It should also give you a way to get help and say how the organization will send future updates. The exact legal requirements depend on the location, industry, and type of incident.
What should a data breach notification tell you?
Read the notice for five practical facts. A vague message that says only “an incident occurred” may not give you enough information to assess your risk or choose a response.
- What happened and when. Look for a plain-language explanation of the incident and any known dates, including when it occurred or was discovered. Dates may still be under investigation.
- What information was involved. The notice should identify the categories of data affected clearly enough for you to decide which accounts, records, or services need attention. In a health-related incident, for example, information might include diagnoses, lab results, medication or insurance details, Social Security numbers, financial account data, or dates of birth. - What the organization knows and is doing. Look for what it knows about how the compromise happened, what information was taken or accessed, what it has done to address the incident, and what it plans to do to reduce the chance of a recurrence. A clear notice should distinguish confirmed facts from matters still being investigated. FTC data breach response guide
- What you can do. Protective steps should match the data involved. If financial information was exposed, the FTC advises contacting your financial institution and monitoring accounts. If your Social Security number was involved, the FTC points to contacting credit bureaus about fraud alerts or freezes. These are examples; follow the notice’s specific advice and use official channels to carry it out. FTC data breach response guide
- Where to get help and how updates will arrive. Check for a working contact route and a description of the channel the organization will use for further notices. The FTC recommends that organizations explain how they will contact consumers in the future, which can help you distinguish an expected update from a phishing message. FTC data breach response guide
What information was exposed, and what should you do?
Use the categories named in the notice to choose a proportionate response. Do not assume that every breach creates the same risk or calls for the same action.
- Financial account information: Contact the financial institution using a number or website you independently verify, review transactions, and follow its guidance.
- Social Security number or similar identity information: Consider the FTC’s examples of contacting credit bureaus about fraud alerts or freezes. Use the official credit bureau channels rather than links in an unsolicited message.
- Health information: Check which records or details were involved and use the organization’s stated contact route to ask about protective steps specific to the affected information.
- Login credentials: If the notice says passwords or account access information were exposed, secure the affected account through its official site or app and take any steps the provider specifies. The cited guidance does not establish that credentials were involved in any particular breach.
If the notice does not identify the data involved or leaves an important instruction unclear, contact the organization through a route you find independently, such as its official website or a statement you already trust. Ask what categories of information were affected, whether your specific record was involved, what action is recommended, and where future updates will appear.

How can you tell whether a breach email is real?
A breach can prompt convincing scam messages that imitate the affected organization. Treat an email’s links, phone numbers, and attachments as unverified until you check them independently.
- Compare the message with the organization’s stated update channel. If it said notices would arrive by mail or appear on a particular official website, use that channel rather than an unexpected link.
- Visit the organization’s website by typing its known address or using a trusted bookmark, then look for the incident notice or contact information.
- Call a number from a trusted statement, payment card, or official website—not simply the number in the email.
- Be cautious if a message pressures you to act immediately, requests a password or payment, or asks you to install software. The FTC’s guidance specifically recommends explaining future contact methods as a way to help people avoid breach-related phishing.
Should you use credit monitoring offered in the notice?
First check why it is being offered and whether the data involved makes it relevant. FTC guidance notes that an organization may offer credit monitoring or identity restoration, particularly when Social Security numbers or financial information were exposed. An offer is a support option, not proof that every kind of misuse will be detected or prevented.

United States: FTC health-breach notices
For entities covered by the FTC’s Health Breach Notification Rule, the FTC says notices must be understandable and include a description of what happened, relevant dates when known, the kinds of identifiable health information involved, steps being taken, and contact information through at least two listed methods. This is a sector-specific rule, not a requirement for every U.S. organization or every breach. FTC Health Breach Notification Rule guidance
In an announcement dated April 26, 2024, the FTC said amendments to that rule expanded notice content and allowed expanded electronic notification. For covered breaches involving 500 or more individuals, the announcement says FTC notice is required at the same time as individual notices, without unreasonable delay and no later than 60 calendar days after discovery. United Kingdom: high-risk breaches
ICO guidance says individuals must be informed directly without undue delay when a breach is likely to result in high risk to their rights and freedoms. It says the notice should describe the nature of the breach, provide a relevant contact point, explain likely consequences and measures taken or proposed, and give specific protective advice where possible. The ICO page states that its guidance is under review following the Data (Use and Access) Act coming into law on June 19, 2025; check the regulator’s current guidance for a live case. When you need a legal answer
If you need to know whether an organization complied with a specific legal duty, identify the relevant country or state, sector, and type of information first. Check the current regulator guidance or consult a qualified adviser; the FTC and ICO examples above do not settle obligations in other jurisdictions or sectors.
