In the United States, what happens first depends on where the property is and which legal regime applies. On private or state land, local and state laws govern discoveries and excavations first; there is no single nationwide private-property procedure. The federal NAGPRA discovery process applies to federal and tribal lands, not automatically to private property.

What happens when archaeologists discover human remains on private property?

Work on or near the discovery may be subject to local or state requirements, but the specific authority, contacts, deadlines, and rules for protecting or excavating remains depend on the jurisdiction and circumstances. Archaeologists, a landowner, or a construction crew should not assume that finding remains gives them authority to move or excavate them.

The National Park Service summarizes the distinction this way: “On private or state land, discoveries or excavations are governed first by local or state laws, but human remains or cultural items removed from private or state land may be subject to repatriation under NAGPRA, depending on who has control of them.” National Park Service: Protection on Federal or Tribal Lands

  • Location: Identify the state or territory and the local jurisdiction.
  • Land status: Confirm whether the site is actually private land, rather than federal or tribal land.
  • Project connection: Determine whether the work involves federal land, funding, or permits; these circumstances may affect whether NAGPRA applies.
  • Nature of the find: Establish whether the discovery is suspected to be human remains or associated cultural items, using the appropriate authorities rather than disturbing it to find out.
  • Activity underway: Note whether the discovery occurred during construction or another activity that could threaten it, or during archaeological research.

For a specific property, check the current state statute and official state archaeology or historic-preservation guidance. The National Park Service also advises that state or local law governs first for discoveries on private or state land. National Park Service: Compliance

How private and federal or tribal land procedures differ

Written discovery documentation No nationwide 24-hour private-land deadline is established by the cited guidance. Due no later than 24 hours after discovery under the NPS-described procedure.
Stopping and restarting activity Requirements depend on local or state law and the circumstances. If an activity related to the discovery could threaten it, that activity must stop and cannot resume until the prescribed written certification and notice period have been met.
Excavation Check local and state rules; private ownership alone does not establish permission to excavate. Intentional excavation requires written authorization. On tribal lands, written consent from the relevant Tribe or Native Hawaiian organization is also required.
Control or disposition Landowner control is not necessarily final; removed remains or cultural items may be subject to NAGPRA repatriation depending on who controls them. NAGPRA establishes priorities for control or disposition, including lineal descendants and, in specified circumstances, Tribes or Native Hawaiian organizations.

What NAGPRA requires on federal or tribal lands

The federal discovery procedure is not a default rule for private property. It matters if the discovery is on federal or tribal land. Under the National Park Service’s description, a person who knows or has reason to know of a discovery there must take these steps:

  1. Immediately report the discovery to the appropriate official and any applicable additional point of contact.
  2. Make a reasonable effort to secure and protect the discovery.
  3. Send written documentation within 24 hours after discovery. The documentation should identify the location by county and state, describe the discovery, and describe the steps taken to protect it.
  4. Stop activity that could threaten the discovery if the discovery is related to an activity. Do not resume until the appropriate official issues written certification and the prescribed notice period has been met.

For federal land, the report goes to the agency with primary management authority. Tribal-land contacts vary by location and may include the Tribe or the State of Hawai’i Department of Hawaiian Homelands. The National Park Service’s discovery and excavation guidance describes the procedure and contacts.

Intentional excavation on federal or tribal lands requires written authorization; on tribal land it also requires written consent from the relevant Tribe or Native Hawaiian organization. The requirements appear in 25 U.S.C. § 3002. NAGPRA’s control and disposition provisions are set out in Title 25, Chapter 32.

Why state procedures cannot be generalized

State examples show why a single nationwide set of instructions would be misleading. Maryland Historical Trust says Maryland law generally governs human remains discovered outside the NAGPRA framework. New Hampshire law describes a role for the state archaeologist in arrangements with a landowner for protection or removal after certain discoveries of unmarked burials. Those examples illustrate variation; neither state’s process should be applied to property elsewhere.

Can construction continue after remains are found?

There is no universal private-property answer in the cited federal guidance. Whether work must stop, who can authorize its resumption, and what protection is required depend on the applicable state or local rules and the project. If the find is on federal or tribal land and related activity could threaten it, the NAGPRA process requires that activity to stop until the prescribed certification and notice requirements are met. Do not treat that federal or tribal rule as automatically governing private land.
