If your mortgage payment was returned, went to your former servicer, or appeared in the wrong month after a servicing transfer, save your payment proof and transfer notices, then contact both servicers to trace it. If the account is not corrected, send a focused written notice of error to the servicer’s designated address. A transfer does not generally change your loan terms, and a specific 60-day rule may protect an on-time payment sent to the former servicer.
First, check whether the 60-day transfer protection applies
Under U.S. federal Regulation X, during the 60 days beginning on the servicing transfer’s effective date, a payment received by the former servicer on or before its due date—including any grace period allowed by your loan documents—may not be treated as late for any purpose. The rule also requires the former servicer to promptly either forward a misdirected payment to the new servicer for application or return it to you and tell you where to pay. See the CFPB’s Regulation X, § 1024.33.
This protection has specific conditions: the former servicer must have received the payment on time, and the 60-day period starts on the transfer’s effective date. It does not decide whether a payment method complied with the servicer’s written requirements, excuse every returned payment, or pause later installments. Keep making future payments as instructed unless you receive reliable, account-specific guidance otherwise.
The servicing transfer itself generally does not change the loan’s terms, apart from servicing-related terms. Transfer notices should identify the effective date, payment transition, and contact details for both servicers. The CFPB’s model notice of servicing transfer reflects that distinction.

Trace the payment before disputing the account
1. Pin down the transfer dates and payment route
Read the notices from both servicers and note the effective transfer date, when the former servicer stopped accepting payments, when the new servicer began accepting them, and the payment instructions each provided. Compare those details with the account number, destination, amount, and method you used for the disputed payment.
2. Preserve proof and account records
Save the bank debit or cleared check, electronic confirmation, payment date and amount, any return notice, transfer letters, statements, account screenshots, and messages with either servicer. Keep copies of letters you send and proof of delivery. These records help you describe the problem clearly; no single document is a prerequisite to asking the servicer to investigate.

3. Ask both servicers to trace it
Contact the former servicer and ask whether it received the payment and whether it forwarded or returned it. Contact the new servicer and ask whether it received funds and how the payment was posted. Give each the payment date, amount, and method, and request written confirmation. If the records show a late fee, delinquency coding, or incorrect application caused by the servicing problem, ask for the account to be corrected.
Send a written notice of error if the account remains wrong
Regulation X recognizes servicing errors that can include failing to accept a conforming payment, applying an accepted payment incorrectly to principal, interest, escrow, or other charges, and failing to transfer servicing information accurately and on time. The rule expressly includes an error involving failure to transfer servicing information accurately and timely to a new servicer. See the CFPB’s Regulation X, § 1024.35.

A notice of error must identify you and your account and clearly describe the error you believe occurred. Use the servicer’s designated address for notices of error if it has provided one; check the transfer materials, periodic statement, or servicer website. A payment coupon or other payment form is not required to be treated as a notice of error.
Include the payment date, amount, method, intended recipient, what happened (for example, returned, not credited, or applied to the wrong installment), and the correction you seek. Attach copies—not originals—of useful records. Keep the submission focused on this payment and retain evidence of when and where you sent it.

Request payment records when you need them
A separate written request for information can help establish what happened. Identify yourself and the account, then specify the records or details you need, such as the transaction history for the relevant period, receipt and posting dates, how the payment was allocated, or records showing its transfer or return. Use any address the servicer designated for information requests. Ask for material tied to the disputed payment rather than an unrestricted file.
The two routes serve different purposes, though one focused submission can state an error and request related information. The servicer must assess the substance of the submission. The rules and response timelines are in § 1024.35 and § 1024.36.

| Route | Use it to | Include | Usual response timing |
|---|---|---|---|
| Notice of error (§ 1024.35) | Assert a servicing error and seek investigation or correction | Your name, account-identifying information, and a specific description of the error | Generally 30 business days; a properly noticed 15-business-day extension may apply |
| Request for information (§ 1024.36) | Obtain specified account or transfer records | Your name, account-identifying information, and the information sought | Generally 30 business days; a properly noticed 15-business-day extension may apply |
Track deadlines and evaluate the response
For a qualifying notice of error or information request, the servicer generally must acknowledge receipt within five business days, excluding Saturdays, Sundays, and legal public holidays. For most notices of error, it generally must correct the error or explain why it believes no error occurred within 30 business days. A 15-business-day extension is possible if the servicer gives written notice of the extension and its reasons before the original deadline. Most information requests have a 30-business-day response period and may also qualify for a timely explained 15-business-day extension. A request for the identity of the loan’s owner or assignee has a separate 10-business-day deadline.
If the servicer concludes that no error occurred, its response must explain why and tell you how to request the documents it relied on. After you request them, copies of relied-on documents generally must be provided without charge within 15 business days, subject to confidentiality, privilege, and other exceptions. Keep the response and compare its explanation with your payment proof and account history.
If the problem is urgent or remains unresolved
These are general U.S. federal rules, not a decision about a particular loan. Exceptions can apply to duplicative, overbroad, or untimely submissions, and state law, loan type, and transfer circumstances may affect a borrower’s options. If the dispute is tied to an imminent foreclosure or serious credit-reporting consequences, consider contacting a qualified housing counselor, attorney, or relevant regulator promptly.
