Open-weight models can be more private when you run them on infrastructure you control, but “open” does not guarantee privacy, safety, or transparency. It means you can access trained weights; it does not necessarily mean you can inspect the training data or every part of the system. Closed models keep weights under their provider’s control and are commonly accessed through a hosted service, so their privacy depends on that service’s specific data practices.

The practical choice is less “which type is safer?” than “who will operate the model and its safeguards, and where will prompts and outputs go?”

What do open-weight and closed AI models mean?

An open-weight model makes its trained parameters available for download or use under specified terms. That can let an organization run or adapt the model itself, but it does not by itself provide the training data, full source code, system instructions, or all the components needed to reproduce the service that produced it.

The European Data Protection Board (EDPB) distinguishes between models that are fully available and models that are only partly available. In its framing, full availability can include weights, code, training data, and documentation; partial releases commonly omit some components, often training data, or make them subject to licenses. The EDPB warns that partial access can limit scrutiny of privacy vulnerabilities. In everyday industry usage, “open-weight” is narrower than “fully open.” See the EDPB’s April 2025 guidance on privacy risks and mitigations in large language models.

By contrast, closed models generally do not make weights or source code publicly available; people interact with them through an API or subscription. That describes access to the model, not a complete privacy policy: the provider’s service terms and technical controls still matter.

Are open-weight AI models more private?

Sometimes—but only when the deployment actually keeps data within infrastructure and services the organization controls. Self-hosting can let an organization decide where inference runs and how prompts are logged, accessed, backed up, or monitored. It does not automatically prevent data from leaving that environment. Logs, network connections, observability tools, backups, and external services can all affect the data path.

OpenAI’s documentation for its specific gpt-oss models says that they can run on infrastructure the user controls, or through a hosting provider, and are not served through ChatGPT or the OpenAI API. OpenAI says it does not receive or process data sent to a self-hosted gpt-oss deployment unless the user shares it with OpenAI or uses a managed hosting partner. A hosting partner therefore remains part of the data path; its own controls and terms need review. These statements apply to gpt-oss, not to every open-weight model or host. For a closed model accessed through an API, check the documentation and contract for that particular service. Relevant details include retention, whether data is used for training, regional processing, and who can access data. OpenAI’s API data-controls guide is one service-specific example; it is not evidence of how other providers handle API data. Do not infer API practices from a model’s closed-weight label.

What control do you gain—and what work do you take on?

Running a model yourself can shift decisions about deployment, customization, and access controls from a provider to your organization. That also shifts responsibility: your team must operate the runtime, secure it, monitor it, and decide how to handle updates and incidents. “Control” is not the same as guaranteed support, full transparency, or control over copies of weights that others can use.

Customization Weights may enable adaptation or fine-tuning, subject to the model’s license and technical requirements. The OECD says fine-tuning generally requires more expertise than using a ready-to-use proprietary service. (OECD report on AI openness) Customization options depend on the service and are not established by the closed-weight label alone. Check the specific provider’s documentation.
Operations and support Your team or host must manage deployment and safeguards. OpenAI describes gpt-oss deployments as self-serviced and says it does not provide hands-on implementation or debugging support for self-hosted or third-party-hosted configurations. (OpenAI gpt-oss documentation) The provider manages the service, but support and service commitments depend on the product and contract. They are not established by the model label.
Ongoing safeguards The deployer decides what controls to add and maintain. OpenAI’s gpt-oss model card says additional safeguards may be needed to replicate system-level protections in its API and products. (OpenAI gpt-oss model card) The provider retains control over its service and its built-in safeguards. The model label alone does not establish how those safeguards work or what protections apply to a particular use.

OpenAI describes gpt-oss-120b and gpt-oss-20b as open-weight models under Apache 2.0 licensing, subject to its usage policy. The weights are free to download, but compute, storage, and hosting can cost money. Those terms are specific to this model family, not a general rule for open-weight software. OpenAI’s documentation also describes gpt-oss-safeguard-120b as designed to fit on a single 80 GB GPU; that is a specification for that named variant, not a general hardware requirement for running open-weight AI. What changes when model weights are public?

Public weights can be copied, modified, and deployed by people beyond the original developer. The OECD notes that once weights are public, the developer loses control over later use and alteration, making it harder to track or prevent misuse. The EDPB notes that modifications can introduce security vulnerabilities or remove built-in safety measures. These are risks to assess, not proof that every open-weight model is unsafe or that closed models are safe.

Releasing weights also changes who can enforce safeguards after release. A provider may set rules for its own hosted service, but it cannot necessarily apply those same controls to independent downstream copies. For gpt-oss, OpenAI’s model card says developers and enterprises may need additional safeguards to replicate protections built into its API and products. Closed weights keep the model under the provider’s control, but that is not a blanket safety or privacy guarantee. OpenAI says it deploys its most capable models as services and does not distribute their weights outside OpenAI and Microsoft; it says third-party access to those models is provided via API. That is a statement about OpenAI’s approach, not a rule for all closed-model providers. See OpenAI’s approach to frontier risk.

Does either model type settle copyright or privacy concerns?

No. Access to weights does not necessarily reveal what data was used to train a model, and partial access may prevent full scrutiny of training-data and privacy risks. The OECD reports that research has demonstrated varying degrees of memorization and extraction of copyrighted material in large language models. That does not establish the behavior of every model or resolve the legal status of a particular output; evaluate the named model and your intended use rather than treating its access type as proof of legal or privacy compliance. How should an organization choose?

Start with the data and operational requirements, then assess a specific model, license, and hosting arrangement. A label such as “open-weight” or “closed” cannot answer these questions on its own.

  1. Map the data path. Identify where prompts, outputs, logs, and backups are processed or stored, and which third-party services receive them.
  2. Decide who will operate the stack. If your team wants direct control, confirm that it can secure, monitor, and maintain the infrastructure. If you use a host or managed service, review that operator’s data controls and terms.
  3. Check customization and license terms. Confirm whether adaptation or fine-tuning is available for the chosen model and whether its license permits your intended deployment and use.
  4. Budget for operational expertise and support. Self-managed deployments can require infrastructure and model expertise; confirm what support is available from the model developer, host, or service provider.
  5. Plan safeguards and oversight. Define access controls, testing, monitoring, incident handling, and who can enforce safeguards in the deployed system. Consider what protections may be absent or need to be recreated.
  6. Review model-specific evidence. Look for documentation about training data, known limitations, privacy, and safety. Do not assume weights alone provide enough information to assess these issues.

Choose a self-managed open-weight deployment when the organization has a concrete need for control over where inference runs or how a model is adapted—and the capacity to operate the deployment responsibly. Choose a closed service when provider-managed operation better fits the organization’s needs, after confirming that the service’s data controls and terms meet its requirements.
