H.R. 10364, the American Copyright Protection Act of 2026, expressly includes virtual private networks among the service providers a court could order to block access to certain foreign piracy sites. It is an introduced bill, not current law: the official record says it was referred to the House Committee on the Judiciary after its introduction on September 14, 2026.
What the bill proposes
The American Copyright Protection Act of 2026 would create a process under federal copyright law for identifying a foreign online location as a “foreign piracy site.” Under the introduced text, a copyright owner could first bring an action in federal district court seeking a declaration that a location meets that definition. After that declaration, the owner could petition for a blocking order naming service providers.
An order would require each named provider to take “all commercially reasonable steps” to prevent users or subscribers from using its systems or networks to access the site “from the United States.” Those are the bill’s proposed requirements, not obligations currently in force. Read the introduced bill text at the U.S. Government Publishing Office.
Which providers could be covered?
The bill defines “service provider” to include broadband internet access providers, domain-name resolution providers and virtual private networks. It excludes root nameserver operators and top-level domain registries. It also excludes entities providing services to fewer than 100,000 monthly users or subscribers in the United States; that figure is a statutory coverage threshold, not a measurement of the VPN market.

So the proposal is not a general ban on VPN use or a requirement that every VPN block every site. It would allow a court process to require named, covered providers to take reasonable steps against access to a site declared to be a foreign piracy site.
How VPN blocking could work—and what the text leaves open
VPNs can route a user’s traffic through servers in different countries, which makes “from the United States” a meaningful implementation question. The bill states the outcome an order must pursue but does not tell VPN providers to block based on a user’s location, a U.S. exit server, or any other particular technical method. Reporting has discussed such possibilities as interpretations, not instructions contained in the bill. The text therefore leaves the precise VPN implementation unsettled.

The bill also says an order may not prescribe a specific technical method. Before including a provider, a court would consider factors such as the burden on that provider, technical feasibility and efficacy, likely harm to the copyright owner, incidental harm to other online services or users, and the public benefit or harm. These provisions give courts factors to weigh; they do not guarantee that incidental disruption would be eliminated.
Why the proposal is controversial
Supporters of site blocking argue that intermediaries can help prevent access to sites distributing copyrighted material without authorization. Opponents quoted in coverage warn that blocking measures can disrupt access to legitimate services as well as targeted sites. Such concerns are arguments about potential consequences, not established outcomes of this unpassed U.S. bill. TorrentFreak’s coverage and Ars Technica’s report discuss the proposal and the questions its VPN provisions raise.

No. As of October 3, 2026, H.R. 10364 is an introduced proposal referred to the House Committee on the Judiciary, not enacted legislation. Its requirements do not presently create a new blocking duty for VPN providers. Legislative status can change, so consult the official bill record and text for the latest information.
