The AI’s involvement does not by itself erase a seller’s legal duties or settle who ultimately bears a loss. Responsibility depends on what you authorized, which business sold the item, the law where you live, the payment method, and any relevant contract or special protection.
Who handles a refund, and who handles a payment dispute?
These are separate routes. A refund is normally requested from the seller under the seller’s return terms and any consumer rights that apply. A payment dispute is raised with the card issuer or other payment provider under that payment method’s rules. A dispute may lead to a reversal or reimbursement, but it is not the same as the seller agreeing to a return.

What the seller is responsible for
Look for the seller of record on the receipt, order page or confirmation email. That is the business to approach about the goods or service, delivery and any return. Whether it must refund you depends on the applicable consumer law, the type of purchase, why you want to return it, timing and the seller’s contract or return policy.
For UK consumers
The UK Competition and Markets Authority (CMA) says consumer law applies whether a business interacts with a customer itself or through an AI agent, and the business remains responsible for its agent. The CMA identifies the Consumer Rights Act 2015 as relevant to faulty goods and the Consumer Contracts Regulations 2013 as relevant to some cancellation or change-of-mind situations. Which right applies, and any time limit, depends on the facts. These UK sources do not establish the rules in other countries.

When a contract names a seller of record
Stripe’s agentic-commerce terms provide one contract-specific example: for transactions covered by those terms, the seller of record is assigned responsibility for fulfillment, returns, refunds, exchanges and claims about its goods or services. Stripe’s terms direct customers to raise those issues with the seller. This is an allocation under that framework, not a rule for every AI-assisted purchase; the terms accessed for this guidance redirected to Stripe’s Japan agreement, so the applicable country-specific agreement matters.
What the AI provider or deploying business may be responsible for
The AI service’s role depends on who contracted with you, what the service or deploying business promised, and the law that applies. In the UK, the CMA says a business cannot avoid its consumer-law responsibilities simply because a third party designed or supplied the AI agent it uses. That does not mean every independent AI developer must refund every order: the relevant question is what each business did, promised and is legally responsible for in the circumstances.

An AI agent is not automatically the legally responsible party just because it placed the order. The Federal Reserve’s September 28, 2026 speech by Governor Christopher J. Waller describes agent liability as an open question for current frameworks and discusses possible adaptation of existing e-commerce approaches; it does not establish a new binding agent-specific rule.
What happens if you dispute a card charge?
In the U.S. card context, FinRegLab’s September 4, 2025 report summarizes a process in which the account-providing institution generally handles a report of an unauthorized transaction initially, then resolves loss allocation with merchants and other payment participants. For card-not-present transactions, liability may fall on acquiring-side banks, which can pass risk to merchants by contract. The exact result depends on the facts, applicable law, network rules and contracts.

Do not assume this card process applies to a bank transfer, digital wallet balance, stablecoin or another payment rail. Those methods can have different legal and contractual dispute routes. Contact the provider for the payment method actually used and follow its instructions and time limits.
What to do if the agent bought the wrong thing
- Check the order and identify the seller. Review the receipt or confirmation for the seller of record, item, amount, delivery details and return terms.
- Compare the purchase with what you authorized. Check the instruction you gave the agent, any spending limit or approval step, and whether the final item and price matched. A purchase that matched your instruction may raise different issues from one that exceeded it.
- Save the relevant records. Keep the prompt or instructions, spending limits, approval or authenticated-intent screen, final cart and price, order confirmation, delivery record and communications with the seller or platform. These records can help show what you intended and what the agent did; this is practical guidance, not a universal legal checklist.
- Ask the seller for the appropriate remedy. Explain what went wrong and request a return, refund or exchange under the applicable law and terms. If a seller does not resolve the issue, keep a record of the request and response.
- Contact your issuer or payment provider if the charge itself is disputable. Describe accurately whether you authorized the agent and what it purchased. Do not label a transaction unauthorized if you did authorize it; explain instead how the order differed from your instructions, if it did.
- Raise a separate service complaint where appropriate. If the agent ignored a limit or the service failed to do what the provider promised, contact the AI provider or deploying business as well. Keep this distinct from the seller refund request and payment dispute.
There is no generic answer to who ultimately absorbs a loss after a mistaken AI purchase. Authorization, applicable consumer law, the payment rail, contracts and any relevant protection all matter.

What to check before relying on a special AI-purchase protection
Do not assume an AI-specific card benefit applies merely because an AI placed the order. American Express’s “Agentic Commerce Experiences” page, accessed October 7, 2026, describes a protection for certain eligible U.S. card charges involving registered agents that transmit cardmember-authenticated purchase intent. The page presents the benefit as future-facing, says further details are coming, and describes conditions including a merchant-return attempt where possible. It also says subjective or non-verifiable intent may not qualify and claims are reviewed. Check the current terms and launch status directly with the issuer before relying on it.
More broadly, Mastercard’s September 30, 2026 discussion of agentic-commerce trust emphasizes identity, intent, controls, execution and visibility into risk. Those are useful things to verify when choosing or configuring an agent, but a trust framework does not itself decide a refund or chargeback claim.

Which details determine the right route?
- Seller identity: Who supplied the goods or service, and does the applicable contract identify a seller of record?
- Reason for seeking money back: Is the item faulty, not delivered, unwanted under a cancellation right, or different from what you authorized?
- Jurisdiction: Which country’s consumer and payment rules apply? UK guidance and U.S. card-process summaries are not worldwide rules.
- Payment method: Was it a credit or debit card, account transfer, wallet or another method with its own dispute process?
- Evidence of intent: What did you tell the agent, what did you approve, and did the final order stay within those instructions?
- Specific promises or protections: What did the seller, AI service or issuer actually promise, and what conditions apply?
