UK authorities can seize or freeze cryptocurrency under the Proceeds of Crime Act 2002 (POCA) without first securing a criminal conviction. The route depends on the case: confiscation follows a conviction and targets the defendant’s benefit from crime, while cryptoasset civil forfeiture targets particular property and is decided by a court. The Economic Crime and Corporate Transparency Act 2023 added powers to seize crypto and wallet-access items, freeze crypto held by qualifying service providers, seek forfeiture, and convert assets into money.
These powers do not mean that authorities can keep every asset they seize. A court must decide whether the property meets the statutory test, and the scheme includes procedures for release, ownership claims, appeals and, in exceptional circumstances, compensation. The detail below reflects the Home Office’s 2024 guidance for England and Wales; procedural rules should not be assumed to be identical across the UK. This is legal information, not legal advice.
Can UK authorities seize crypto without a conviction?
Yes. A conviction is required for the post-conviction confiscation route, but it is not a prerequisite for the cryptoasset civil-forfeiture powers in Part 5 of POCA. These are different legal processes: one concerns a convicted defendant’s benefit from crime; the other concerns whether particular property is recoverable or intended for unlawful use.

Confiscation after a criminal conviction
After conviction, a court may make a confiscation order requiring the defendant to pay an amount reflecting the benefit obtained from criminal conduct, subject to the defendant’s available realisable assets. The order is for a sum of money; it is not necessarily an order declaring that a specific bitcoin or token is itself criminal property. Cryptocurrency may nevertheless be among the assets used to satisfy the order.

The Crown Prosecution Service describes confiscation as a way to deprive offenders of criminal proceeds, deter further offending and reduce funds available to criminal enterprises. Quoting section 5A of POCA, the CPS states that “the principal objective (of confiscation) is to deprive the defendant of the defendant’s benefit from criminal conduct, so far as within the defendant’s means”.
Civil forfeiture and civil recovery
Civil forfeiture and civil recovery are non-conviction-based routes. They focus on property rather than requiring the person connected with it to be convicted. Under the cryptoasset-specific civil-forfeiture process, the court can consider whether the property is recoverable or was intended for use in unlawful conduct. Civil recovery in the High Court can apply to assets more broadly, while civil forfeiture is available for specified kinds of property, including cryptoassets.
The tests and procedures are not simply a lighter version of criminal confiscation. For civil recovery, the authority must establish on the balance of probabilities that assets were obtained through unlawful conduct. A civil-forfeiture application can also concern property intended for unlawful conduct. The Home Office says there is no administrative forfeiture of cryptoassets: a court-based process is central to this route.

Schedule 9 to the Economic Crime and Corporate Transparency Act 2023 inserted four cryptoasset-specific chapters into Part 5 of POCA. They set out powers to find and detain cryptoassets and access items, freeze assets held by qualifying providers, ask a court to forfeit assets, and convert them into money before a forfeiture decision.
| POCA chapter | What it covers |
|---|---|
| Chapter 3C | Searching for and seizing cryptoassets and cryptoasset-related items, including items that may help officers access an unhosted wallet. |
| Chapter 3D | Crypto wallet freezing orders for assets held by a qualifying UK-connected cryptoasset service provider. |
| Chapter 3E | Applications to forfeit detained or frozen cryptoassets. |
| Chapter 3F | Conversion of detained or frozen cryptoassets into money before the forfeiture hearing, principally to address volatility. |
The Home Office describes the new chapters as modelled on existing forfeiture schemes for cash, listed assets and money in bank accounts. The statutory definition of “cryptoasset” is broad: according to the Home Office circular, it can encompass cryptographically secured digital representations of value or contractual rights using distributed-ledger technology, including NFTs, stablecoins and privacy coins.
A “cryptoasset-related item” is property that is, contains, or gives access to information likely to help seize recoverable cryptoassets or assets intended for unlawful conduct. A wallet may be software, hardware, a physical item or a combination of these, used to store the private key that permits access.

How does a seizure from an unhosted wallet work?
An unhosted wallet is not administered by an exchange or other custodian. The Home Office describes the process as a sequence: search for relevant items, seize and detain them, obtain relevant information, reconstruct the wallet, then seize and detain the cryptoassets. The first seizure may therefore concern the means of access rather than the crypto itself.

The search power depends on lawful authority to be on the premises and reasonable grounds to suspect that an item likely to assist in seizing cryptoassets is present. The relevant provisions can cover premises, vehicles and people. Prior judicial authority is required unless the applicable statutory urgent route applies.
Examples of items that may be relevant include a paper notebook containing recovery seeds, an electronic hardware wallet, or a phone, tablet, laptop or desktop computer containing relevant information or an application that controls a software wallet. These are examples, not a rule that every device or note can automatically be seized.
2. Obtain information and reconstruct the wallet
Officers may require accessible electronic information to be produced in a visible and legible form when needed to determine whether an item is cryptoasset-related or to enable seizure of cryptoassets. The Home Office circular says this power does not authorise requiring information protected by legal professional privilege. Depending on the officer and the applicable enactment, failure to comply may amount to an obstruction offence.
After obtaining relevant information, an officer may use it to open or reconstruct a wallet on a wallet controlled by law enforcement. The circular distinguishes this reconstruction from the later transfer of the assets: reconstructing access is not itself the seizure of the cryptoassets.
3. Transfer and detain suspected assets
An officer may seize cryptoassets where there are reasonable grounds to suspect that they are proceeds of unlawful conduct or intended for use in such conduct. The seizure can include transferring the assets into a wallet controlled by law enforcement. That is a custody step while the statutory process proceeds, not the final court decision on forfeiture.

