Before buying a token in a presale or before launch, verify who is selling it, what rights the token actually gives you, how supply and unlocks work, what the deployed contract permits, and whether resale is realistically possible. No checklist can make a speculative token safe or guarantee that you can sell it later. The legal treatment also depends on the offering’s facts and your jurisdiction, not the project’s chosen label.
Is this token presale legitimate?
Start by identifying the people and entities behind the sale: the issuer, founders or principals, affiliates, and any intermediary collecting funds. Confirm their identities and claims using sources independent of the project’s own promotional channels. Look for clear disclosures about registration or an applicable exemption where relevant. A project calling a token “utility” or “not a security” does not determine its legal status.
The U.S. Securities and Exchange Commission’s 2026 resource explains that a crypto asset that is not itself a security may still be offered subject to an investment contract. That legal analysis turns on the facts of the offering; it is not possible to determine the status of an unnamed token from its marketing label alone. Requirements also vary by jurisdiction. Be cautious if the seller’s identity is difficult to verify, if disclosures are missing, or if you are being rushed to send funds. The SEC warns investors to be wary of promises of high returns with little or no risk in its Investor Bulletin: Initial Coin Offerings.

What rights do you get, and what are you agreeing to?
Read the actual sale terms and token documentation, not just the landing page or social posts. Save copies with their publication date or version so you can tell later which terms you reviewed. Establish what holding the token entitles you to now, what is only promised for a future product, and what conditions must be met before that product or network works.
- What are the token’s stated rights, functions, or utility?
- How does the issuer say sale proceeds will be used?
- Can the issuer cancel the sale, and is a refund available? If so, under what conditions and by what deadline?
- Are there resale restrictions, lockups, eligibility limits, or other conditions on transferring tokens?
- Does the project rely on future adoption, execution, or managerial decisions for the token to have its proposed use?
The SEC’s ICO bulletin recommends asking about token rights, use of proceeds, resale and refund limitations, public access to the blockchain and code, and independent cybersecurity audits. The CFTC’s digital-currency advisory also cautions that buying a token solely in the hope of reselling it at a higher price is speculation and carries considerable risk.

How do you check token supply, allocations, and vesting?
Ask for a complete, internally consistent token-supply plan. Compare total supply with circulating supply and identify who receives the remainder. Check the allocation for founders, employees, investors, the treasury, and the public sale; then determine when each allocation can be transferred. A vesting announcement is a claim to verify against authoritative project documents and, where possible, the deployed contract.
- Supply and issuance: Is supply fixed, or can someone mint or issue more? Who has that authority, and can the rules change?
- Allocations: What share is held by insiders, the treasury, early investors, and public buyers?
- Vesting and lockups: When do allocations become transferable, and are releases gradual or concentrated on particular dates?
- Burn rules: Are burns discretionary or automatic, and who can change the mechanism?
- Control: Who controls supply-related permissions, reserves, and administrative keys?

Large future unlocks can increase the amount of tokens available to sell. If insider allocations or circulating supply are unclear, record them as unknown rather than treating a projected number as established.
Does a smart-contract audit mean a token is safe?
No. An audit is evidence about the code and scope reviewed; it does not guarantee that the token is secure, fairly administered, legally compliant, or free from fraud or loss. A report may cover only particular contracts or a specific version of code, and it may identify findings that remain unresolved.

- Find the contract address through a primary project channel you navigate to yourself.
- Check that the address matches the deployed contract on the relevant blockchain. Do not rely on an address copied from an unsolicited message or an unaffiliated post.
- Look for published contract source code and compare it with the deployed contract’s verified source where the chain’s explorer supports that information.
- Read the audit report. Check the auditor, date, contract addresses and code version covered, scope, findings, and whether fixes were verified.
- Inspect privileged controls described in the code or report, such as the ability to mint, pause transfers, change fees, or upgrade a contract. Understand who holds those permissions and whether they can be exercised without notice.
The SEC’s ICO bulletin recommends asking whether code has been published and independently audited, and the SEC’s 2025 staff statement lists audit status among potentially relevant disclosures. Neither source establishes a universal audit standard or a foolproof way to verify safety. An audit cannot rule out risks outside its stated scope, including privileged control or later changes to the code.

Not necessarily. A planned exchange listing is not the same as an independently confirmed listing, and a listing does not ensure that a market will have enough buyers for you to sell at an indicated price. Check the sale terms for transfer restrictions and compare any listing claim with an announcement from the venue itself. Distinguish a future plan from a live market with observable trading and liquidity.

Even when trading is available, you may not be able to sell the amount you want at the displayed price. Concentrated ownership, thin liquidity, volatility, and token unlocks can affect the price and the ability to exit. The SEC’s crypto-asset securities alert and the CFTC’s digital-currency advisory identify liquidity and other risks associated with crypto assets.
How do you avoid presale scams and pressure tactics?
Guaranteed returns, claims of high returns with little risk, countdown timers, celebrity testimonials, social-media tips, and hard sells are reasons to slow down, not reasons to act quickly. The SEC and CFTC identify these kinds of tactics in their investor guidance on digital-asset and crypto-investment scams, digital-asset fraud, and virtual-currency pump-and-dump schemes.
- Type the project’s official domain yourself or use a trusted bookmark; do not follow unsolicited links or scan unexpected QR codes.
- Compare the sale address and terms against primary project sources before sending funds.
- Verify listing claims with the venue rather than relying on a project’s promise or a screenshot.
- Treat any material claim you cannot corroborate as unknown.
Do not invest money you cannot afford to lose entirely. A checklist helps expose unanswered questions; it cannot remove the possibility of losing your full investment.
How should you compare two token offerings?
Compare like with like using documented evidence, not headline presale prices. This is an organizing framework, not a scorecard or a recommendation that either offering is suitable.

If a key comparison cannot be made because information is missing, do not treat silence as a favorable answer. No current, original, authoritative statistic establishes a reliable present-day failure or fraud rate for pre-launch token offerings, so an old estimate should not be used as your personal probability of loss.
