Irish broadcaster Dave Fanning sued after his photograph appeared beside an MSN headline about a different broadcaster facing trial over alleged sexual misconduct. The trial was not Fanning’s, and the reported court proceedings do not establish that Microsoft was found liable.
What did the MSN article say, and why was it misleading?
In January 2024, The Irish Times reported that Fanning had started defamation proceedings after his photograph appeared with an MSN article headlined “Prominent Irish broadcaster faces trial over alleged sexual misconduct.” The headline concerned another broadcaster, whose trial ended in an acquittal; it was not about Fanning. The Irish Times’ report described Fanning’s photograph appearing alongside the headline.
The distinction matters: the reporting connects Fanning to the article because his image was used, not because he was accused of the conduct or involved in the trial.
How did the article reach MSN?
BNN Breaking produced the article; MSN carried it
Futurism’s June 6, 2024 account described BNN Breaking as the article’s producer and MSN as the aggregator that carried it. Futurism said the article appeared on MSN’s homepage for several hours before it was removed. The Irish Times reported that it was removed the day after publication. Those accounts describe the removal timing differently, so they do not support a single more precise duration. Futurism’s report also discussed the article’s production and distribution.

What is known about the AI connection?
Futurism, citing a New York Times investigation, reported that BNN employees used generative AI to paraphrase material from other news services and that the site produced thousands of articles daily, most reportedly without human fact-checking. This reporting links the incident to AI-assisted news production and aggregation. It does not establish exactly how Fanning’s photograph became attached to this particular article, so the image mismatch’s technical cause should not be treated as confirmed.
What did Fanning allege, and what did the court say?
Fanning brought a defamation action involving BNN and Microsoft entities. In January 2024, The Irish Times reported on an early application concerning permission to serve proceedings outside Ireland. At that hearing, Justice Cian Ferriter was quoted as saying Fanning’s position that he had “absolutely nothing” to do with the trial “cannot be gainsaid,” based on what was before him. That reported observation addressed the early procedural application; it was not a final ruling on liability or the merits of the defamation claim.

A procedural update published April 29, 2026 described the matter as ongoing before the Irish High Court and said no final judgment or resolution had been publicly reported as of that update. The update also stated that it relied on public reporting and had not independently verified the material. The April 2026 status update is therefore a dated secondary account, not confirmation of the case’s status after that date.
