Communities are pushing back against proposed data centers over concerns about water and electricity use, noise and pollution, land use, utility costs, and the growth of AI. National polls show substantial opposition, but they ask different questions and cannot predict how residents will view a particular project. Developers and local governments are responding with earlier engagement, clearer rules, and commitments that can be measured and enforced.

Why are communities opposing data centers?

Opposition reflects concerns about a facility’s local effects as well as broader unease about AI. In Gallup’s April 2026 open-ended follow-up, respondents who opposed data centers mentioned water and energy use, pollution including noise, quality of life, traffic and land-use preferences, utility bills and other economic concerns, and AI itself. Those answers describe what respondents worried about; they do not establish the actual effects of any individual project. People who favored data centers frequently cited economic benefits and jobs.

That distinction matters: a national poll can register sentiment, but it cannot tell a town what a proposed facility will use, emit, cost or contribute. Those questions depend on the project, its location, the local utility and the terms of its approvals.

What do national polls say about opposition?

Two 2026 surveys found high opposition, but their results should not be read as points in one continuous trend because they asked about different things:

What does a more credible community strategy look like?

Engagement is most useful before a project is effectively fixed and public input is limited to a late-stage zoning hearing. The Urban Institute describes early, three-way discussions among residents, local governments and companies, with the aim of surfacing concerns and possible terms while decisions remain open. The right process depends on local authority and the project; no single agreement resolves every planning question. Urban Institute

  • Put specific claims on the record. Replace broad assurances with commitments that can be checked, such as water-use limits, noise standards, energy sourcing, emissions reporting, workforce programs or community funding.
  • Separate general rules from project-specific terms. An ordinance can establish standards for facilities across a jurisdiction; an agreement can address obligations tied to one project. Neither substitutes for the other.
  • Identify who can enforce each commitment. Residents should be able to see what counts as compliance, who monitors it, what happens after a breach and whether the terms are legally binding.
  • Plan for closure as well as construction. Include a decommissioning plan in project approvals. The Federation of American Scientists reports that interviewed local-government practitioners were not aware of a data center that had ceased operations or been formally decommissioned, leaving many such provisions largely untested. One interviewee recommended approving a decommissioning plan alongside the facility. FAS

How do agreements differ from zoning rules?

“Community benefits agreement” can describe different arrangements, and the label alone does not establish who is bound or how a promise can be enforced. The Federation of American Scientists reviewed 42 local ordinances, 12 state actions and 10 executed local-government/developer agreements; these are the scope of its guide, not a count of every policy or agreement nationwide. Private community benefits agreement Developer and an organized community coalition. Can create negotiated commitments, but depends on a coalition with the resources and standing to negotiate and enforce them. WRI describes private agreements as rare in the data-center context.
Workforce agreement Developer or contractor and workforce representatives or partners. Can focus on hiring, training or labor terms; it does not cover every community impact.
Nonbinding pledge Company and community or public officials. May communicate intentions, but should not be presented as enforceable unless the commitment is incorporated into a binding instrument.

Federalism and state law shape what local governments can negotiate or regulate. Urban Institute and WRI both note that state limits or preemption may constrain local approaches, so residents and officials need to check the law governing their jurisdiction rather than assume a model agreement will transfer unchanged. What can an enforceable agreement cover?

A useful agreement translates contested impacts and promised benefits into terms that can be monitored. Relevant subjects may include water, power, noise, emissions, workforce development, local spending, taxes and utility costs. The terms should specify how performance is measured, who reports it, how often data is made public and what follows if the developer falls short.

Lancaster, Pennsylvania, illustrates one municipal approach, not a universal template. WRI reports that the city’s public agreement with three developers provides $20 million for sustainability and local economic initiatives and includes 100% clean energy, water-use caps and noise limits. The city is responsible for administering enforcement. The legal terms are specific to that agreement and locality. World Resources Institute

Pennsylvania has also taken a state-level step: in September 2026, Gov. Josh Shapiro signed an executive order requiring specified energy and water reporting and binding commitments under the state’s process. These requirements apply to Pennsylvania’s process; they are not federal rules or a national standard. Commonwealth of Pennsylvania

Why agreements do not guarantee local support

Even a detailed agreement cannot make every proposal acceptable to every resident. People may weigh jobs, tax revenue and investment differently from potential effects on water, electricity costs, noise, land use or quality of life. WRI cautions that agreements are not a silver bullet: they supplement public governance, and their value depends on enforceability, community participation and local authority. WRI

For residents assessing a proposal, the practical test is not whether a developer promises to be a good neighbor. It is whether the major impacts and benefits are disclosed, whether terms are specific and binding, whether residents can participate early, and whether an accountable public body can enforce the commitments.
