A hospital chart error is separate from a Social Security death-record error, so check each organization that may have recorded or received the information and request corrections from the organization that maintains each record.
Start by finding where the error appears
Contact the hospital’s medical-records or health information management office and its privacy office. Ask for a copy of the relevant records and request clear answers to these questions:
- Which entry says the patient is deceased, and what date or status does it show?
- Where does it appear: the clinical chart, billing record, discharge or eligibility feed, or another record?
- When was the entry made, and which encounter or account does it relate to?
- Was the information sent to another organization or system? If so, to whom and when?
Under HIPAA, people generally have a right to access records in a covered entity’s designated record sets. These can include medical and billing records, as well as payment, claims, and insurance records, subject to limited exceptions. See HHS guidance on accessing medical records.
Request a written amendment to the hospital record
Send an amendment request to the hospital’s designated office. Follow its stated procedure; a covered entity may require a written request and a reason if it has informed patients of that requirement in advance. Make the request specific enough for staff to locate and assess the disputed information.

- Name the record and the exact entry you dispute.
- Explain why it is inaccurate or incomplete and what correction you are requesting.
- Include useful identifiers, such as the encounter date, account number, or department.
- Attach relevant supporting evidence, such as current government ID or a current treating-provider record. Provide only what is reasonably needed.
- Keep a copy of the request and evidence, along with proof of when and how you submitted them.
HHS explains the right to request an amendment and the rules that apply to covered entities in its HIPAA amendment guidance.
Ask how an accepted correction will reach other systems
If the hospital accepts your request, ask which affected records or recipients it will notify and request written confirmation that the amendment was made. Under HIPAA, a covered entity that accepts an amendment must make reasonable efforts to provide it to people you identify who need the correction, and to people—including business associates—it knows have the information and may have relied, or could foreseeably rely, on it to your detriment.

Ask the hospital which recipients it has contacted, but also check directly with any organization where you encounter the same error. A hospital correction does not by itself establish that an insurer, pharmacy, bank, employer, or government program has updated its own records.
If the hospital denies your amendment request
Ask for the denial and its reason in writing. HIPAA permits denial on specified grounds, including when the entity determines the information is accurate and complete or when it did not create the information. There is a limited exception to the latter ground when the originator is no longer available to act on the request.

A covered entity generally must act on an amendment request within 60 days. It may take one extension of up to 30 days if it gives you written notice explaining the reason. If your request is denied, you may submit a statement of disagreement for inclusion in the record under the applicable HIPAA rules. The entity must also follow the rules for including that statement with later disclosures of the disputed information. See HHS’s amendment guidance.
File an HHS complaint if you believe HIPAA rules were not followed
You can submit a written complaint to the HHS Office for Civil Rights (OCR) describing the covered entity and the alleged HIPAA noncompliance. HHS generally requires a complaint within 180 days of when you learned of the act or omission; OCR may extend that period for good cause. An OCR complaint is an enforcement route, not a guarantee that a particular record will be amended.

If Social Security Administration records show you as deceased
Contact a local Social Security office as soon as possible. SSA asks you to bring at least one current, unexpired original identity document or a copy certified by the agency that issued it. Its examples include a passport, driver’s license, employee ID, school record, health insurance card other than Medicare, or certified medical record.

After correcting the record, ask SSA for an “Erroneous Death Case – Third Party Contact” notice to show organizations such as banks or doctors. SSA’s guidance for people incorrectly listed as deceased describes the steps and identity evidence.
If Medicare eligibility is affected
CMS says an erroneous death date in Social Security or Railroad Retirement Board records must be corrected by the agency that maintains the eligibility record before Medicare eligibility can be updated. CMS also recommends checking Medicare eligibility records for hospice, home health, hospital, or skilled-nursing end dates that match the erroneous death date; those dates may help identify where the problem arose. Contact other organizations showing the error
For each organization that treats you as deceased, ask which record or source it relied on and how it accepts correction evidence. Depending on where the problem appears, that could mean an insurer, pharmacy, bank, employer, or government program. Give each organization the evidence it requests and ask for confirmation when its record is corrected.
Do not assume one correction automatically repairs every database. SSA’s process describes consent-based contact with specified third parties, and CMS describes a separate dependency for Medicare eligibility. The organization maintaining the affected record is the place to confirm its status and correction process.
How common is this kind of error?
SSA’s Office of the Inspector General reported that 5.6 million death records were posted to the Social Security Death Master File in calendar year 2025; 12,504 records, or 0.22 percent, were later determined to be erroneous. Those figures refer only to records in that SSA file—not to hospital chart errors, and they do not estimate how often hospitals incorrectly mark patients deceased. The OIG said SSA errors can result from administrative entry mistakes or erroneous reports from other sources, but that does not establish the cause of any particular hospital error.
