Rules enacted by Congress are generally harder for a new president to change than executive orders or agency interpretations: changing a statute ordinarily requires new legislation. But no rule is permanent, and the key federal stablecoin law still depends on implementation. The GENIUS Act is law; broader crypto market-structure legislation was still a proposal in the cited September 2026 overview.
What makes a crypto rule durable?
“Crypto regulation” is not one switch that a president can turn on or off. The legal form of a policy determines who can change it and what steps are required. A statute, an executive order, an agency interpretation, a proposed rule and a bill do not have the same status.

This is a practical hierarchy, not a guarantee that statutes cannot be amended, challenged or interpreted differently. Durability also depends on the precision of the law, delegated authority, rulemaking, judicial review and whether a future Congress can agree on changes.
What is already law, and what is still being implemented?
The GENIUS Act: enacted stablecoin law

Enactment does not mean every operational detail is settled. On August 17, 2026, Treasury issued a proposed implementing rule, not a final one. Treasury said it expected the Act’s effective date to be January 18, 2027. That is Treasury’s stated expectation; the proposal itself remains part of rulemaking. Executive policy: easier to reverse than a statute
Executive Order 14178, issued January 23, 2025, directed agency reviews and policy recommendations and expressly revoked Executive Order 14067. That reversal illustrates why an executive order is less durable across administrations than an enacted statute: a later president can change executive policy without repealing an Act of Congress. The order remains subject to statutes and constitutional limits. Read Executive Order 14178.

The White House also published recommendations from the President’s Working Group on Digital Asset Markets in July 2025. Recommendations and administration policy can guide executive-branch activity, but they are not a substitute for legislation enacted by Congress. Agency interpretation: practical guidance, not a complete legislative settlement
On March 17, 2026, the SEC issued an interpretation joined by the CFTC concerning categories of crypto assets and specified transactions, including staking and airdrops. It can clarify how the agencies currently read and administer existing law, but it is not equivalent to a comprehensive law defining the market structure for all crypto assets. The SEC described its action as a bridge while Congress considers broader legislation. Read the SEC’s announcement.

Why broader crypto market structure remains uncertain
The GENIUS Act addresses payment stablecoins; it does not settle the full set of questions about the wider crypto market. In its September 15, 2026 update, the Congressional Research Service described the CLARITY Act as a proposal, not enacted law. Committee materials or a bill’s introduction do not by themselves make its provisions binding. Read the CRS overview of crypto policy and legislation.
SEC Chair Paul Atkins said on August 18, 2026, that “legislation remains indispensable to enacting ‘future-proofed’ rules of the road that are durable enough to protect the work we are undertaking today from being unwound by a future rogue regulator.” That is the chair’s policy argument for legislation, not a neutral legal conclusion or a prediction that Congress will pass a bill. What to watch as rules move from policy to law
- Legal status: Check whether a policy is enacted, final, proposed, interpretive, or merely a legislative proposal. Similar headlines can describe documents with very different legal effects.
- Scope: Identify the activity covered. The GENIUS Act concerns payment stablecoins; a broader market-structure proposal addresses a different set of questions.
- Implementation: For enacted laws, look for final rules, effective dates and agency procedures. Treasury’s August 2026 GENIUS proposal was not yet final.
- Change authority: Ask whether Congress, a president, an agency or a court would need to act to alter the particular policy. Each operates within its own legal authority.
- Current status: Legislative and regulatory status can change. The CRS overview dated September 15, 2026 is a dated snapshot, not a guarantee of later status.
For users, a hardware wallet is one example of a self-custody tool discussed in legislative materials. It can help a person control access to digital assets, but owning or using one does not itself change applicable legal obligations. See the House report materials discussing self-custody wallets.
What a new president could—and could not—change
A president can change executive policy and influence agency leadership and priorities, subject to law. Agencies can revise interpretations or complete rulemaking under their statutory authority and required procedures. But a president cannot repeal an Act of Congress by executive order. Changing statutory obligations generally requires further legislation, while courts may review how laws and agency actions are applied.

The practical answer is therefore neither “all crypto rules can be erased at the next election” nor “a law can never change.” The GENIUS Act has the stronger statutory footing, but its implementation is still underway; executive policy and agency positions are more exposed to changes in administration or agency action; and broader market-structure legislation remained unresolved in the cited September 2026 account.
