A foreign contractor may also face CIC approval and local-partnership conditions; confirm the current requirements with CIC and the procuring authority before award.
Start with legal eligibility and a current CIC certificate
Check each bidder in the CIC contractor register and request its current registration certificate. CIC says public-sector clients must consult the register and demand the certificate when considering construction tenders. Its FAQ says registration makes a contractor eligible to participate legally in tendering and be awarded construction work.
CIC’s website advertises a 2026/27 annual registration and renewal period. That does not establish that a particular bidder’s certificate is valid: verify the certificate and status at the time of procurement, and ask CIC or the tendering authority about any uncertainty.
Match category and grade to the work and contract value
Confirm that the bidder’s registered category covers the actual discipline in the package, then check that its grade fits the tender value. CIC says grading considers financial capability, works capability, and available capital. A contractor registered for one kind of work should not be assumed qualified for a different discipline.

CIC’s 2024/25 industry report gives report-era examples: Grade B1 for building works corresponded to a tender value above E25 million, while Grade C3 for civil works corresponded to a tender value above E30 million. Treat these as historical thresholds, not a substitute for checking current CIC grading rules for the relevant work category and procurement.
Apply the foreign-contractor conditions carefully
CIC’s FAQ says a foreign contractor may be engaged only when the desired skill is unavailable locally. It says the owner must seek CIC approval and engage the foreign contractor in partnership with a local contractor for skills transfer. This is the Council’s published summary; the available information does not establish every current legal detail, form, threshold, exception, or deadline.

Before a live procurement or award, confirm the operative requirements with CIC and the procuring authority. Ask what evidence is needed to demonstrate that the skill is unavailable locally, how approval must be obtained, what local-partner arrangement is acceptable, and how skills transfer should be documented. Do not rely on draft provisions or assume that a general statement resolves a tender’s specific rules.
Compare evidence of capability, not nationality
Registration establishes eligibility and a category or grade; it does not prove that a bidder can deliver your particular project. Request evidence that is relevant to the scope and assess it consistently for local and foreign bidders.

- Comparable completed work: Ask for projects of similar type, scale, and technical complexity, along with client references and performance documentation.
- Named team: Identify the proposed project lead and key technical personnel, their roles, availability, and relevant experience.
- Capacity and programme: Review staff availability, equipment and supply plans where relevant, the proposed schedule, and the bidder’s ability to manage the work alongside existing commitments.
- Financial and delivery arrangements: Test whether the bidder’s resources and cash-flow plan are credible for the contract. CIC’s grading framework includes financial capability, works capability, and available capital; project-level due diligence should examine the needs of this contract.
- Quality and safety: Review the proposed quality controls, site safety arrangements, and how the bidder will manage defects or changes.
CIC describes project registration as collecting information about project nature, value, and distribution while updating contractor track records. Its registration page says it registers public projects above E1 and private projects above E1 million. Confirm whether registration applies to your project and whether the thresholds or procedure have changed.
Make the commercial comparison genuinely like for like
A headline price is useful only when bidders are pricing the same obligations. Compare the offer’s scope assumptions, exclusions, taxes, logistics, maintenance or lifecycle responsibilities, and allocation of project risks. Check whether the proposed schedule and resources are consistent with the price, and whether local-partner or skills-transfer obligations affect the delivery plan.

The official materials cited here do not provide a universal evaluation formula or official CIC scoring rubric. If two bidders are otherwise eligible, use a documented project-specific comparison that considers:
- Registration, certificate validity, category, and grade fit.
- Comparable project evidence and references.
- The named delivery team, available capacity, and proposed programme.
- Total price against aligned scope assumptions and obligations.
- Any applicable local participation and skills-transfer arrangements.
- Risk allocation and the bidder’s ability to manage the project’s particular risks.
This is a recommended owner-side framework, not an official CIC scoring method. Set the evaluation criteria before reviewing bids and apply them consistently.

What CIC’s registration figures do—and do not—show
The CIC report Kingdom of Eswatini: Construction Industry Performance 2024/25 describes registrations as of March 2025. It reports foreign contractors at 0.5% of contractor registrations, with 82% of foreign registrations in the Mechanical Foreign category. The report describes foreign activity as concentrated in specialized and technically demanding work, and says local contractors are increasingly capable in general building and civil works while reliance on foreign expertise continues in some technical areas.
The same report records approximately 1,698 contractor registrations, including 431 general building registrations and 294 general civil registrations. These are registrations, not a unique-firm count: a contractor may be registered in multiple categories. The figures describe the database through March 2025, not current 2026 totals, and do not measure any individual bidder’s quality, performance, price competitiveness, or suitability for a particular project.

- Do references and project records demonstrate experience comparable to the actual scope?
- Are the proposed personnel, schedule, financial resources, and other capacity credible and available?
- Do the bids cover the same scope, taxes, logistics, maintenance duties, and risk allocation?
- If a foreign contractor is proposed, has CIC confirmed the applicable approval process and local-partner and skills-transfer requirements for this procurement?
