Online prices can change because of demand, inventory, timing, location, sales channel, or promotion rules. Retailers may also use personal data to tailor a price or offer, but a price difference alone does not prove that happened. The distinction matters: ordinary dynamic pricing changes prices in response to market conditions; personalized pricing uses information about a person or group to estimate willingness to pay.

Why do online prices change?

Retailers may adjust prices as demand rises or falls, inventory changes, or other selling conditions shift. Prices and offers may also vary by locality, time, sales channel, and promotion eligibility. In a marketplace, competitor activity and automated repricing may contribute, though a visible change does not show which factor a particular seller used.

The U.S. Federal Trade Commission (FTC) says businesses may use dynamic pricing based on demand or inventory so long as pricing information is not misleading. Its guidance also recognizes conditional offers and discounts. A loyalty price, a local offer, or a sale available only to eligible customers can therefore differ without being a price calculated from an individual shopper’s profile. Is dynamic pricing the same as personalized pricing?

No. Dynamic pricing is a broad description of prices changing with conditions such as demand or inventory. Personalized pricing is more specific: the seller uses information about a consumer or group to set a price or offer, potentially based on an estimate of willingness to pay. The OECD describes personalized pricing as a form of price discrimination in which different consumers may be charged different prices; the FTC’s August 2026 announcement uses a similar willingness-to-pay framing. Personalization can also affect which products or promotions a shopper sees, rather than the monetary price of the same item. A tailored ranking or offer is not by itself proof that the price was personalized. Because these mechanisms can look alike from the outside, observing a different price cannot reveal the seller’s reasoning.

What data do retailers or pricing firms use?

In an initial study of pricing intermediaries, FTC staff reported that firms had access to direct and inferred consumer data from first- and third-party sources. Examples named in the study included:

The study examined what intermediary systems could enable, and the FTC said retailers may hire such firms. These are documented categories in that inquiry, not a checklist of data collected or used by every retailer. Data access, a vendor’s claimed capability, a pilot, and a retailer’s deployed pricing practice are different things. The FTC’s initial analysis drew on documents from six respondents, and its released examples were hypothetical because confidential business information was aggregated or anonymized. It does not establish that all or most retailers charge each shopper a unique price, nor does it provide a reliable market-wide prevalence figure. Do retailers use my browsing history to change prices?

Browsing history is among the data categories named in the FTC’s initial study of intermediaries, so its potential use is documented. That does not establish that a particular retailer uses your history to set a price, how often it happens, or whether a price you saw was affected by it. A retailer may use personal data to decide which audience sees an offer without changing the product’s price; conversely, the same visible price could reflect demand, inventory, location, or a promotion rule.

The FTC began its inquiry to understand what data firms use, where it comes from, which firms use these technologies, and how intermediaries enable algorithmic price changes. Those were questions under investigation, not findings about market-wide practice. FTC overview of its inquiry

How to compare two prices without jumping to conclusions

Before attributing a difference to a personal profile, compare like with like. These checks can narrow plausible explanations, but they cannot prove what algorithm or intent a seller used; that generally requires evidence from inside the business.

  1. Match the item and seller. Check the exact model, size, color, condition, bundle, and seller. A marketplace listing from another merchant may not be comparable.
  2. Record when you saw each price. A price observed at a different time may reflect a sale, demand, or inventory change.
  3. Hold location and delivery destination constant. Local offers, taxes, delivery terms, or regional availability may affect what appears.
  4. Compare the same channel and account state. Note whether you used an app or website, were signed in, or had an account-linked offer.
  5. Check stock and promotion conditions. Inventory, loyalty status, coupon use, minimum spend, and other eligibility rules can change the displayed offer or final price.
  6. Separate the price from the presentation. Confirm whether the monetary price changed, or whether a personalized ranking or promotion simply changed what you were shown.

Clearing cookies, opening a private-browsing window, or switching devices is not a reliable test of whether a retailer personalizes prices; the sources cited here do not establish that any of those steps will lower a price.

What U.S. rules say—and what remains unsettled

The FTC’s fees-rule FAQ permits non-misleading dynamic pricing. For a conditional discount, the total price should not be presented as though it includes a discount unavailable to everyone before the customer qualifies; if both prices are shown, the total price must be most prominent. Required disclosures in online interactive media must be unavoidable. In August 2026, the FTC said it was seeking comment on an enforcement policy statement about personalized pricing. The announcement was a policy development, not a general ban or final rule. FTC Chair Andrew Ferguson said the agency lacks authority to ban personalized pricing in all circumstances, while warning that businesses that fail to disclose how personal data is used to set a price may violate the FTC Act or other laws the agency enforces. Legal protections and enforcement can differ by jurisdiction; the OECD’s 2025 G7 review describes possible access benefits as well as risks including opacity, higher costs for some consumers, exclusion of competitors, and harm to vulnerable consumers. What studies say about consumer responses

An OECD experiment conducted in Ireland and Chile found that disclosures had limited effects on participants’ ability to identify and understand personalized pricing, and it could not confirm a significant effect on purchasing behavior. Participants, on average, considered personalized pricing unfair and thought it should be prohibited.
