There is no single U.S. rule that makes every form of “social gambling” legal or illegal. The answer depends on where you play, how the game is run, whether anyone takes a cut, and whether players can win money or something of value. A friendly game at home, a no-prize social casino app, and an online casino-style game with cash or cash-equivalent prizes can raise very different legal questions.

What counts as social gambling?

“Social gambling” is not a universal legal category. People use the phrase for everything from a private card game to an app marketed as a social casino. The product’s label does not decide its legal status: the rules of the state or locality where the activity takes place, along with the game’s actual payment and prize mechanics, matter.

For an online game, look beyond the name and ask whether players pay to participate, buy or exchange virtual currency, and have a chance to receive cash or a cash-equivalent or material prize. A game that offers no real-world prize raises a different question from one that does, but that difference alone is not a nationwide legal safe harbor.

Why federal law does not give every small game a green light

Federal law defines an “illegal gambling business” partly by whether the business violates the law of the state or political subdivision where it operates. Under 18 U.S.C. § 1955, the federal offense also has business-size and duration or revenue elements: five or more people must be involved in conducting, financing, managing, supervising, directing, or owning the business, and it must operate substantially continuously for more than 30 days or have gross revenue of $2,000 or more in a single day. The statute’s thresholds are elements of that federal offense, not permission to violate state law below those levels. See the current text of 18 U.S.C. § 1955.

How state rules differ: official examples

These examples show why a nationwide yes-or-no answer would be misleading. They are limited to the jurisdictions and conditions described by the cited authorities; they are not a survey of all 50 states.

Jurisdiction What the cited authority says Practical significance
Oregon Oregon defines a “social game” to include a non-lottery game between players in a private home when there is no house player, house bank, house odds, or house income. The statute also addresses certain other venues under conditions set out in Oregon law. Oregon Revised Statutes, Chapter 167. The private-home definition is tied to Oregon law and its stated conditions; it is not a nationwide exemption.
Montana The Montana Department of Justice says bridge, cribbage, hearts, pinochle, pitch, rummy, solo, and whist played in a public setting solely for prizes of minimal value are social card games, not gambling activities subject to regulation. Its FAQ says poker and panguingue are not social card games, and separately states that no other form of internet gambling is legal in Montana. Montana Gambling Control Division FAQ. The game, prize, and setting matter under this specific Montana guidance; the named treatment does not extend to poker.
Louisiana The Louisiana Attorney General warns that online casino games for real money remain illegal in the state and that some sites described as “sweepstakes” or “social casino” may involve payouts, dual-currency systems, or material prizes. The Attorney General stated: “I want to make it unequivocally clear that online casino, bingo, keno, iGaming, and alleged sweepstakes or social gaming sites offering such games are operating illegally in Louisiana.” Louisiana Attorney General public alert. This is the Louisiana Attorney General’s stated enforcement position; it should not be treated as a rule for every state.
New York New York Racing, Pari-Mutuel Wagering and Breeding Law § 912 defines an “online sweepstakes game” to include an internet or mobile game that uses dual currency exchangeable for cash or cash equivalents, or offers a chance to win them, while simulating casino-style games. The law prohibits operating, conducting, or promoting such games in New York. The Senate page shows a revision date of December 12, 2025. New York State Senate, § 912. Read the current statute and its definitions; the label “sweepstakes” does not override the law’s treatment of the game’s mechanics.
Washington The Washington State Gambling Commission describes some online products marketed as sweepstakes alternatives to authorized raffles as gambling activity and advises consumers to check Washington law and the law in the relevant jurisdiction. Washington Gambling Commission Sweepstakes FAQ. The Commission’s guidance calls for checking the applicable jurisdictions rather than relying on a product’s marketing.
New Jersey A 2025 Governor’s Task Force on Responsible Gaming report describes sweepstakes casinos as casino-style games using free or purchased virtual currency with potential cash or prizes. 2025 Task Force report. The report provides dated context about the model, not a substitute for current New Jersey statutory text.

  1. Pin down where the play occurs. Identify the state and, where relevant, the locality where participants are physically playing. For a remote game, do not assume the operator’s location or a nationwide-sounding name determines which rules apply.
  2. Check who runs the game and who benefits. Is it private play among participants, or does a host, house, venue, or online operator receive income? Is there a house bank, house odds, or a fee? Oregon’s definition illustrates why those details can matter.
  3. Trace the money and prizes. Record any entry payment, purchase of virtual currency, conversion or exchange feature, and the prize a player can receive. Distinguish play currency with no real-world value from cash, gift cards, cash equivalents, or other material prizes.
  4. Look for a rule covering that game and venue. Check the current statute and the state gaming regulator’s official guidance. Confirm that any exception applies to the exact game, prize, setting, and arrangement rather than borrowing an example from another state.
  5. Get jurisdiction-specific advice if the facts are unclear. For a recurring game, paid event, or online product with a prize, consult a lawyer licensed in the relevant jurisdiction.

What to verify before trusting a “social” or “sweepstakes” label

Marketing language can obscure the features that matter. Read the game’s terms and payment flow, not just its app-store description or home page. In particular, check whether a free currency and a purchased currency operate together, whether either can be exchanged for a prize, and whether the game simulates casino-style play. The New York statute expressly addresses a dual-currency model, while Louisiana’s Attorney General has warned about products presented as social casinos or sweepstakes that offer payouts or material prizes.

Rules and regulator positions can change, especially for online prize models. The New York Senate page cited above shows a December 12, 2025 revision date; check for later amendments and current official guidance before relying on it.
