Crypto exchange licensing means a firm has permission to provide specified services in a particular jurisdiction. It can bring concrete duties for how a provider handles client assets, but it is not a guarantee that customers will recover funds after every failure—and it does not, by itself, mean funds are insured. Check the exact legal entity and service against the regulator that applies where you live.
What does crypto exchange licensing mean?
“Licensed” is a useful everyday term, but laws may describe a provider as authorized, registered, or otherwise permitted. The important point is that regulatory permission is tied to a jurisdiction, a legal entity, and particular services—not a general quality badge for every product or company using an exchange’s brand.
In the EU, the Markets in Crypto-Assets Regulation (MiCA) generally requires a person providing crypto-asset services in the Union to be an authorized crypto-asset service provider (CASP), unless it qualifies under a specified route for certain already-regulated entities. The requirement concerns the services and entity covered by the rules. It does not establish that an exchange is licensed everywhere it operates. ESMA’s MiCA Article 59
As a separate example, the UK FCA says firms wishing to undertake new cryptoasset regulated activities will need FCA authorization under the future regime. The FCA’s final rules, published on 30 June 2026, apply to firms granted permission under the Financial Services and Markets Act (FSMA) on or after 25 October 2027. That UK timeline is distinct from EU MiCA and should not be treated as a statement of every firm’s current obligations. FCA: Cryptoasset firms—authorisation, supervision and enforcement

What can licensing rules mean for your assets?
Under MiCA, a provider holding clients’ crypto-assets or the means to access them must make adequate arrangements to safeguard clients’ ownership rights, especially if the provider becomes insolvent, and to prevent using clients’ assets for its own account. Where relevant business models hold client funds other than e-money tokens, the rules also require safeguarding arrangements and separate identification of accounts. ESMA’s MiCA Article 70
For providers offering custody and administration, MiCA sets out further duties. The custody agreement must specify responsibilities and custody details; the provider must keep client position records and maintain a custody policy; client holdings must be segregated from the provider’s holdings; and procedures must allow assets or access means to be returned as soon as possible. These are meaningful legal and operating obligations, not a promise of a particular result. They do not guarantee recovery in every insolvency, hacking incident, fraud, operational failure, or customer dispute.
Are my assets safe if a crypto exchange is licensed?
A license can indicate that a provider is subject to defined requirements and oversight for covered services in a particular jurisdiction. It does not make crypto-assets risk-free or establish that every asset on the platform is protected in every circumstance. The rules cited here impose safeguarding and custody duties; they do not promise that every customer will always recover every asset.

Also distinguish the exchange’s custody model from its regulatory status. If a provider holds your assets or access means, its custody obligations matter. If you control your own private keys, you take on responsibility for securing them and maintaining a usable recovery method.
Does a crypto license mean my funds are insured?
No such conclusion follows from the MiCA provisions described here. Safeguarding and segregation requirements are not the same as deposit insurance, a guarantee against loss, or a promise that a regulator will reimburse customers. Check the specific protection, if any, that applies to the relevant entity, service, and jurisdiction rather than inferring insurance from a license.

How do I check if a crypto exchange is regulated?
For an EU provider, start with ESMA’s interim MiCA register and confirm the result with the relevant national regulator. ESMA says the register data is supplied by national competent authorities and the European Banking Authority; its page reported the latest interim-register update as 24 September 2026. A register entry is a status-checking tool, not an endorsement of a product or a guarantee about an account.
- Find the legal entity. Check the company name in the exchange’s terms and account documents. A familiar brand name may not identify the entity serving your account.
- Identify the jurisdiction. Consider where you live and where the provider’s relevant entity operates. A permission in one jurisdiction does not automatically establish permission in another.
- Check the official register. Search the relevant regulator’s register for the exact entity and confirm that the permission covers the service you intend to use.
- Note the date and resolve conflicts. Check when the register information was updated. If a result is missing, unclear, or inconsistent with the provider’s claims, verify it with the regulator.
- Read the account terms. Review custody, withdrawal, insolvency, and complaint terms. A register entry does not answer every question about your account or the provider’s procedures.
How does self-custody change the decision?
A self-custody wallet changes who controls access to the crypto-assets; it does not establish whether an exchange is licensed. With a hardware wallet, key access can remain under the user’s control, but the user must protect the backup and recovery information. Losing the device and forgetting the backup can mean losing access. Trezor describes PIN and passphrase protection and on-device confirmation for its Safe 3, and its terms of use warn about loss of access when both device and backup are unavailable. Self-custody is not a guarantee against loss; it shifts key-management responsibilities to you.

What licensing does—and does not—tell you
- It can tell you that a specified entity has permission for covered services in a particular jurisdiction and may be subject to related legal duties.
- It does not tell you that every service or affiliate under the same brand is covered, or that the provider is authorized in every country.
- It does not prove that customer funds are insured or that customers will recover assets after every kind of loss.
- It does not replace checking custody arrangements, withdrawal terms, complaint routes, and the exact entity serving your account.
