Finding a song in Instagram’s music picker does not automatically clear it for every use. The permission may be limited by the track’s terms, the purpose of your post, where you publish it, and who controls the music rights. For musicians, the practical rule is to check both the recording and the underlying composition before using a track in promotional or commercial video.
Can I use Instagram’s music library for a Reel?
Sometimes, but access to a track inside Instagram is not blanket permission for every use. GEMA, the German collecting society, says the Instagram music-library permission it describes is for use on Instagram and for non-commercial content. Its guidance covers Stories, Reels, and videos, but it is not a universal legal rule: rights and exceptions depend on territory, facts, and the applicable rights-holder terms. Before posting, consider the purpose of the Reel, whether you will reuse it elsewhere, whether it is sponsored or promoted, and whether the track is available for that specific use. The sources here do not establish a current, complete catalogue or a universal eligibility matrix for every account type, country, format, or paid placement. A track appearing in the picker should not be treated as proof that all of those uses are cleared.
Can I use a trending song in a business or sponsored post?
Do not assume that a song available for an ordinary personal post is also cleared for a business, promotional, or sponsored video. GEMA advises businesses and other commercial users to obtain authorization or a licence from the relevant rightsholder to pair music with moving images—a use commonly associated with synchronization rights. Depending on the track, relevant parties may include a publisher or creator, and the recording may have a separate controller.
GEMA also cautions that commercial character is not determined solely by an account label. A post from a nominally private account may still be commercial depending on its purpose and context, such as promoting a product or forming part of influencer activity. The applicable analysis can depend on the rights holders’ views and local law; GEMA’s German guidance should not be read as a complete legal test for every country.
For a commercial video, identify the relevant rightsholders and obtain permission that covers the actual use before publishing. GEMA suggests searching its repertoire and contacting the publisher to identify rights holders. Check the licence scope, including territory, platforms, duration, and advertising or sponsored use; do not assume that permission for one context covers another.
Does crediting the artist make it okay?
No. Credit may be appropriate, but it does not by itself grant permission. Meta’s copyright guidance says infringement may still occur if you bought or downloaded the track, credited its owner, added a disclaimer, did not intend to profit, modified it, found it online, or saw other people post it. Recording music yourself at a public event does not automatically clear it either.

Those points address common misconceptions; they do not decide whether a specific use qualifies for fair use or another copyright exception. Exceptions vary by jurisdiction and depend on the circumstances. A short excerpt is not automatically permissible, and the guidance cited here does not resolve any individual case.

Do not assume so. GEMA describes the Instagram music-library permission as limited to Instagram, so using the same video on another platform may require separate permission for its music. Check the rights and terms for each platform and intended use, or obtain a licence that expressly covers cross-platform use. A Reel’s availability or permission inside Instagram is not evidence of clearance elsewhere.

What if it’s my own song?
Verify what “my song” means for the particular track. The composition (music and lyrics) and the sound recording can have different owners or controllers. Co-writing, samples, a label or publishing agreement, and distribution arrangements may affect what you can authorize or upload.
Check the agreements and permissions that apply to both the composition and recording, as well as any platform or distributor settings that affect how the track is delivered or used. The fact that you performed or released a song does not, by itself, establish that you control every relevant right.

What can musicians do if someone uses their music?
Keep documentation showing what rights you control and which recordings or compositions are involved. Meta’s January 24, 2023 Rights Manager announcement described tools for rights holders to manage when, how, and where their content is shared, alongside reporting and notice-and-takedown processes. Meta said at the time that Facebook Page holders could apply for Rights Manager access; that dated eligibility statement is not a guarantee of current availability.
If you want to use those tools, check Meta’s current eligibility and reporting instructions. Keep your ownership records and identify the specific content and rights at issue before submitting a report.

A practical pre-post checklist
- Identify the use: Is the video personal and non-commercial, promotional, sponsored, or part of a paid placement?
- Confirm platform scope: Will it remain on Instagram, or will you cross-post or use it in an advertisement elsewhere?
- Check both rights: Identify who controls the composition and the sound recording, and whether you have permission for the intended video use.
- Read the actual terms: Confirm that the track and licence, if any, cover your territory, format, duration, and commercial purpose.
- Keep evidence: Save licences, permissions, and relevant agreements so you can show what use was authorized.
