A utility-scale battery project in the United States usually needs separate land-use, construction and safety approvals, any site-triggered environmental permits, and a grid interconnection agreement. There is no single national permit package: the approvals depend on the project’s location, design, land status, site impacts and point of interconnection. Treat this as a screening framework, not a complete checklist for a specific parcel.

What permits do I need for a utility-scale battery project?

Start with four workstreams. They can proceed in parallel, but approval in one does not substitute for approval in another.

  • Land use and siting: zoning, conditional-use or site-plan approval, and potentially requirements for setbacks, access, noise, lighting, visual screening and decommissioning.
  • Construction and safety: applicable building, electrical and fire-code reviews, permits and inspections, as determined by the authority having jurisdiction (AHJ) and the codes adopted locally.
  • Environmental and resource review: approvals triggered by the footprint, construction work, site conditions or a relevant state or federal action. These may concern waters and wetlands, stormwater, protected resources, cultural or historic resources, or contaminated land.
  • Grid interconnection: a separate request and process with the relevant transmission provider, regional transmission organization (RTO), independent system operator (ISO) or utility.

The first work is identifying the state, county and municipality; parcel and land ownership; battery configuration and size; proposed point of interconnection; and likely site constraints. Without those details, no national list can determine which permits apply.

Who decides which approvals?

Federal involvement is not automatic just because a battery project is large. FERC’s federal transmission-siting authority is limited to qualifying electric transmission facilities in Department of Energy-designated National Interest Electric Transmission Corridors under specified circumstances. It is not a general permit for a battery plant, and FERC says state siting continues to cover most transmission projects.

How do I connect a battery storage project to the grid?

For a project seeking to inject electricity into the transmission system, the battery enters the generator-interconnection framework. Its ability to draw power to charge also matters: storage charging behavior is part of the assumptions used in interconnection studies. The governing tariff and project-specific studies determine the process, costs, timing and operating rights.

  1. Identify the point of interconnection and provider. Determine which transmission provider, RTO/ISO or utility governs the proposed connection and obtain its current tariff and queue requirements.
  2. Submit the request in the applicable queue. Meet the provider’s application, site-control, readiness and financial requirements. Requirements can depend on the request and tariff in effect.
  3. Complete the required studies. Participate in the applicable system-impact and facilities studies. The studies assess the proposed connection and can identify network upgrades assigned to the project.
  4. Negotiate and execute the interconnection agreement. Review the project-specific obligations, assigned upgrades and conditions for connection and operation.
  5. Complete construction, testing and authorization. Finish required interconnection work and testing, then obtain authorization to operate under the applicable process.

FERC Order No. 2023, issued in July 2023, requires public utilities to adopt revised pro forma generator-interconnection procedures and agreements. Its reforms include first-ready, first-served cluster studies, readiness and site-control requirements, and study assumptions that reflect storage charging. Order No. 2023-A, issued March 21, 2024, clarified and modified parts of the rule. For a live project, the current provider tariff and controlling rule text—not a general summary—govern.

Site control under FERC’s Order No. 2023-A summary

FERC’s explainer for Order No. 2023-A says interconnection customers must demonstrate 90% site control when submitting an interconnection request and 100% when executing the facilities study agreement. It describes a deposit alternative only where regulatory limitations may prevent timely demonstration of site control; in that circumstance, the customer must obtain site control within 180 days after completing the study process and executing an interconnection agreement. Confirm how these provisions apply to the request and current tariff.

Why queue statistics need a date

FERC reported that more than 2,000 GW of energy resources were waiting in interconnection queues at the end of 2022. In a September 25, 2024 article, FERC said wait times were longer than five years and that the average project then needed would not begin construction until 2029. Those figures describe the queue conditions FERC discussed at those dates; they are not a forecast for a project applying in 2026.

Do I need zoning approval for a battery energy storage system?

Check the parcel’s zoning and the local ordinance rather than assuming batteries are permitted by right or prohibited. Local rules may set permitted zones, require conditional-use approval, or distinguish projects by system size. They may also address setbacks, screening, noise, lighting, site access, emergency planning and decommissioning. PNNL’s 2023 report describes local concerns about safety, visual and auditory effects, and environmental impacts; its 2026 report notes that ordinance detail varies substantially and that some jurisdictions lack BESS-specific code language.

Contact the local planning authority and fire authority early. EPA guidance advises complying with state and local siting, zoning, marking and permitting requirements and planning for fire response and cleanup. Fire suppression, emissions, environmental effects of damaged-battery cleanup and incident-response coordination may need attention, but a particular design or fire standard is not universally required on the basis of this national framework. The adopted code and AHJ determine what evidence, plans and inspections a project needs.

Which environmental permits might apply?

Screen the site and construction scope before finalizing the layout. A permit is not required for every category on this list; applicability depends on the activity, jurisdiction and site conditions.

  • Waters and wetlands: determine whether proposed work affects areas within USACE jurisdiction. A USACE permit may be needed for certain activities in regulated waters; it is conditional on jurisdiction and project impacts.
  • Grading and stormwater: check construction-related requirements and any applicable local, state or federal reviews.
  • Floodplains, species and habitat: identify relevant site constraints and any review or mitigation obligations.
  • Cultural and historic resources: ask whether state or federal review is triggered by the site or an agency action.
  • Contaminated land, air and noise: investigate site status and applicable requirements with the relevant authorities.
  • Environmental review: check whether state review applies. NEPA may apply to a federal agency action; it is not a blanket federal permit triggered solely by a private battery project. FERC conducts NEPA environmental analysis in its qualifying transmission-permit process.

How to screen a site and connection before committing

For an initial comparison of possible sites or points of interconnection, evaluate the factors below together. A favorable land-use path does not establish an available grid connection, and a promising queue position does not settle local or environmental approvals.

  • Governing authority and approval path: map the local, state and federal agencies with jurisdiction.
  • Grid feasibility: compare queue status, study scope and estimated network upgrades under the applicable provider process.
  • Site-control readiness: determine whether the project can meet the provider’s requirements and relevant milestones.
  • Environmental constraints: identify potential impacts, permits and mitigation early enough to inform layout and schedule.
  • Local conditions: assess zoning, fire-response planning and community concerns.
  • Uncertainty: record schedule and cost risks that depend on studies, approvals or unresolved site conditions.

Before treating any checklist as project-specific, assemble the state and county, parcel and land ownership, project MW and MWh, battery chemistry, standalone or co-located configuration, proposed point of interconnection, transmission provider or utility, land-use designation, environmental constraints and intended market or operating model. Then consult current local ordinances, state siting and environmental agencies, the relevant AHJ, the USACE district if regulated waters may be affected, and the provider’s current tariff and queue documents.

FERC Chairman Willie Phillips said in a September 25, 2024 FERC article: “Connecting new resources to the grid quicker and more efficiently is key to more reliable, resilient, and affordable electricity for everyone.”
