Short answer: Virginia does not automatically make an app legal because it calls itself a “social sportsbook.” The key question is how the app works: whether users stake money or something else of value for a chance to win a prize or other value based on an uncertain outcome. Virginia separately permits sports betting through a Virginia Lottery-regulated system. The sources cited here do not establish the status of any particular social sportsbook, so assess the app’s actual payment, prize, and redemption rules rather than relying on its label.
How Virginia’s gambling definition applies to a social sportsbook
Virginia Code § 18.2-325 defines illegal gambling to include making, placing, or receiving a bet or wager involving “money or other consideration or thing of value” in exchange for a chance to win a prize or other value that depends on an uncertain result. Read the Virginia Code’s gambling provisions for the statutory language.
For a social-style sports app, the practical questions are what a user must pay or contribute to participate, what the user may win, and whether in-app currency or rewards can be redeemed or transferred. Those details may matter when applying the statute; they are not, by themselves, a separate legal test or a ruling on a specific app.

How regulated sports betting works in Virginia
Virginia’s sports-betting program operates under the Virginia Lottery framework, with permits and oversight by the Virginia Lottery Board. The statutory framework is in Chapter 40 of the Virginia Lottery Law and its sports-betting article. This regulated system is not blanket approval for unlicensed apps.

For permitted betting, event and wager categories are subject to approval under 11VAC5-70-170. The Virginia Lottery sports-betting page provides its current guidance and says the directive may change; it was marked updated August 17, 2026. The regulation itself is available at 11VAC5-70-170. Check those official sources for current permitted options rather than relying on an old list.
What to check before using an app
- Check the operator’s authorization. Determine whether the operator is permitted in Virginia’s Lottery-regulated sports-betting program. The state’s sports-betting guidance and Lottery Law are the relevant official starting points.
- Read the payment and entry rules. Look for what users pay, stake, or contribute to enter a contest or make a prediction, including paid or purchased in-app currency. Consider how those mechanics fit the statutory wording on consideration or a thing of value.
- Read the prize and redemption terms. Check what can be won and whether balances, tokens, or rewards can be cashed out, redeemed, or transferred. These terms are relevant facts, not a guarantee of how Virginia authorities or a court would classify the app.
- Check the event and wager type. For regulated sports betting, confirm that the event and wager are currently authorized and that no statutory restriction applies. The sports-betting statute and Lottery’s current directive govern these distinctions.
“Fantasy” or “social” wording does not settle legality
Virginia’s sports-betting statute excludes specified categories, including authorized fantasy contests, charitable gaming, lottery games, and horse-race wagering. These are category-specific exclusions. An app does not become an authorized fantasy contest—or otherwise fall within an exclusion—simply by using “fantasy” or “social” in its name or marketing. The statute also prohibits bets on youth sports, proposition bets on college sports, and bets on Virginia college sports. Permitted events and wager types for regulated operators are further subject to the Lottery’s current authorized-events guidance.
Separate rule: credit cards for regulated sports-betting accounts
A 2026 amendment, HB 515, approved April 13, 2026, bars the Director from approving credit cards as a funding method for sports-betting accounts and requires permit holders to take reasonable measures to prevent credit-card acceptance on their platforms. This rule concerns funding regulated sports-betting accounts; it does not determine whether a social sportsbook app is legal. See the enacted text of HB 515.

What this means for a specific app
The available statutes and official guidance establish the general framework, but they do not classify every app marketed as a social sportsbook. A reliable answer for a particular service depends on its current terms and actual mechanics, including what users contribute, what they can win, and how any rewards can be redeemed or transferred. For a decision about a specific app, consult a Virginia attorney rather than treating its branding or an online description as a legal determination.
