If your church or nonprofit may have suffered a data breach, act quickly to stop further access, preserve evidence, and find out what information and people may be affected. Bring in qualified incident-response help and legal counsel before deciding what to tell people: the right steps and any notice duties depend on the incident, the data, the organization, and where affected people live.
What should you do first?
- Put one person in charge and assemble a response team. Assign responsibility for technology, operations, legal decisions, communications, and leadership. The team can include staff, outside specialists, or both. The Federal Trade Commission’s Data Breach Response: A Guide for Business (August 2023) recommends mobilizing promptly; CISA’s #StopRansomware Guide also recommends maintaining and exercising incident-response and communications plans.
- Contain access without destroying evidence. The FTC advises taking affected equipment offline, but not turning machines off until forensic experts arrive. Do not wipe, reset, or discard affected devices or logs before getting incident-specific advice. The FTC’s guidance is explicit: “Do not destroy evidence.” For ransomware incidents, CISA notes that highly volatile evidence, such as system memory and short-retention logs, may need to be preserved. Experts can help balance containment with evidence collection.
- Bring in qualified outside help if you lack the expertise. A digital-forensics or incident-response specialist can investigate the source and scope, capture and analyze evidence, and recommend remediation. Consult legal counsel—potentially counsel experienced in privacy and data security—about applicable federal and state requirements. Avoid making irreversible technical changes before coordinating with investigators.
How do you establish what happened?
Work with investigators to build a fact-based picture before deciding on notifications or making public claims. Identify:
- Which systems and accounts were accessed, and whether unauthorized access is still occurring.
- What information may have been accessed, acquired, or exposed, including health, financial, or government identification data.
- How many people may be affected and where they live.
- Whether the information was encrypted or otherwise secured, and what relevant logs or other evidence remain.
- Whether a service provider’s systems, accounts, or access permissions were involved.
Check a provider’s claimed fix rather than treating its assurance as proof that the incident is resolved. Review provider permissions and access, and work from forensic recommendations to close the entry point, change compromised credentials, correct the underlying weakness, and review segmentation and access controls. If personal information appeared on a website, remove it and check whether copies remain elsewhere.
How do you decide whom to notify?
Do not assume one deadline or notice rule covers every organization. The FTC says every U.S. state, the District of Columbia, Puerto Rico, and the U.S. Virgin Islands has breach-notification legislation involving personal information; requirements differ, and additional rules may apply depending on the data. Work with counsel to assess the affected people’s locations, the information involved, and the organization’s activities before communicating incident specifics. The FTC’s August 2023 guide provides general response guidance, not a determination that a particular church or nonprofit is covered by a particular law.

Check whether HIPAA applies
HIPAA breach-notification rules apply to covered entities and business associates when unsecured protected health information is breached. Do not assume that every church is a covered entity or that pastoral counseling records are HIPAA-protected; confirm the organization’s status, the data involved, and the facts with counsel.
The Department of Health and Human Services’ Breach Notification Rule summary, last reviewed July 26, 2013, describes these thresholds for incidents to which the rule applies:

These are HIPAA rule thresholds, not nationwide deadlines for every church or nonprofit breach. Because HHS’s summary is dated, verify current requirements with counsel before relying on it during an incident.
Should you report the incident to law enforcement?
Consider contacting local law enforcement and reporting cyber-enabled crime to the FBI’s Internet Crime Complaint Center (IC3), the FBI-run central hub for such reports. Contact affected businesses or service providers when their accounts or entrusted data are implicated. For ransomware, CISA directs organizations to consider applicable state notification laws and relevant health rules; those obligations still depend on the facts and the organization’s status.

What should you tell affected people?
Use a designated spokesperson or contact so messages remain consistent. Explain what is known and what is still being investigated, without speculation. Tell people what information was involved, what steps they can take, and how to get reliable updates or ask questions. Tailor recommendations to the exposed data rather than sending everyone the same generic advice.

- If Social Security numbers were exposed, the FTC identifies credit freezes or fraud alerts as possible protective steps.
- People who suspect identity theft can use IdentityTheft.gov for recovery guidance.
- If financial information or Social Security numbers were exposed, consider whether credit monitoring or identity-restoration support would help affected people.
