The U.S. Nuclear Regulatory Commission (NRC) issued a construction permit for Kemmerer Power Station Unit 1 in Wyoming to US SFR Owner, LLC, a wholly owned TerraPower subsidiary. The project is TerraPower’s sodium-cooled reactor—not a NuScale design. The permit authorizes construction, not operation.
Which reactor did regulators clear for construction?
The NRC issued construction permit CPAR-1 for Kemmerer Power Station Unit 1 on March 9, 2026, after the Commission authorized issuance through Order CLI-26-5. The permit holder is US SFR Owner, LLC, a wholly owned subsidiary of TerraPower, LLC. The NRC identifies Kemmerer as a sodium-cooled advanced reactor project. NRC project information
The NRC characterized the decision as the first commercial reactor construction approval in nearly a decade and the first approval for a non-light-water reactor in more than 40 years. Those are the agency’s historical comparisons. It also said staff completed the design’s technical review in less than 18 months. NRC, March 2026
What does a construction permit allow?
Under the NRC’s Part 50 licensing pathway, a construction permit authorizes the applicant to build the facility; it does not authorize the facility to operate. The applicant must obtain a separate operating license before it can begin operation. So “cleared for construction” describes a licensing milestone, not a completed power station or a plant already producing electricity. NRC: Part 50 licensing process

How is this different from NuScale’s approval?
NuScale’s NRC action concerned a design, not a construction permit for a specific power station. On May 29, 2025, the NRC issued NuScale Power’s US460 Standard Design Approval. A standard design approval allows an approved design to be referenced in applications; it does not, by itself, authorize construction or operation of a particular plant. NuScale would still need to apply for permission to build and operate a facility using that design. NRC: NuScale licensing activities
| Regulatory action | Project or design | Reactor description | What the action permits |
|---|---|---|---|
| Construction permit CPAR-1, issued March 9, 2026 | Kemmerer Power Station Unit 1, Wyoming; permit holder US SFR Owner, LLC, a TerraPower subsidiary | NRC describes the project as sodium-cooled | Construction of the facility; operation requires a later operating license |
| Standard Design Approval, issued May 29, 2025 | NuScale Power US460 design | NRC describes it as a light-water small modular reactor (SMR) | Allows the design to be referenced in applications; does not itself authorize a specific facility to be built or operated |
The NRC describes NuScale US460 as a 77-megawatt-per-module design, with six modules totaling approximately 460 megawatts. These figures describe NuScale’s design, not the Kemmerer permit. The available NRC descriptions do not establish that the agency classifies TerraPower’s Kemmerer design under the same “SMR” label, so the two projects should not be treated as a like-for-like technical comparison. What the NRC said about the decision
In the agency’s March 4, 2026 news release, NRC Chairman Ho Nieh called the action “a historic step forward for advanced nuclear energy in the United States” and said it reflected a commitment to “timely, predictable decisions grounded in a rigorous and independent safety review.” That is the regulator’s characterization of its decision, not an assessment of the project’s economics or operating performance.
