If a game uses your artwork without permission, first confirm that you own the relevant rights, preserve evidence of the original and the game’s use, and check whether a license or legal exception could apply. If you have a good-faith basis to act, you can contact the developer or submit a formal copyright notice through the platform hosting the content. This guide focuses on U.S. law and procedures; rules and platform processes differ elsewhere.
1. Confirm that you own the rights and identify what was copied
In the United States, copyright generally attaches to original artwork when it is fixed in a tangible form. It protects original expression, not abstract ideas, systems, or procedures. The U.S. Copyright Office explains these basics in What Is Copyright?
Before filing a complaint, check who owns the specific artwork. A commission agreement, employment terms, assignment, or license may affect whether you can file or what uses you authorized. If someone else owns the rights, that person or an authorized representative may need to act.
Compare your original with the image in the game. Record the game title, developer or publisher if known, where the image appears, the URL or other location details, and the date you observed it. Keep screenshots and copies for your records. Save materials that may help establish authorship or ownership, such as the original layered file, dated drafts, publication records, and relevant contracts. Platform forms require enough detail to identify both the copyrighted work and the allegedly infringing material; they do not prescribe one universal evidence format.

2. Check for permission or a legal exception
Review any license, commission terms, employment agreement, or permission you may have granted. Also consider whether the game’s use could qualify for a legal exception. In the United States, fair use depends on the circumstances; there is no fixed percentage or number of words or notes that automatically makes a use fair. The Copyright Office’s Fair Use FAQ explains the uncertainty, and Epic asks reporters to consider fair use, fair dealing, or similar exceptions before submitting a report. Other countries may apply different rules.
3. Choose whether to contact the developer or file with the platform
A concise, factual message to the developer or uploader may resolve a mistake or explain whether permission exists. Valve specifically suggests that a claimant might consider contacting the individual before filing, since the issue could be a simple misunderstanding. Direct contact is optional; if it is unsuitable or does not resolve the issue, use the official reporting process for the service hosting the content.

Steam
Valve’s Steam copyright notice form asks for the URL of the material on Valve’s systems, a description of the allegedly infringing content, details about and a URL for the copyrighted work when available, claimant contact details, authority and good-faith declarations, and a signature. Valve says complaint contents, including the claimant’s name and email address, may be provided to the uploader. It also calls a copyright complaint a serious legal matter.
Epic Games
Epic accepts copyright removal requests for content posted on its products and services. Its copyright and trademark reporting page warns that a notice is a legal process and that false claims can have legal and account consequences. It also describes counter-notices for users who believe content was removed by mistake or was authorized.

Epic’s page states that, as of August 10, 2026, it no longer processes IP reports for ArtStation or Sketchfab. It directs ArtStation reports to dmca@artstation.com and Sketchfab reports to dmca@sketchfab.com. Check the current page before sending a report because routing details can change.
Nintendo
Nintendo’s U.S. Intellectual Property Policy accepts notices concerning material on its websites or within its video-game products. Its notice requirements include a description of the copyrighted work and allegedly infringing material, details locating the material, contact information, a good-faith statement, an authority and accuracy statement under penalty of perjury, and a signature.

4. File only if you can make the required legal assertions
A DMCA notice is not just a general complaint: it is a formal legal assertion that you have authority to act and a good-faith basis for believing the use is not authorized. Do not submit one if you are unsure who owns the rights, whether the use is licensed, or whether an exception could apply. Knowingly making a material misrepresentation can have legal consequences. The platform may also share notice information with the uploader, as Valve’s process expressly warns.

An uploader whose material was removed may submit a counter-notice asserting that removal resulted from a mistake or misidentification. Under the U.S. process described by the Copyright Office, a service provider may restore the material no earlier than 10 and no later than 14 business days after forwarding a compliant counter-notice, unless the claimant notifies the provider of a lawsuit seeking to restrain the use. See the Copyright Office’s Section 512 resources for the notice-and-counter-notice process.

A counter-notice contains formal declarations and consent to jurisdiction, so a disagreement can move beyond a platform dispute. If the matter is significant, contested, or could lead to litigation, speak with a copyright attorney about your specific circumstances.
The Copyright Office identifies federal court and the voluntary Copyright Claims Board as possible forums. Eligible Copyright Claims Board matters are limited to $30,000 total. Eligibility and the appropriate route depend on the claim and circumstances; consult the Office’s Section 512 resources and consider legal advice before escalating.
How to choose your next step
- Ownership is uncertain: Review contracts, commission terms, employment terms, and any transfer or license before making a claim.
- The source or permission is unclear: Preserve the relevant files and records, then consider whether a factual direct inquiry is practical and safe.
- You are confident you own the rights and the use is unauthorized: Identify the host and use its current official notice process, supplying the requested work and location details.
- You are not prepared for disclosure or a dispute: Read the platform’s warnings and consider legal advice before filing; a notice may be shared with the uploader and could be challenged.
- The platform process does not resolve the matter: Get advice on whether further action, including a court claim or an eligible Copyright Claims Board proceeding, makes sense for your case.
If you are outside the United States, check your local copyright rules and the relevant platform’s current reporting process rather than assuming that U.S. notice procedures apply.
