If someone appears to have copied your board game, first preserve the evidence and compare the specific elements—not just the overall feel. In the United States, similar gameplay or a shared game idea is not, by itself, the same as copying copyright-protected expression. The right response depends on what matches, who owns it, and whether the issue concerns artwork or wording, a brand name, a qualifying invention, or an agreement.

This is general U.S.-focused information, not a decision about whether any particular game infringes. A resemblance, access to a prototype, or a similar sales listing does not alone establish copying or liability. Work through the steps below before sending a takedown notice or making a public accusation.

What parts of a board game can copyright protect?

Copyright may protect original expression in a game, such as sufficiently expressive rules text, illustrations, gameboard art, or packaging art. It does not protect the underlying game idea, title, or method of play as such. The U.S. Copyright Office puts the core distinction plainly: “The idea for a game is not protected by copyright.” That does not mean every component is automatically protected; the question is whether the particular material contains qualifying original expression.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That distinction matters when comparing games. A shared mechanic, broad theme, familiar genre convention, or general way of scoring is different from reproducing another creator’s distinctive illustration or substantial expressive wording. A board layout or card design may contain protectable expression, but do not assume every arrangement, rule, card, or component qualifies simply because it appears in a published game. The assessment is about the specific material and the applicable rights, not whether the games seem similar overall.

Copyright can arise when original expression is fixed in a tangible form; registration is not what creates the copyright. But for a U.S. work, registration or refusal is generally required before bringing a federal copyright infringement lawsuit. Registration timing can also affect remedies, so check the dates rather than treating automatic copyright as a substitute for registration.

What should I do first if someone copied my game?

Make a careful comparison and preserve records before accusing anyone. Identify exactly what appears to match, separate potentially protected expression from mechanics or ideas, and check who owns each relevant element.

  1. Collect lawful copies of both versions. Keep the original rulebook, cards, board art, illustrations, logo, packaging, product listing, and the accused equivalents where available. Save screenshots with dates and page locations, and retain physical copies or photographs. Do not alter the files or crop away context that could matter later.
  2. Compare element by element. Put matching wording, artwork, graphics, and branding in one list. Put shared mechanics, themes, genre conventions, and broad ideas in a separate list. This helps avoid treating a common game concept as proof that protected expression was copied. A striking resemblance can warrant closer review, but it still needs a specific analysis.
  3. Preserve your own development history. Keep original files, version histories, dated prototypes, publication or sales records, and correspondence that may show what was created and when. These records may help explain the history of the work, but a timestamp or prototype does not by itself prove priority or infringement.
  4. Write down the access story without overstating it. Record who received a prototype or files, when, and under what circumstances. Access may be relevant context, but access alone does not prove that the other party copied anything.
  5. Pause before making a public accusation. A factual, private inquiry may preserve room for clarification or a negotiated resolution. If ownership, agreements, or the comparison are disputed, get advice before publishing claims that another person or company committed infringement.

Who owns the artwork, rules, and components?

Before demanding that someone stop using material, confirm that you own the rights you intend to assert. The maker is generally the initial owner of visual art, but work-made-for-hire exceptions can apply. Co-designer, employee, commissioned-artist, publisher, and licensing agreements can change who owns or may use particular contributions.

Review the actual paperwork for the specific element at issue. A game creator may own the rules text but not necessarily every commissioned illustration; a publisher may have permission to use art without owning it; or an agreement may allocate rights differently. Do not claim ownership of a collaborator’s artwork merely because it appears in your game. When an agreement is unclear, or several people contributed, an attorney can help identify who can make a claim and what the agreement permits.

Should I register the copyright now?

Check the status and dates of the relevant work promptly. Copyright may exist upon fixation, but registration or refusal is generally needed before a federal infringement suit over a U.S. work, and registration timing can affect certain remedies.

USPTO guidance describes two timing rules that may matter: registration within five years after publication is associated with prima facie evidence of the copyright’s validity and the facts stated in the certificate; registration within three months after first publication or before infringement is relevant to eligibility for statutory damages and attorney fees. These are statutory timing conditions, not promises that a court will award a remedy. Ask counsel how the timing applies to the particular work and sequence of alleged acts.

Be precise about “publication.” The Copyright Office says public display alone does not necessarily amount to publication. A displayed illustration, a game offered for sale, and a work distributed to the public may have different factual histories. Keep records of when and how the material was made available, rather than assuming that the first public appearance answers every timing question.

Can I send a DMCA takedown for a copied board game?

A DMCA notice can address allegedly infringing copyrighted material hosted by an online service; it is not a general tool for claiming ownership of a game idea or stopping similar mechanics. Registration is not required to send a notice, but the notice must be supported and accurate.

Before sending one, identify the specific copyrighted work and the specific material on the service that you believe infringes it. The notice requires identification of the work and the allegedly infringing material, your contact information, a signature, a good-faith statement, and a statement that the information is accurate and that you are authorized to act. Use the applicable service provider’s notice process and describe only material you can truthfully identify as infringing.

