Partly. On 19 August 2025, US Director of National Intelligence Tulsi Gabbard said the UK had agreed to drop a demand that would have enabled access to protected Apple data belonging to Americans. But the UK Home Office did not confirm or deny that the reported notice existed, and later reporting in 2026 described a separate UK-only notice and a fresh Apple legal challenge. The retreat Gabbard announced was therefore not a public resolution of the wider dispute.
What did the UK reportedly demand, and what did the US announcement say?
News reports in February 2025 said that the UK had issued Apple a technical capability notice (TCN) under the Investigatory Powers Act 2016. The reported January notice sought a capability to access encrypted cloud material broadly, rather than assistance limited to one named account. Its reported scope raised concerns about data belonging to US users as well as people in the UK. Apple challenged the order, but the notice and its details were not publicly confirmed by the UK government. The Associated Press reported that the Home Office said it would not comment on operational matters, including confirming or denying the existence of notices.
On 19 August 2025, Gabbard publicly announced that the UK had agreed to drop its mandate as it affected Americans’ encrypted data. She said she had worked with UK partners alongside President Donald Trump and Vice President JD Vance. In her statement, she described the demand as a “back door” that would have enabled access to protected data and encroached on civil liberties. The Washington Post’s account and AP’s reporting placed the announcement amid US diplomatic pressure and criticism from members of Congress. The negotiations’ terms were not disclosed, and no published agreement or court ruling verified the terms of the retreat.

What changed for Apple’s Advanced Data Protection users in the UK?
Advanced Data Protection (ADP) is an optional iCloud feature that provides end-to-end encryption for supported data categories, including files, photos and notes. That description does not mean that every category of iCloud data is end-to-end encrypted by ADP.

Apple’s immediate product change in February 2025 was to stop making ADP available to new UK users and tell existing UK users it would disable the feature for them. That was a change to the availability of an optional protection feature; it was not itself confirmation of the notice, a public account of its legal terms or proof that authorities had accessed particular users’ data. AP and The Washington Post reported the withdrawal and described ADP’s coverage.
Did the 2025 retreat end the dispute?
No. By 2026, reporting described a later notice limited to UK customers and another legal challenge by Apple. The UK’s continued refusal to confirm or deny notices means the reported scope and timeline are not officially established by the government. At a September 2026 tribunal hearing, Reuters reported that Apple’s lawyer Ben Jaffey called the government’s position “farcical”; that was an advocate’s criticism, not a court finding.

US Senator Ron Wyden and Representative Warren Davidson said Congress and the public still did not know the full scope of the current request because of secrecy. In their 11 September 2026 letter, they argued that the secrecy undermined democratic oversight and strained US–UK relations. Their statement is available from Wyden’s office.

The dispute reflects competing policy concerns, not a simple choice between public safety and privacy. The UK government’s international statement argues for solutions that preserve privacy and cybersecurity while enabling public-safety work. The Home Office statement on end-to-end encryption and public safety sets out that position.

Authorities argue that access to relevant information can matter in serious-crime investigations. The countervailing concern is that a capability designed to let authorities reach encrypted data may create weaknesses that could be exploited beyond the intended investigation. In this case, the reported breadth of the first notice and uncertainty surrounding the later request are central to the debate; the secret terms themselves are not public, so claims about exactly what Apple would have had to build or disclose should be treated cautiously.
