Do not assume that deleted files were never copied. The next steps depend on how the incident happened, what information was involved, whether systems are still compromised, and which notification rules apply.
What to do first
- Bring in the right people. Assign responsibility for security and technical response, privacy or legal decisions, operations, communications, and management. Secure affected physical areas and digital access points. If ransomware or an active compromise is suspected, coordinate containment with the incident-response lead: isolating a system can limit damage, but the response team may need to preserve volatile evidence first.
- Preserve evidence and start a timeline. Record when the incident was discovered, what is known, which systems and people may be involved, what data may be affected, and what actions have been taken. Preserve relevant logs, system images, communications, and volatile evidence when feasible. Avoid wiping or rebuilding affected systems before evidence is captured unless immediate containment requires it. The FTC’s August 2023 Data Breach Response: A Guide for Business cautions against destroying forensic evidence during investigation and remediation.
- Limit further disclosure or access. Remove personal information that was improperly posted on an organization’s site, then ask search engines to remove cached versions and contact other sites holding copies. If information was sent to the wrong person, request secure deletion, return, or retrieval where appropriate. Change exposed credentials, revoke unauthorized access, review vendor access, and verify that the weakness that enabled the incident has actually been fixed.
- Work out the scope. Determine what kinds of data were involved, whose information it was, how many people may be affected, who accessed it, whether it may have been copied or misused, and whether the underlying systems remain vulnerable. Review logs, preserved data, service-provider access, and backups. State what remains unknown; do not claim information was not copied unless there is evidence to support that conclusion.
- Recover only when it is safe. For ransomware or malicious deletion, prioritize essential services and restore from clean backups after containment. Offline, encrypted backups are preferable where available. Do not reconnect potentially compromised systems until the response team determines they are safe. CISA’s #StopRansomware Guide, updated in May 2023, covers isolation, evidence capture, credential compromise, and recovery. CISA’s 2012 malicious-erasure alert is archived and should be treated as background, not current operational policy.
- Assess who needs to be notified. Consult privacy or legal counsel and the relevant regulator’s guidance for the jurisdictions and sectors involved. When notifying affected people or organizations, explain what happened, what information was involved, what has been done, what recipients can do, and how to get updates. Avoid sharing technical details that could create additional risk or impair an investigation.
How the incident type changes the response

What affected individuals can do
Use the organization’s official breach notice, but obtain contact details independently from its known website or account portal. Be cautious of messages that mention the incident: a real breach can be used to make phishing attempts seem convincing.
- If passwords or account credentials may have been exposed: Change them through the official service, use unique passwords, and secure recovery methods. Turn on multifactor authentication where available.
- If financial account access data was exposed: Contact the bank or card issuer using a trusted phone number, such as one on the card or its official website.
- If a US Social Security number was exposed: FTC guidance advises considering a credit freeze or fraud alert, reviewing credit reports, and using IdentityTheft.gov if the information has been misused.
- Match the response to the data: Generic credit monitoring does not secure a compromised account. An organization may offer a year of credit monitoring or other identity-protection or restoration assistance, particularly after exposure of financial information or Social Security numbers; such support is optional and does not prove that a service prevents identity theft.
When a breach must be reported
There is no single notification deadline that applies to every breach. The relevant rules depend on where the organization operates, where affected people are located, the organization’s role, the type of information, and any sector rules or contracts. Consult current regulator guidance and legal counsel rather than applying one jurisdiction’s deadline everywhere.
United Kingdom
The UK Information Commissioner’s Office (ICO) small-organization guidance says qualifying personal data breaches must be reported without undue delay and within 72 hours of discovery. It says individuals do not need to be notified if the risk is not high; high-risk incidents require notification without undue delay. The ICO page also states that its guidance is under review following changes made by the Data (Use and Access) Act, so check the regulator’s guidance and obtain legal advice before acting.

United States
The FTC’s August 2023 business guide says state breach-notification laws typically govern required notice details and points to federal requirements for particular sectors, including health information. Requirements vary by state, data, entity, and circumstances. The UK 72-hour guidance is not a general deadline for US incidents.
Other jurisdictions and regulated sectors
Identify the locations of the organization and affected people, the organization’s role, the data involved, and applicable sector rules or contractual duties. Those details are necessary to determine which reporting and notice obligations apply.

Prepare for recovery before another incident
Maintain backups that are encrypted and kept offline where practical, and make recovery part of the incident plan. A backup is useful only if it is clean and can be restored safely; reconnecting compromised systems too early can undermine recovery. NIST’s February 2024 SP 1800-29, Data Confidentiality: Detect, Respond to, and Recover from Data Breaches, provides organizational guidance for defending against data-confidentiality attacks and responding to breaches.
