The SEC Chair leads the agency’s executive and administrative work, but does not act as a separate commissioner or make every official decision alone. The President appoints SEC commissioners with the Senate’s advice and consent, then designates one of those commissioners as Chair.

What does the SEC Chair do?

The Chair is the SEC’s top executive and is responsible for the Commission’s executive and administrative functions, according to the SEC’s commissioner explainer and its strategic plan. Former SEC Chair Christopher Cox described the role as carrying out the agency’s “day-to-day executive functions” in a 2007 speech.

The Chair’s leadership operates within the SEC’s mission: protecting investors, maintaining fair, orderly, and efficient markets, and facilitating capital formation. The Chair is one member of the Commission, not a separate agency. Cox noted that, generally, the five commissioners vote on official SEC decisions. The Chair’s executive responsibilities therefore should not be confused with unilateral authority over every Commission decision.

How is the SEC Chair appointed?

The process has two distinct stages: appointment to the Commission and designation as its Chair. The Senate’s advice and consent apply to the commissioner appointment; the Chair designation is made by the President.

  2. The Senate considers the commissioner appointment. The nominee must receive the Senate’s advice and consent to become a commissioner.
  3. The President designates a sitting commissioner as Chair. The SEC says the President “also designates one of the Commissioners as Chairman.” The Chair is not a separately confirmed sixth seat.

How the Chair fits into the five-member Commission

The SEC describes a Commission of five members. Commissioners serve staggered five-year terms, and no more than three may belong to the same political party. The SEC also says a commissioner may continue serving for approximately 18 months after a term expires if a replacement has not been appointed. These are details about commissioner service; the cited SEC explainer does not establish a separate fixed term for the Chair.

Who is the current SEC Chair?

As of October 4, 2026, the SEC identifies Paul S. Atkins as Chair. According to his SEC biography, President Donald J. Trump nominated Atkins on January 20, 2025; the Senate confirmed him on April 9, 2025; and he was sworn in as the 34th Chair on April 21, 2025. The current-officeholder detail is date-sensitive and may change.