How can authorities freeze crypto held by an exchange or custodian?
Where a service provider administers the wallet, an enforcement officer may apply for a crypto wallet freezing order rather than use the unhosted-wallet reconstruction route. The application requires reasonable grounds to suspect that the wallet contains recoverable property or property intended for use in unlawful conduct, and the provider must meet the statutory UK-connection criteria.
The Home Office circular says a provider may qualify through factors such as having a registered or head office in the UK with its day-to-day affairs conducted here, submitting disputes to UK courts under its terms, or holding relevant customer data in the UK. Whether a particular provider meets the test depends on the facts and the statutory conditions; the label “exchange” alone does not establish it.
A freezing order prohibits withdrawals, payments or other use of the wallet unless the court allows an exclusion. Possible exclusions include reasonable living expenses, carrying on a business, trade or occupation, and legal expenses. The court may make an order without notice if giving notice could prejudice later forfeiture steps. While it operates, the provider retains custody of the frozen assets.

How long can crypto or a wallet be held?
The initial detention periods for cryptoasset-related items and seized cryptoassets are generally 48 hours unless detention has been authorised in advance. A judicial authority can extend detention in periods of up to six months. The ordinary maximum is two years from the first order, with a possible extension to three years in the specified situation involving an outstanding overseas evidence request connected with the assets or related items.
A crypto wallet freezing order can also operate for up to two years and may be extended to three years in that specified overseas-evidence situation. These are statutory maximum periods, not automatic holding periods: continued detention must remain justified under the applicable suspicion and procedural requirements.
What happens at a cryptoasset forfeiture hearing?
A judicial authority may order forfeiture of some or all detained or frozen cryptoassets if satisfied that the assets are recoverable property or were intended for use in unlawful conduct. If assets held by a service provider are forfeited, the provider must transfer them into a wallet nominated by an enforcement officer. The new cryptoasset civil-forfeiture powers have no minimum value threshold.

Joint ownership and claims by victims or true owners
Joint or associated property can make the outcome more complicated. If the parties cannot agree on their respective interests, the matter may go to the High Court or, in Scotland, the Court of Session. In appropriate cases, a court may sever or extinguish an interest and order payment to the affected holder, but it must consider whether that outcome is just and equitable.

The statutory scheme also provides for true-owner and victim protections. Someone deprived of cryptoassets through unlawful conduct, such as theft, may apply for release in the circumstances set out in the legislation. Other true-owner applications face additional conditions, including restrictions intended to avoid making the court resolve an ownership dispute unnecessarily.
Can detained crypto be converted into money?
Yes. The scheme allows cryptoassets to be converted into money before the forfeiture application is decided. The court must consider whether the assets are likely to suffer a significant loss in value before release or forfeiture, including during any appeal period. Conversion may be sought by the agency bringing the case or by the cryptoasset holder, as the Home Office circular explains.
After a forfeiture order and once appeal rights are exhausted, enforcement officers must take steps to realise the assets. Destruction is permitted if realisation is not reasonably practicable or would be contrary to the public interest, particularly where circulation of the assets could facilitate further criminal conduct. If forfeiture is not ordered, compensation may be available in exceptional circumstances for loss caused by seizure, detention or a wallet freeze.

The Home Office identifies constables, HMRC officers, SFO officers and qualifying accredited financial investigators as enforcement officers for these powers. NCA officers may use them when designated with the powers of a constable.

How do crypto forfeiture powers interact with a criminal case?
Authorities may consider asset recovery and financial investigation from the outset of an investigation, using criminal and civil powers as appropriate. Non-conviction-based powers may be pursued whether or not a criminal investigation or prosecution exists and regardless of its stage, subject to statutory restrictions. That does not make the civil route interchangeable with criminal confiscation: they have different targets, tests and procedures.
There is also a restriction on seeking civil recovery for property already taken into account when deciding the amount of a confiscation order. The Section 2A guidance therefore stresses assessing asset-recovery routes early rather than treating them as an afterthought to the criminal case.
What do the latest official recovery figures show?
The Home Office reported that £284.5 million of assets were recovered through confiscation, forfeiture and civil recovery orders in the financial year ending 31 March 2025. It reported this as a 15% increase over the previous year and a 31% increase over the financial year ending March 2020. This is an all-asset total, not a cryptoasset-only figure, so it cannot be used to infer how much cryptocurrency UK authorities recovered.
Frequently Asked Questions
How soon must I appeal a crypto forfeiture order?
The Home Office circular says an appeal against a forfeiture decision must be lodged within 30 days of the court’s order. Anyone considering an appeal should obtain advice promptly because the deadline is short and the correct route depends on the decision and jurisdiction.
Is there a minimum amount of crypto before authorities can apply for forfeiture?
There is no minimum value threshold for the cryptoasset-specific civil-forfeiture powers. The lack of a monetary floor does not remove the requirement for the court to apply the statutory test.
If crypto is converted and I win, do I get the interest too?
Where converted proceeds are held pending the outcome, the scheme places them in an interest-bearing account. If an appeal succeeds and the assets are released, accrued interest must also be returned in the circumstances described by the legislation.
