Piney Point’s 2021 emergency began with signs of a possible liner tear, not a sudden collapse. Officials discharged water under controlled emergency conditions to reduce the risk of an uncontrolled release; closing the former phosphate site has taken much longer because it requires water treatment and disposal, sediment work, and phased reconstruction and capping.
What is Piney Point?
Piney Point is a former phosphate-processing facility in Manatee County, Florida. Its water-management compartments—often called stacks or reservoirs—held process water and stormwater. The 2021 crisis centered on NGS-South, one of those compartments.
What happened in March and April 2021?
On March 25, 2021, HRK notified the Florida Department of Environmental Protection (DEP) that conductivity and water volume had increased in the stack seepage collection system. Those readings indicated a possible tear in the NGS-South liner. DEP issued an emergency final order on March 29. Controlled discharge to Tampa Bay began the next day to lower the water burden and reduce the chance of an uncontrolled release toward Bishop Harbor. The governor declared a local state of emergency on April 3, and DEP’s timeline records the emergency discharges ending April 9.
Spectrum News Bay News 9 reported in June 2026 that more than 200 million gallons had been discharged to Tampa Bay during the emergency response. That was a controlled discharge—not the release of the entire reservoir in a collapse.

According to the U.S. Environmental Protection Agency’s incident record, the leak had been repaired by April 13 and no water was then being discharged from the site. EPA also recorded that sampled parameters with applicable water-quality standards met those standards, with trends stable or declining between sampling events. Those are historical results for the agency’s sampling; they do not establish that there was no ecological impact or provide a current environmental assessment.
Why is the cleanup taking so long?
Ending the emergency discharge did not close the site. The approved approach is a phased engineering closure, in which water management and physical work on the compartments have to proceed together.

Process water must be treated and removed
Water is managed through treatment and disposal rather than simply pumped away. A permitted underground injection control (UIC) well on Buckeye Road receives treated, non-hazardous industrial wastewater. DEP says it inspects the injection and monitoring wells. The well is one disposal route, not a substitute for closing the compartments.
DEP’s January 5, 2024 update said pretreatment-facility operational testing was underway and reported 107,714,900 gallons transferred for well disposal by that date. Storage levels also respond to rainfall, wind, waves, and water-management operations, so a volume from one date is not a permanent measure of the work remaining.

Soft sediments and compartment structures need work
Soft material must be dredged and dewatered or consolidated where needed. The receiver and engineers determined that closure work on OGS-South was complete in September 2023. Preparation and dredging of NGS-South began in November 2023 to remove soft material for dewatering and consolidation. Other compartments have their own preparation and closure stages.
Closed areas must be rebuilt for stormwater management
The closure plan calls for preparing reservoir areas, adding fill and liners where needed, constructing stormwater controls, and placing a soil and vegetative cap. Compartment walls are also modified so closed areas no longer retain process water and can function as part of the site’s stormwater system. These steps make closure more than a pumping operation: water treatment, conveyance and injection, sediment handling, and construction have to be sequenced as an integrated project.

What do the dated water figures show?
The reported quantities are snapshots taken under changing site conditions, not current October 2026 measurements.

The two remaining-water figures refer to different dates and evolving water-management conditions. DEP’s detailed page gives August 9, 2024 as the date of its latest narrative volume update; it does not establish the amount remaining today.

When is Piney Point expected to be closed?
The schedule has shifted. In May 2022, DEP said the conceptual plan anticipated final closure by December 2024. In June 2026, Spectrum News Bay News 9 reported that Manatee County Utilities Director Patrick Shea expected facility closure in November or December 2026. That is a forecast reported at the time, not confirmation that closure has since occurred. The same report said county cleanup management would continue beyond that expected facility-closure date.
DEP’s live closure page labels OGS-South closed, NGS-South ongoing, and NGS-North being prepared, but those labels are not accompanied by a distinct update date. Its latest dated detailed status narrative is August 9, 2024. The June 2026 reporting provides a newer schedule forecast, but the sources cited here do not establish final completion or a present-day compartment-by-compartment status.
Who is responsible for the cost?
There are separate state enforcement and county operating-cost issues. DEP says a circuit court entered final judgment against HRK on August 13, 2024, awarding the agency $258,132,438.91: $119,745,000 in civil penalties and $138,387,438.91 in costs and expenses. DEP says it may seek additional costs after closure.
Separately, the Bradenton Herald reported in 2026 that Manatee County faced approximately $23 million in unreimbursed expenses and had decided to continue managing cleanup. That figure describes the county’s reported funding position, not a final ruling about who must ultimately bear those costs.
