A voluntary AI commitment is a promise or practice an organization chooses to adopt; regulation is a legal requirement for people, systems, or activities within a law’s scope. Voluntary frameworks can help organize AI risk management, but adopting one does not replace applicable legal duties. The distinction depends on the commitment’s terms, the jurisdiction, an organization’s role, the AI system and use, and the relevant dates.
How voluntary commitments differ from regulation
The key difference is legal force. An organization can choose to use a voluntary framework or make a pledge. A regulation establishes duties that covered actors must meet, with scope, application dates, and enforcement set by law.

These are broad categories, not a claim that every pledge or law works identically. A voluntary promise may have a separate legal effect if it is incorporated into a contract or another binding instrument. A regulation’s exact requirements and consequences also depend on its provisions and the facts.
Examples: NIST AI RMF and the EU AI Act
NIST AI Risk Management Framework: voluntary guidance
The U.S. National Institute of Standards and Technology (NIST) describes its AI Risk Management Framework (AI RMF) as voluntary. NIST says organizations are not required to use it. The framework offers a way to organize risk management and consider trustworthiness across the design, development, use, and evaluation of AI systems. It can inform internal governance, but choosing it does not, by itself, establish that an organization has met every legal obligation that applies to it. NIST’s AI RMF page and its AI RMF FAQs describe its voluntary status.

NIST’s 2023 AI RMF 1.0 publication calls the framework “voluntary, rights-preserving, non-sector specific, and use-case agnostic.” The framework’s status can change: NIST’s current framework page says AI RMF 1.0 is being revised as part of the White House AI Action Plan. Check NIST’s current materials for the version and any related agency policy relevant to your situation. NIST’s AI RMF 1.0 publication provides the original framework description.
EU AI Act: binding regulation
The European Union’s AI Act is a contrasting example of binding regulation. Article 113 of Regulation (EU) 2024/1689 states: “This Regulation shall be binding in its entirety and directly applicable in all Member States.” Which duties apply to a particular organization or AI system still depends on the Act’s scope, the organization’s role, the use in question, and the relevant application date. The Act also shows that voluntary measures and binding rules can coexist. Article 95 encourages codes of conduct to support voluntary application of selected requirements and address topics such as environmental sustainability, AI literacy, inclusive design, and impacts on vulnerable groups. That pathway does not make the Act voluntary or, on its own, create an exemption or compliance safe harbor. Article 95’s text describes the voluntary codes.
When do the EU AI Act’s provisions apply?
The Act has phased application dates; saying simply that it “starts in 2026” misses provisions that apply earlier or later. Article 113 of the consolidated text gives these dates:

- 2 August 2026: the general application date.
- 2 August 2027: Article 6(1) and corresponding obligations apply.
These are dates in the consolidated text, not a determination that every duty applies to every organization on those days. The provision, actor, system, and circumstances matter. The cited EUR-Lex text is consolidated as of 27 July 2026; EUR-Lex identifies consolidated texts as documentation tools and points to the authentic versions in the Official Journal. For a legal determination, check the authentic text and obtain appropriate advice.
How enforcement changes the practical stakes
Voluntary frameworks often support internal processes, and commitments can bring reputational or contractual consequences depending on their terms. Regulation adds public-law accountability: the EU AI Act requires Member States to provide penalties and other enforcement measures for infringements, described in the Act as effective, proportionate, and dissuasive. The exact consequences depend on the provision and national implementation. Article 99 of the consolidated AI Act addresses penalties and enforcement measures.

Using a framework may help an organization document and manage risks, but it is not a substitute for identifying and meeting applicable legal duties. Conversely, not using NIST AI RMF does not, by itself, show that an organization has violated a law; the relevant law and facts determine that.

- Identify the jurisdiction. Determine which countries or regions’ laws could apply to the organization, system, and use.
- Identify the organization’s role and activity. A law may impose different duties on different actors. Map what the organization does with or in relation to the AI system.
- Check the system and use against the law’s scope. Do not assume that a general framework or public pledge decides whether a particular system is covered.
- Check the dates and provisions. Confirm which requirements apply and when; phased laws can have multiple dates.
- Separate governance evidence from legal analysis. A framework can structure internal work. Verify separately whether the organization must meet specific legal requirements, document compliance, or follow other binding instruments.
- Read the commitment’s terms. A pledge may carry consequences through a contract or another binding instrument even when the framework itself is voluntary.
This comparison focuses on NIST’s U.S. framework and the EU AI Act; it is not a complete inventory of U.S. or global AI law. The United States has binding AI-related requirements that may arise under existing, sector-specific, state, or local law, as well as contracts. Whether a particular organization or use is covered requires analysis of the current law and facts.
