Some departments expressly review online material, but the platforms searched, procedures used, and legal limits vary by jurisdiction and agency. A public profile alone is not evidence of unsuitability, and these five considerations are not automatic disqualifiers.
1. Bias-related posts may raise suitability concerns
Posts, images, or other public material that appear to show bias-related behavior may be considered in assessing whether a candidate is suited to peace-officer work. California’s Commission on Peace Officer Standards and Training (POST) says social-media check results may include evidence of bias-related behaviors, traits, or attributes, and that agencies should relate findings to suitability. The California State Auditor has also described screening as a way to detect potentially harmful biases.
Interpretation matters: a lawful political view, a protected characteristic, or mere association with someone is not, by itself, proof of bias or an automatic reason for rejection. California POST says information protected under fair-employment laws, as well as information unrelated to suitability, should not be provided to employers. 2. Evidence of illegal or other unsuitable conduct may be considered
California POST identifies illegal or immoral behavior and other behavior indicating unsuitability as potentially relevant findings. In a separate agency example, a Georgia Bureau of Investigation policy reproduced in a U.S. Department of Justice publication limits collection to criminal comments or images. These are examples of screening dimensions, not a nationwide, exhaustive list of what every agency considers relevant.

The central question is whether reliable material bears on the job and the agency’s suitability criteria—not simply whether a post is embarrassing or unpopular. The available examples do not establish a universal rule for every department. 3. Context, patterns, and change can shape how material is read
A single item may be interpreted differently from a repeated pattern. California POST says search depth may depend on the circumstances: evidence of unsuitable conduct may justify examining a longer history to assess patterns, while agencies should treat candidates consistently. It also says relevant results may include evidence that mitigates past behavior, such as maturity or rehabilitation.

California Department of State Hospitals policy describes case-by-case considerations that include:
- How old the candidate was when the conduct occurred and how much time has passed.
- Whether the behavior was a pattern, how severe it was, and its likely consequences.
- Whether it has recurred and how directly it relates to public-safety employment.
- Aggravating or mitigating circumstances, including evidence of later maturity or rehabilitation.

4. Public visibility and private-account boundaries are different questions
California POST describes searches of candidate postings wherever they appear, including social-networking sites, blogs, and forums. It also says the check does not require or permit infringement of a candidate’s privacy rights. The practical boundary is not identical everywhere: California POST’s FAQ says it is unsettled whether California Labor Code section 980 applies to public-sector employers.
Other California and Georgia examples describe more specific limits. California Department of State Hospitals policy bars its hiring coordinator from requiring passwords, account information, or access to password-protected social accounts. The Georgia Bureau of Investigation policy example says applicants are notified, passwords are not used, private profiles are not accessed, and only public-domain information is searched. These examples should not be treated as legal advice or as rules binding every agency. Check the current instructions and law that apply to the hiring department. 5. Verification, filtering, and documentation vary by agency
Finding an online post is not the same as establishing who created it, whether it is accurate, or whether it is relevant. California Department of State Hospitals policy calls for open-source results to be verified, accurate, and validated, and for potentially impermissible information to be withheld from selection decision-makers. California POST likewise says reported results should be limited to suitability-relevant information and should not include protected information.
California’s State Auditor examined five departments and five hiring decisions per department. Among the reviewed officers with public social-media accounts, the auditor found one applicant account containing biased content when it conducted its review. The auditor could not determine whether departments had seen or considered that content during their background investigations. This is a bounded audit finding, not a national prevalence estimate; the report also found variation in review rigor and recordkeeping. What applicants should check before applying
There is no single U.S. rule that answers what every applicant must disclose or what every agency may search. Washington’s WAC 139-07-020 lists review of social-media accounts among required background-check information; California POST provides detailed guidance for its context, while California’s audit shows that implementation and documentation can differ among departments. These sources do not establish the rules in every state.
- Read the current hiring instructions. Check the application, background-investigation materials, and any agency policy for stated social-media procedures and disclosure requirements.
- Answer questions honestly. Do not assume an agency will or will not find particular public material, and do not misrepresent information requested in the application process.
- Ask about an unclear request. If instructions appear to request passwords or private-account access, ask the agency for its written policy and consult jurisdiction-specific guidance rather than assuming one state’s example applies.
- Do not treat account deletion as a solution. The cited guidance does not establish that applicants must delete accounts or surrender credentials; focus on following the agency’s actual instructions.
