Your ISP can still see that you connected to a VPN. A remote peer or service may see the VPN’s public IP address instead of your home connection’s address, shifting trust from your ISP to the VPN provider. What a notice means—and what may happen next—depends on the notice, the provider, and the country involved.
What your ISP can see when you use a VPN
A VPN encrypts traffic between your device and the VPN provider. While that connection is active and the relevant traffic passes through it, your ISP generally cannot read the protected traffic’s contents. It can still see that your connection is communicating with a VPN endpoint, along with connection details such as timing and data volume. The exact information visible can depend on the service and how it is configured.
The Federal Trade Commission puts the distinction plainly: “A VPN app will typically obscure the content of your traffic from your internet service provider or public Wi-Fi provider, but it doesn’t render you anonymous.” The FTC’s consumer guidance is from 2018 and describes the broad privacy distinction, not the practices of any particular VPN today.
What changes—and what does not—when traffic goes through a VPN

This is a shift in the trust boundary, not a switch from exposure to anonymity. The Electronic Frontier Foundation explains the role encryption plays in protecting traffic in its encryption guide. This article does not establish the logging, complaint-handling, jurisdiction, or customer-identification practices of any specific VPN provider. A “no logs” claim should not be treated as independently verified on that basis.

How a piracy-related ISP notice can happen
In one common peer-to-peer enforcement scenario, a rights holder or investigator observes a public IP address associated with activity and reports it to the provider responsible for that address. The provider may be able to match the address and relevant time to a subscriber account and forward a notice, depending on local law and provider policy. The ISP need not have watched or identified the underlying content itself for this path to occur.
A VPN can change the public IP address visible to a remote peer when the traffic properly passes through the VPN. In that case, the VPN provider may be the provider associated with the visible address, rather than the home ISP. That does not establish that the VPN cannot connect activity to a customer: the answer depends on the provider’s records, service design, and applicable process. An IP address is associated with an internet connection, not conclusive proof of which person performed an action. EFF discusses that distinction in its paper on IP addresses and digital evidence.
Why “DMCA notice” can mean different things
In the United States, people often use “DMCA notice” loosely for any copyright-related message. Section 512’s notice-and-takedown framework concerns notices sent to online service providers about allegedly infringing material, such as material hosted on a website. A notice under that framework identifies the copyrighted work and the allegedly infringing material, among other required information. The U.S. Copyright Office explains the framework in its Section 512 resources and describes online service providers.

A message an ISP forwards to a subscriber about activity associated with an IP address is not automatically the same thing as a Section 512 takedown notice. The Copyright Office’s DMCA Designated Agent Directory relates to service providers’ designated agents for notices under that framework; it does not turn every ISP warning into a takedown notice.

United States
Section 512 addresses notices to online service providers about material and includes a designated-agent framework. Do not assume that every subscriber warning from an ISP is itself a Section 512 notice, or that one kind of message carries the same legal significance as another. The notice’s contents and any accompanying court document matter.

Canada
Canada’s federal Office of Consumer Affairs describes a notice-and-notice regime: an intermediary such as an ISP forwards a qualifying notice to the subscriber. Subscriber information may be disclosed if a court orders it. See the government’s guidance on notices to Canadian internet subscribers. This Canadian process should not be assumed to apply in the United States or elsewhere.
Other countries
Procedures vary by jurisdiction. The U.S. and Canadian examples above do not establish the rules in other countries.

If you received a copyright-related notice
- Read the notice itself: identify who sent it, what activity or material it describes, and whether it is an ISP-forwarded warning, a takedown request, or a court document.
- Check the dates, public IP address, and any account or connection details listed. A reported IP address is not, by itself, proof of which person used the connection.
- Do not assume that a VPN connection makes the notice mistaken or that it guarantees immunity. The visible address and the provider able to associate it with an account can depend on how traffic was routed and on provider records.
- If the message includes a legal demand or you are unsure of your obligations, consult a qualified lawyer in your jurisdiction. A general article cannot determine liability from a notice alone.
