Save the notice and related records, then ask the organization in writing what information it shared, with whom, and how it decided the data was de-identified. The right complaint route depends on who held the data: HHS’s Office for Civil Rights (OCR) handles suspected HIPAA and Part 2 violations, while the FTC directs consumers with concerns about health apps and other potentially covered businesses to ReportFraud.ftc.gov. This guide covers U.S. federal routes; it cannot determine whether a particular disclosure was unlawful or which state rules apply.
Preserve evidence before you contact the organization
Keep a record of what happened and when. Save the original notice, emails or texts, relevant screenshots and URLs, and the version of the privacy policy that applied at the time. Record the organization’s exact statements about anonymization or data sharing, the dates of communications, and the names or roles of people you contacted.
Write down what you know about the information, recipient, and possible exposure. Include whether the data contained direct identifiers or unusual details that might identify someone when combined with other information. Avoid forwarding or reposting sensitive records simply to document the incident.
Ask what was shared and how it was de-identified
Contact the organization’s privacy officer or privacy contact and ask for a plain-language account. Useful questions include:

- What health information was disclosed, and did it include direct identifiers or rare details?
- When was it disclosed, who received it, and for what purpose?
- Could the recipient combine the data with other information to identify people?
- If HIPAA applies, which de-identification method was used? If the organization relied on Expert Determination, did an expert document an identification-risk assessment?
- Has further sharing stopped, what containment steps were taken, and does the organization consider the incident a reportable breach?
- What notices, complaint process, or other support does the organization offer?
These questions can clarify the incident; they do not mean that every person is entitled to every underlying risk-analysis document. Keep the request and the organization’s response with your other records.
“Anonymous” is not a de-identification method
For protected health information covered by HIPAA, HHS recognizes two methods of de-identification: Safe Harbor and Expert Determination. Safe Harbor requires removing specified identifiers subject to the rule’s conditions. Under Expert Determination, a person with appropriate knowledge and experience uses accepted statistical and scientific methods to determine that the risk of identification is very small in context, including in light of reasonably available information and the anticipated recipient; the methods and results are documented. HHS explains both methods and their conditions.

Removing names alone does not settle the question. Other details can potentially identify someone when combined with information the recipient or others can access. Ask what method was used, who received the data, and whether the risk was assessed in that context. HIPAA’s methods apply to HIPAA-covered protected health information; a label such as “anonymous” does not by itself establish which legal rules govern another kind of data or organization.
Identify the organization and choose the right complaint route
Do not assume that every health-related service is covered by HIPAA. HIPAA generally applies to covered entities—such as health plans, certain health care providers, and clearinghouses—and to business associates in relevant circumstances. Some health apps and personal health record vendors outside HIPAA may instead be subject to the FTC’s Health Breach Notification Rule. The organization’s role and the facts matter. HHS OCR complaints: HIPAA and Part 2
Anyone may complain to OCR about a suspected HIPAA or Part 2 violation. The complaint must identify the entity and describe the conduct; OCR says it does not investigate anonymous complaints. You may ask OCR to keep your contact details confidential during an investigation. Complaints generally must be filed within 180 days of when you knew of the act or omission, although OCR may extend the deadline for good cause. Follow the HHS complaint instructions and keep a copy of what you submit.
FTC complaints: health apps and other potentially covered businesses
For a health app or another organization that may fall under FTC consumer protection or the Health Breach Notification Rule, the FTC directs consumers to ReportFraud.ftc.gov. The FTC’s health breach notice form is for covered organizations to report breaches; it is not the consumer complaint form.

Understand what a breach notice deadline does—and does not—mean
For a reportable breach of unsecured protected health information, a HIPAA covered entity must notify affected individuals without unreasonable delay and no later than 60 calendar days after discovery. That deadline does not by itself establish that a particular disclosure was a breach. Whether the rule applies depends on the facts, including whether the disclosure was impermissible and whether the information was unsecured. HHS describes the requirements in its Breach Notification Rule guidance.

Keep copies of complaints, confirmation numbers, written replies, and any breach notice together. Assess identity-theft or personal-safety concerns based on the specific information exposed and what the organization says happened; a health-data disclosure does not create the same risk in every case. The available federal guidance does not establish which state laws, contractual promises, or research rules may apply to an individual incident, so location and the organization’s role may affect additional options.
