Not automatically. In Indiana, calling a betting product a “social sportsbook” does not make it lawful. Whether a particular product is legal depends on what users risk, whether they can win money or other property, how outcomes are decided, and whether the operator is authorized under Indiana’s sports wagering law. Sports betting offered online or at retail is authorized only within the framework the Indiana Gaming Commission (IGC) administers under IC 4-38. Products outside that framework that involve risking money or property for a chance at gain can fall under Indiana’s general gambling definition, and the IGC states that unauthorized operations, including unlicensed betting pools, are unlawful.

Why the word “social” does not settle the question

“Social sportsbook” is a marketing label, not a legal category. Neither Indiana’s gambling statute nor the IGC guidance reviewed for this article creates an exemption for products that use the term. Free play, virtual currency, and sweepstakes-style language do not, by themselves, answer whether a product is lawful. A service can look like a free game and still involve paid entries, redeemable value, or wagers that are decided by chance. The label is only a starting point; the product’s actual terms and mechanics decide the analysis.

The sources reviewed also do not contain a court decision or regulator determination covering every product sold under this name. That means no article can responsibly declare all social sportsbooks legal or all of them illegal. What can be stated with confidence is the framework that applies to any of them.

Indiana’s general definition of gambling

The 2025 Indiana Code text reproduced by Justia defines “gambling” as risking money or other property for gain, where the outcome is contingent in whole or in part on lot, chance, or the operation of a gambling device. The definition excludes bona fide contests of skill, speed, strength, or endurance in which awards go only to entrants or entry owners, and bona fide business transactions that are valid under contract law. The code also defines “gain” as the direct realization of winnings. Those three elements, risk, gain, and chance, are the core of the analysis for any product. Indiana Code §§ 35-45-5-1 and 35-45-5-2 (2025), as reproduced by Justia sets out the wording.

The IGC’s enforcement page summarizes the rule in the same terms, describing unlawful gambling as risking money or property for gain contingent upon chance, excluding bona fide contests of skill, speed, strength, or endurance. The agency also states the principle that matters most for unlicensed products:

“Any gambling operation not explicitly authorized by the state, such as unlicensed betting pools and unauthorized lotteries, is deemed unlawful.” (Indiana Gaming Commission, Illegal Gambling guidance, IGC enforcement page)

That quotation is agency guidance, not a court holding, and it does not classify any specific app. It does show that authorization, not the product’s name, is the controlling question.

  1. Identify what the user puts at risk. Look for purchases, paid entry fees, deposits, or any currency that can be exchanged for value. Read the terms, not the marketing copy, because free-looking products often require payment to continue or to unlock wagers.
  2. Identify what can be won or redeemed. Determine whether winnings can be cashed out, converted into money or property, or used to obtain prizes. Nonredeemable points that have no cash or property value are a different question from redeemable value.
  3. Determine how results are decided. Establish whether outcomes depend on chance, on skill, or on a mix. A bona fide contest of skill is treated differently from a wager on an uncertain event, but the exclusion is narrow and fact-specific.
  4. Identify the operator and its authorization. In Indiana, sports wagering is run by an IC 4-38 certificate holder or its contracted vendor. Check the operator against the IGC sportsbook contact directory, which lists retail venues and mobile operators and is marked current as of July 29, 2026. A product that does not appear there, or that describes itself as an informal pool, should be treated with caution.
  5. Check for a separate statutory category. Paid fantasy sports fall under IC 4-33-24, not IC 4-38. A free-to-play product may be governed differently from a paid one.
  6. Seek current guidance when the answer is unclear. If the product involves virtual currency, cash prizes, or point redemption, get a written determination from the IGC or from a qualified Indiana attorney before relying on it.

The authorized sports wagering channel

The IGC says sports wagering was established by House Enrolled Act 1015 (2019) and is contained in IC 4-38. A person holding an IC 4-38 certificate of authority may conduct sports wagering. Under the IGC’s FAQ, only Indiana casinos, racinos, or off-track betting facilities can receive that certificate. A certificate holder may contract with a vendor to run a retail or online sportsbook, and the IGC regulates sportsbook operations and approves sportsbook technology. The FAQ was last updated March 26, 2024, so check the current FAQ and the sports wagering program overview for newer details.

Penalties for unlawful gambling

The 2025 Code reproduction states that a person who knowingly or intentionally engages in gambling commits unlawful gambling, generally a Class B misdemeanor. It separately states that an operator who knowingly or intentionally uses the Internet to engage in unlawful gambling in Indiana, or with a person located in Indiana, commits a Level 6 felony. These penalty descriptions come from a third-party reproduction. The official Indiana General Assembly code page did not display statutory text when checked, so confirm the current wording on the IGC statutes and rules index and the official General Assembly site before relying on penalty language in a legal document.

Self-restriction and wagering limits

The IGC FAQ describes two self-restriction options for patrons. The Voluntary Exclusion Program restricts sports wagering and casino gambling. The statewide Internet Self-Restriction Program (ISRP) covers online wagers and offers one-year or five-year periods. A patron must request removal after the selected term ends. The FAQ also says operators must provide an easy and obvious way to set wagering limits. Because the FAQ predates the current directory, confirm enrollment steps and program details through the IGC’s program pages.

What this means in practice

A social sportsbook is not lawful or unlawful because of its name. It is lawful in Indiana only where its mechanics and operator fit an authorized framework, and where a product offers no risk-for-gain structure that falls within the general definition. Readers who are unsure should treat any product that asks for payment, offers redeemable winnings, and lacks a clear Indiana authorization as a product that needs a formal legal review.
