The key difference from ordinary highway diesel is its marking, permitted use and tax treatment—not an established difference in engine performance or base fuel formulation. This is a U.S. federal overview; state and local rules may also apply.
What is dyed diesel?
For federal excise-tax purposes, qualifying dyed diesel is marked with Solvent Red 164 at the prescribed concentration, or with another dye type and concentration approved by the IRS Commissioner. The dye must be added indelibly by mechanical injection. The marking identifies fuel intended for certain nontaxable uses; it does not by itself make every use of that fuel tax-exempt.
IRS Publication 510 requires this warning on applicable shipping documents and at retail pumps or delivery facilities: “DYED DIESEL FUEL, NONTAXABLE USE ONLY, PENALTY FOR TAXABLE USE.” (IRS Publication 510)
How is dyed diesel different from regular diesel?

The federal tax treatment is conditional. Publication 510 describes the exemption and applicable conditions, including that dyed fuel remains subject to the Leaking Underground Storage Tank (LUST) tax in the circumstances specified by the IRS. (IRS Publication 510)

Who may qualify to use dyed diesel?
The IRS Instructions for Form 720 list federal nontaxable-use categories that include farm use, off-highway business use, export, fuel used in a boat engaged in commercial fishing, and specified bus uses. This list identifies categories, not a blanket approval for every vehicle, machine or use on private property. Eligibility depends on the category and the facts. (IRS Instructions for Form 720)
Farm use does not automatically allow highway use
A farm connection alone does not make highway driving a nontaxable use. IRS Publication 225 says a diesel truck used both on a farm and on the highway should use undyed, taxed fuel, even when its highway trips relate to the farm business. (IRS Publication 225)

Can you put red diesel in a road truck?
Do not use dyed diesel in a truck for taxable highway use merely because the truck also serves a farm or another qualifying activity. The IRS farm example calls for undyed, taxed fuel in a vehicle used both on the farm and on the highway. Other cases depend on the specific federal category and facts. Check the relevant tax rules before fueling, and consult your state or local tax or fuel regulator for rules beyond the federal overview here.
What happens if dyed diesel is used for a taxable purpose?
Under IRS Publication 510 (December 2025), a penalty may apply when someone knowingly or with reason to know sells, holds or uses dyed fuel for a taxable use, or alters the dye. The penalty is the greater of $1,000 or $10 per gallon of dyed diesel or kerosene involved. After a first violation, the $1,000 amount increases depending on the number of violations. The penalty is additional to any tax imposed on the fuel. These are federal figures, not a statement of every state or local penalty. (IRS Publication 510)

Do not try to remove or disguise the dye: the IRS identifies altering it as conduct that may trigger the penalty.

Yes, but it is limited. The IRS says section 6435, added by Public Law 119-21, allows an eligible claimant to seek payment equal to federal excise tax previously paid on certain diesel or kerosene later removed from a terminal as eligible dyed fuel for nontaxable use. The provision applies to eligible dyed fuel removed on or after December 31, 2025; conditions include that the claimant paid the prior tax and that the fuel was removed as eligible dyed fuel. This is a claim process for qualifying circumstances, not a general exemption for every dyed-fuel buyer or use. See the IRS excise-tax overview and Internal Revenue Bulletin 2026-04.
