In Great Britain, do not drive while disqualified. Check your driving record and court order for the ban’s end date and any retest requirement. What you must do to drive again depends on the outcome and, for a disqualification, whether it lasted 56 days or more.
First, identify the decision and your jurisdiction
“Suspended” is often used informally, but phone-use cases can have different outcomes. Read any notice or court order and check your driving record so you know whether you have a fixed penalty, a court disqualification, or a revoked licence. The steps for getting back on the road are not interchangeable.
The procedures below are for Great Britain (England, Scotland and Wales). Northern Ireland has different arrangements for some disqualification rules; contact the Driver and Vehicle Agency (DVA) for licence matters there. Do not drive until you have confirmed you may
If a court has disqualified you, you must not drive until the disqualification ends. Check your driving record for the disqualification end date and read the court’s order for any requirement to take a test. Do not assume that lodging a challenge or appeal means you can drive; the reviewed GOV.UK appeal guidance does not establish that. Get advice on your status and order before driving.

What a phone-use offence can lead to
Holding and using a phone or another device that can send or receive data while driving can result in six penalty points and a £200 fine, according to GOV.UK’s mobile-phone driving guidance. A court may disqualify a driver; for the described device offence, the maximum fine stated by GOV.UK is £1,000, or £2,500 for a lorry or bus driver. These are official guidance figures, and the cited page does not state a publication date; it was checked on 4 October 2026.
A phone-use allegation does not automatically mean a ban. Police may take no action, give a warning, offer driver training, issue a fixed penalty notice or charge the driver. Separately, reaching 12 or more penalty points within three years can lead to disqualification. GOV.UK lists standard totting-up bans of six months for a first ban, 12 months for a second within three years, and two years for a third within three years. A court decides the length of a ban imposed for a conviction based on the seriousness of the offence. What to do for each outcome
If you received a fixed penalty notice
If you believe the notice is unjust, GOV.UK says you may choose not to pay and argue the case in court. That is different from challenging a court’s decision after a hearing. Read the notice carefully and consider legal advice before deciding how to respond. For mobile-phone fixed penalties, GOV.UK says you do not need to hand your licence to the police or fixed penalty office to accept the notice; the office sends the endorsement to DVLA. If a court disqualified you
Follow the order and check the exact end date on your driving record. Whether you need a new licence before driving again depends on the ban’s length, as explained below. If the court ordered a test, you must meet that requirement before you resume driving.

If your licence was revoked as a new driver
If your licence is cancelled within two years of passing your test, the new-driver rules require you to apply for a new provisional licence and retake both parts of the driving test before driving again. This is revocation, not an ordinary short disqualification. See GOV.UK’s new-driver rules.
When you can drive again after a disqualification

How to challenge a notice or court decision
Choose the process that matches your case:
- Fixed penalty you dispute: GOV.UK says you can choose not to pay and argue the case in court.
- Magistrates’ court decision already made: eligible applicants can apply to challenge a decision, including in some cases where they did not know about the case, did not attend, or the court did not have all the evidence. The application can be made by phone or online. You need the case reference and, for a driving case, your licence number.
These routes are not the same. The process for challenging a magistrates’ decision is described at GOV.UK’s appeal application page. GOV.UK says you may speak with a legal representative or legal adviser before challenging a decision. Get advice about your specific order and driving status before acting.

- For a ban of less than four years: after two years.
- For a ban of at least four years but less than ten: after half the ban has been served.
- For a ban of ten years or more: after five years.
You need a good reason; an early reduction is not automatic. Write to the disqualifying court with the offence and conviction dates and supporting information. Details are in GOV.UK’s guidance on reapplying for a licence after disqualification.
Prevent another phone-use offence
GOV.UK says drivers must stay in full control of the vehicle at all times. Hands-free devices may be used only if you do not hold them at any time during use. A mount does not make it lawful to pick up or hold the phone, and it must not obstruct your view. If you need to interact with the phone, stop somewhere safe first.
