Before you send a mortgage lender tax returns, bank statements, or other sensitive documents, ask where automated systems are used, what information they rely on, who receives it, and how you can correct errors. Practices vary by lender; there is no single AI process, data-retention period, or review route that applies to every mortgage application.
Where do you use AI or automated systems in my mortgage application?
Ask the lender to walk through each stage rather than answering only whether it “uses AI.” Automated tools may be involved in document intake and data extraction, fraud screening, credit assessment, underwriting, property valuation, or loan servicing. The lender may use different systems for different tasks, and automation does not necessarily mean an AI system makes the final decision.
- Which tools are used at each stage of my application?
- Do they produce recommendations, or can an output determine an outcome?
- When does a person review an exception, a disputed result, or information that does not fit the system’s expectations?
- Can I request human review, and how do I do that?
Do not assume that every lender uses AI—or that every tool described as automated is covered by a particular regulatory definition. For example, Regulation C defines a specific category of automated underwriting system; that category is not a complete inventory of every proprietary or automated tool a lender might use. The CFPB’s guidance on adverse-action notices for decisions based on complex algorithms addresses credit decisions, not a universal list of mortgage technologies.
What information goes into those systems, and where does it come from?
Ask what information the lender collects or obtains, where it comes from, and how it affects your application. Relevant sources can include your application and uploaded documents, credit-report information, property or valuation data, connected financial accounts, and third-party sources.

- Which categories of information materially affect my application?
- Do you obtain information from third parties beyond the documents and accounts I provide?
- How can I see and correct information that is inaccurate or out of date?
- If a vendor supplies data or an analysis, can you identify the source and explain its role?
The CFPB has described concerns that some algorithmic credit processes may use large datasets, potentially including information harvested through consumer surveillance. That is a documented concern about possible data practices, not evidence that a particular mortgage lender uses surveillance-derived information. Ask the lender about its own sources and purposes; the Bureau’s September 19, 2023 guidance on credit denials involving artificial intelligence discusses the broader issue.
Who receives or can use my information?
Request the lender’s privacy notice and ask how it applies to your application. Find out whether information may be shared with affiliates, investors, service providers, or other parties, and what purpose each type of sharing serves.

- Which parties may receive my application information or information derived from it?
- What does each recipient use it for?
- Do any privacy choices or opt-outs apply to those disclosures, and how do I use them?
- Does the privacy notice distinguish information shared for servicing or legal obligations from other uses?
The Gramm-Leach-Bliley Act (GLBA) and Regulation P are part of the CFPB’s mortgage compliance resources. The Bureau provides GLBA privacy-notice resources and model forms, but those resources do not establish what a particular lender shares. Read that lender’s notice and ask it to explain any language you do not understand.
How long is my application and derived data retained?
Ask for the lender’s actual retention policy. The official resources cited here do not establish one universal retention period for mortgage application data, and a lender’s answer may depend on the kind of information, the stage of the application, and legal or operational requirements.

- How long do you keep submitted documents and copies of them?
- How long are extracted, inferred, or otherwise derived data retained?
- What happens to my information if I withdraw, or after the loan closes?
- Do vendors keep copies, and what deletion or retention terms apply to them?
- Who can access the data, and what security controls govern lender and vendor access?
CFPB mortgage resources and its GLBA privacy-notice materials provide compliance context, not a lender-specific retention schedule. Ask for the policy rather than relying on a general number.
Can you explain a denial or other unfavorable credit action?
Yes. When a creditor takes adverse action, the obligation to provide specific principal reasons applies regardless of whether the decision involved a complex algorithm or AI. A model’s complexity is not an exception to the explanation requirement under the Equal Credit Opportunity Act and Regulation B.

Ask: “If you deny my application or take another adverse action, will you identify the specific principal reasons for that decision?” An explanation should identify the actual reasons, not merely say that a system or model produced the result. Credit-score factors alone do not necessarily substitute for the specific reasons required in an adverse-action notice.
In the CFPB’s September 19, 2023 release, Bureau Director Rohit Chopra said: “Creditors must be able to specifically explain their reasons for denial. There is no special exemption for artificial intelligence.” The Bureau’s Circular 2022-03 explains that these adverse-action requirements are technology-neutral.

What can I do if my credit application was denied because of my credit report?
If a credit report contributed to the decision, ask which credit-reporting company supplied it, which credit score was used, and how to obtain the report. The adverse-action notice should provide relevant reporting-company and score information. CFPB consumer guidance says you can request a free report from the reporting company within 60 days of the adverse-action notice.
- Read the adverse-action notice and identify the reporting company it names.
- Request your report from that company within 60 days of the notice.
- Check the report for inaccurate or outdated information and dispute errors with the reporting company.
- Ask the lender whether it offers an additional process for reconsideration or human review of your application.
The lender’s reconsideration or human-review process can vary; general consumer guidance does not establish one process for every lender. The CFPB explains report access and dispute steps in “What can I do if my credit application was denied because of my credit report?”
How should I compare lenders’ answers?
If you are speaking with more than one lender, use the same questions with each so you can compare their policies rather than relying on vague assurances.

These questions help you understand each lender’s process; the cited consumer-protection sources do not rank lenders or establish that one lender’s practices are better than another’s.
