not—mean for regulation

FINRA’s June 27, 2024 notice says its rules and securities laws continue to apply to member firms using generative AI as they do when firms use other technologies; the notice did not create new requirements. FINRA’s report identifies advice-related uses such as generating risk profiles or recommendations, and discusses oversight concerns including suitability, conflicts, customer risk profiles, and portfolio rebalancing. A firm’s use of AI does not, by itself, remove its existing obligations. That point does not mean every general-purpose chatbot is a regulated adviser or establish a legal claim about a particular recommendation.