A notice about a copied illustration or substantial expressive text is different from a notice asserting that someone used the same style of play. Similar mechanics alone do not justify a copyright takedown. If commissioned art or licensed material is involved, confirm your authority before claiming it. A materially false assertion can carry risk.

The person whose material was removed may submit a counter-notice. The Copyright Office describes a 10–14-business-day restoration window unless the sender reports that a court action has been filed. A takedown can therefore lead to a dispute rather than a final determination of ownership or infringement. Consider whether a notice is an appropriate, proportionate response before using it.

When is a trademark, patent, or contract issue more relevant?

Different kinds of similarities call for different legal questions. A name or logo that could confuse buyers about who made or sponsors a game is a trademark issue, not automatically a copyright issue. Compare the marks, who used them first, the related goods, and evidence of likely consumer confusion; the USPTO describes the assessment as case-specific.

Patents concern qualifying inventions or designs, not mere ideas. If the dispute centers on a claimed inventive mechanism or a distinctive manufactured design, do not assume copyright rules resolve it. Patent questions have their own requirements and should be assessed with case-specific advice.

Contracts can matter too. A confidentiality promise, publisher deal, license, co-designer agreement, or commissioned-work agreement may shape what a party was allowed to disclose, use, or reproduce. Preserve the relevant documents and avoid treating a copyright analysis as a substitute for reviewing those promises and permissions.

Should I contact the other party, send a notice, or take legal action?

Choose a response based on the material at issue, the evidence, and what outcome you want. A direct contact may open a discussion, but it does not compel removal; a DMCA notice targets allegedly infringing copyright material hosted online; and a lawsuit or other formal claim involves different requirements and consequences.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Consider measured direct contact when you need clarification or want to explore a license or other resolution. Keep the message factual: identify the work and the specific concern, and avoid declaring that liability is already proven.
  • Consider a copyright notice when specific protected artwork or expressive text appears on an online service, you have authority to act, and you can make the required statements truthfully. It is not a remedy for similar play mechanics alone.
  • Consider a trademark inquiry when the concern is a similar name or logo and possible confusion about the source of the games. Priority and consumer confusion matter; resemblance alone does not settle the question.
  • Get legal advice before escalating when ownership is disputed, agreements are involved, a patent issue may exist, the alleged copying is substantial, or you need an order stopping ongoing conduct. An attorney can help evaluate claims, remedies, and the appropriate forum.

Is the Copyright Claims Board an option?

The Copyright Claims Board (CCB) is an optional forum for eligible copyright claims, but it is not the same as federal court and cannot issue an injunction. A respondent may opt out, so a claimant cannot assume the dispute will be decided there.

The CCB accepts eligible claims when the work is registered or at least a registration application has been submitted, subject to its rules. It primarily awards money; its total-damages ceiling for a claim is $30,000. If your main goal is an order stopping ongoing conduct, the CCB cannot provide that remedy. Federal litigation has its own registration requirements, and whether it is appropriate depends on the facts, likely remedies, cost, and other considerations. Do not assume either forum will find infringement.

How can I document future game iterations?

Keep organized copies of drafts, art files, rules revisions, dated correspondence, and physical prototypes as the game develops. For a physical design process, a blank board game prototype kit can be one practical way to make iterations and retain them as part of your records. A kit does not create intellectual-property rights, prove when a design was created, or resolve a later infringement dispute; it is simply a way to keep physical versions alongside the rest of your development history.

The most useful record is one you can explain: what the version contains, who contributed, and when it was made or shared. Keep ownership and permission documents with the relevant materials, especially when collaborators, publishers, or commissioned artists are involved. If the game is moving toward publication or a dispute is already underway, ask an intellectual-property attorney what records and rights matter for your circumstances.

What is the safest way to think about a suspected copy?

Start with the narrowest accurate claim. If the overlap is only a broad idea or method of play, copyright may not be the right theory. If original text or art appears to have been reproduced, document the specific work, establish ownership, check registration and publication dates, and choose a proportionate response. If the concern is branding, a patentable feature, or a promise in an agreement, assess that separately. The available information here cannot determine whether any unnamed game or company is liable.

Frequently Asked Questions

Can I make a board game inspired by another game’s mechanics?

A game can share an unprotected idea or method of play without that alone establishing copyright infringement. Avoid copying expressive rules wording or artwork, and assess branding, patent, and contract concerns separately if those are part of the situation.

Can I post online that another creator stole my game?

A resemblance or evidence that someone saw your prototype does not by itself prove copying or infringement. Before naming a person or company publicly, keep the comparison factual and consider legal advice, especially if ownership or the underlying agreements are disputed.

Does a similar board game title mean the other game infringes my copyright?

A title or logo raises a distinct trademark question about priority and likely consumer confusion; it is not automatically a copyright claim. The answer depends on the specific marks and marketplace context, so a similar name alone does not decide the dispute.
