OpenAI says the EU AI Act is one reason it is adding invisible text watermarks to eligible ChatGPT and Codex output for users in the European Union. That is evidence that regulation prompted a concrete company response—not proof that the watermark reliably identifies AI writing or that the law has achieved its wider goals. The Act requires machine-readable marking and detectability where technically feasible; it does not mandate OpenAI’s particular method, textGrain.
What OpenAI announced—and what is available
On October 5, 2026, OpenAI announced a phased rollout of invisible watermarks for eligible ChatGPT and Codex text output in the EU, describing deployment as taking place over the coming weeks. Its Help Center now says EU ChatGPT-generated text carries textGrain, but does not specify when the change reached each account. The announcement and Help Center therefore do not establish that every eligible user was already receiving watermarked output on October 7, 2026.
The API route is different: OpenAI said customers worldwide could opt in to text watermarking for select models, with the feature off by default. Detector access is also limited. OpenAI opened applications for approved researchers and expert organizations, with requests initially reviewed case by case; it did not release the detector publicly at launch, citing the risk that false positives and missed marks could mislead people.
What the EU AI Act requires
Article 50(2) of the EU AI Act sets a technology-neutral obligation for providers of AI systems that generate synthetic audio, images, video or text: they must ensure outputs are marked in a machine-readable format and detectable as artificially generated or manipulated. The law says technical solutions must be effective, interoperable, robust and reliable as far as technically feasible, taking account of the content type’s limitations, implementation costs and the state of the art. It does not name textGrain or require that specific watermarking technique.

The Commission says the Act’s transparency obligations applied from August 2, 2026. Its Code of Practice on Transparency of AI-generated Content is voluntary; Article 50’s legal requirements are not. The Code describes a practical compliance route, but it does not turn one particular technical approach into a statutory mandate.
Provider marking and publisher disclosure are separate duties
Article 50 also addresses deployers, meaning organizations or people using AI systems. A deployer that publishes AI-generated or manipulated text to inform the public about a matter of public interest must disclose that it was artificially generated or manipulated. The disclosure rule does not apply when the text has undergone human review or editorial control and a person or organization holds editorial responsibility for publication. This is distinct from the provider’s machine-readable marking obligation: one concerns a technical signal in generated output, the other a disclosure to readers in specified circumstances.

How textGrain puts a signal into text
OpenAI describes textGrain as an invisible statistical signal embedded in a model’s word choices. It subtly changes how the model randomly selects among possible words or word pieces, leaving a pattern that a detector can test across a passage. The signal is in the wording itself—not hidden characters, invisible spaces or unusual punctuation.
In a technical report dated October 5, 2026, OpenAI and academic coauthors describe coupling token generation to keyed randomness through an optimal-transport problem, with costs based on Gumbel random variables and KL regularization. The method groups vocabulary tokens into blocks and uses an entropy budget to control the average sampling randomness removed. A detector uses the text and a secret key to test for statistical dependence. This describes the proposed method and its assumptions; it is not, by itself, independent evidence of how well the deployed system performs.

What OpenAI’s published evaluations show
The figures below are evaluations reported by OpenAI in its October 5, 2026 announcement, not independent replications. Detection performance varies with passage length, subject matter and editing.

The reported 1% figure is the detector’s target false-positive rate in those tests, not a claim that every real-world result has a 1% chance of being wrong. OpenAI also reported no meaningful performance differences with and without watermarking for its Astra model on seven named benchmarks. For three examples, its reported scores were: Artificial Analysis Intelligence Index, 49.57 unwatermarked versus 49.76 watermarked; AutomationBench, 34.09% versus 34.86%; and DeepSWE v1.1, 72.80% versus 71.68%. These are company-selected results, not independent validation.

What a detector result can—and cannot—establish
OpenAI says a positive result may indicate that an OpenAI system generated or processed some of a passage. It does not establish the user’s identity, how much a person contributed, who owns the text, who is responsible for publishing it, whether it is accurate, or whether its use was lawful or required disclosure.
A negative result is not proof of human authorship. A passage may be too short, edited, translated, generated by an unsupported model, produced before watermarking was enabled, or generated by another provider. OpenAI characterizes watermarking and detection as early technologies with significant limitations. No independent regulator or peer-reviewed evaluation of textGrain’s deployed performance is identified in the sources cited here.

- Longer, flexible passages: OpenAI’s reported tests found higher detection rates for longer psychology-like samples than for shorter ones.
- Constrained text: Detection was substantially lower for mathematics, where word choice offers less flexibility.
- Edited text: In OpenAI’s synonym-replacement tests, editing reduced detection, with a larger replacement share producing a larger drop.
Does this prove that regulation works?
In a narrow, observable sense, the evidence supports the headline’s claim: OpenAI explicitly framed its October 5 announcement as a response to the EU AI Act, whose transparency obligations had already applied since August 2. Regulation preceded the announcement, and the company says the requirement influenced its approach. That is a concrete example of regulation prompting or accelerating a product change.
It does not establish that Article 50 requires textGrain specifically, that the method will identify all AI-generated text, or that watermarking alone will reduce deception or meet the Act’s broader policy aims. OpenAI says it will revisit its approach as technology, evidence, standards and requirements evolve. The defensible conclusion is that the law has prompted a stated implementation response; the effectiveness and wider impact remain separate questions.
