If you believe someone has accessed or shared your protective-order or foster-care records without authorization, first address any immediate safety risk, then contact the court or agency that holds the records using a safe method. Ask what information was exposed, whether access is confirmed, what has been contained, and which rules apply to this specific file. There is no single U.S.-wide response procedure for every court and child-welfare record.
What should you do first?
If you may be in immediate danger
Contact emergency services or local law enforcement using a safe phone, device, or trusted intermediary. Do not wait for the court or agency to finish investigating an exposure before seeking urgent help. If you think your communications or device may be monitored, avoid using it to contact the suspected person or to make a safety plan.
Do not post names, case numbers, addresses, screenshots, or other identifying details publicly while seeking help. A local victim advocate or domestic-violence service may be able to help coordinate safe communications and a safety plan. The U.S. Office for Victims of Crime’s model standards direct victim-assistance providers to account for applicable privacy and confidentiality rules and limits.

If there is no immediate emergency
Contact the organization responsible for the record: this may be the court, a child-welfare agency, or another identified custodian. Ask for a safe point of contact, such as the relevant clerk, privacy or security contact, or agency representative. Use a known official contact method rather than replying to an unexpected message or sending sensitive material to an unverified address.

What should you ask the court or agency?
These are practical questions to help establish what happened and what steps are available; they are not a universal list of questions every custodian is legally required to answer.
- Which records and specific fields were exposed—for example, an address, phone number, placement, school, case notes, health information, or identity documents?
- Is unauthorized access confirmed, or is the incident still being investigated? When did the exposure occur, and when was it discovered?
- Was the material publicly accessible, sent to a particular recipient, or accessed through an account or system?
- Has access been disabled, and has the material been removed or restricted? Have relevant copies or links also been addressed?
- What notices have been sent or will be sent, under what rule, and when should you expect an update?
- Who is your named contact for updates, safety coordination, and a written record of the response?
Ask the custodian to explain any unfamiliar terms and to confirm key answers in writing if doing so is safe. Do not assume that the exposure is resolved just because one online copy has been removed; ask what other locations, recipients, or copies are known.
How can you respond if location or routine details were exposed?
An exposed home address, foster placement, school, workplace, or predictable routine can create a safety concern. Tell the custodian and, if appropriate, law enforcement or an advocate why the information could put someone at risk. Ask whether the record can be restricted, redacted, corrected, or removed from public access, and whether local address-confidentiality procedures cover the specific address or record.

Available protections depend on jurisdiction and record type. For example, Massachusetts Trial Court guidance describes restrictions on specified identifying details in adult harassment-prevention case files. The Texas Office of the Attorney General describes an Address Confidentiality Program for eligible survivors and cautions that it “doesn’t guarantee safety or replace other safety measures.” Neither example establishes a nationwide entitlement or guarantees that every record will be concealed.

If a foster placement or a child’s school is involved, ask the child-welfare agency what safety coordination is appropriate and who should receive the information. Share details only with people who need them to respond, using the safest available channel.
What evidence should you preserve?
Keep the original breach notice and relevant messages, screenshots, web addresses, dates, and incident or case reference numbers. Record whom you contacted, when you contacted them, and what they said. Store copies somewhere the suspected person or another unauthorized user cannot access. Ask the agency how to send evidence safely before forwarding sensitive records or screenshots.
There is no universal evidence-retention schedule established for this situation in the sources cited here. Preserve material that may help identify what was exposed and support follow-up, while limiting further circulation of sensitive information.
Which confidentiality and notification rules apply?
The governing rule depends on the record, the custodian, and the jurisdiction. A protective-order filing in court, a child-abuse report, a foster-care file, and health information held by a covered entity may be subject to different confidentiality and notice requirements. Ask the custodian which law or policy applies to the particular records and who can explain it.

HHS’s 60-day statement concerns individual notification after discovery of a HIPAA-covered breach; it does not mean every affected person must wait that long, nor does it determine notification timing for records outside HIPAA. Ask the custodian about the specific notice procedure that applies.

A local victim advocate, domestic-violence service, child-welfare advocate, or legal aid provider may help with safety planning, contacting the court or agency, and finding jurisdiction-specific resources. Ask how the service handles confidential information before sharing details, since privacy protections and limits depend on the provider and applicable rules.
The UK Home Office’s police guidance for domestic-abuse protection orders says victim breach notifications should be handled sensitively and may require support from an independent domestic violence adviser (IDVA) or another service. That is an example of a support practice, not U.S. procedure. If you are in the United States, ask a local advocate which services and rules apply where you live.

- Do not wait for an investigation to conclude if you face immediate danger.
- Do not share case details, screenshots, or addresses publicly while trying to get help.
- Do not assume HIPAA or a single state confidentiality rule governs every record.
- Do not send additional sensitive information through a contact method you have not verified.
- Do not treat an address-confidentiality program as a guarantee that information cannot be found or that other safety steps are unnecessary.
